Paradigm of reforming higher legal education in Ukraine in the context of training practising students

The relevance of the study was explained by a special public demand for the quality of legal education, ensuring compliance of the content of legal education with modern requirements of the labour market and the tasks of professional activity of lawyers. The purpose of the study was to consider methodological, research and theoretical, legislative, educational, and methodological foundations regarding the practical orientation of the educational process of training lawyers as a paradigm for reforming higher legal education and determining the forms of organising the educational process aimed at improving the quality of legal education. The methodological framework of the study was formed considering philosophical, general scientific, and special scientific methods of scientific cognition. Conceptual approaches to the introduction of possible methodological forms of organising practical training of students into the educational process of higher legal educational institutions were proposed, considering the elements of the Bologna Process and the development of a unified educational space according to the European vector of development of Ukraine. The study considered methodological, scientific and theoretical, legal, and methodological foundations for a general understanding of the practical training of law students in the educational process, its functional purpose in the context of implementing the reform of legal education as a component of legal reform in Ukraine. The study emphasised the necessity of preserving and further developing fundamental higher legal education and combine it with the established national and foreign doctrines of law and the practical orientation of the educational process as a paradigm for reforming legal education in Ukraine. It was concluded that the development of practical skills and abilities of a legal education applicant occurs in the educational process due to various forms of methodological organisation of the educational process. In particular, the authors considered the features of conducting practical classes using case methods and solving incidents, as well as binary classes, practical training, working in a law clinic, performing dual education, taking part in court debates, etc. The practical value of this study lies in the fact that it proved the advisability of preserving the national traditions of higher legal education in the educational process and introducing new, progressive forms of the educational process aimed at improving the quality of higher legal education, which would meet the requirements of the labour market and the challenges facing a modern democratic society, global development trends and tasks of professional activity of lawyers in various fields

The paper analyzes the system of legal education in Lithuania. It provides a short historical overview and recent developments in this area. On the one hand, higher education institutions try to implement main goals of the Bologna Process and to provide two-cycle studies in the field of law. On the other hand, there are still very strong ties to the traditional one-stage model of legal studies. Thus, universities try to combine both these models and offer both two-stage and one-stage studies. In such a situation students are given an opportunity to choose the model they prefer. The paper gives an insight into the programs of studies offered by the universities in Lithuania. The last thing discussed in the article is the issue of securing quality of legal studies.

The task of vocational education at the present stage of development of society is to train competitive professionals with professional mobility, skills of rapid adaptation to changing conditions of society, methods of self-education, improving the quality of their own professional activities and its product. The article analyzes the modern model of practical training of teachers, namely: future educators of preschool education and primary school teachers in the educational process of the Pedagogical Institute of Borys Grinchenko Kyiv University. The current modernization of the domestic education system creates increased requirements for the quality of training of modern teachers, which is not only to modernize the content of profile-oriented disciplines, but also requires appropriate organization of various types of pedagogical practice. The authors investigate various aspects of training future teachers to carry out professional activities in preschool and primary schools. In particular, the activities of the Center for Self-Knowledge and Self-Development, the Center for Innovative Educational Technologies (ICR), the Educational Laboratory of Creative Pedagogy are substantiated, providing a combination of scientific achievements and practice in the educational process. It is in the process of training in these centers that students have the opportunity to model different components of future pedagogical activities and choose different ways to solve them given the proposed features of the pedagogical situation, which will further contribute to the formation of future teachers holistic perception of professional activity. all participants in the educational process, the ability to make independent decisions and respond quickly to the challenges of everyday teaching. The peculiarities of students’ work in the centers in classroom and extracurricular classes are revealed, in the process of which future preschool educators and primary school teachers have the opportunity to participate in interdisciplinary projects, trainings, master innovative and digital teaching tools. component of the educational process and ensures the competitiveness of young professionals. The article identifies tools for information and educational environment that should be used in working with students (STEAM-education, storytelling, kahoot, answergarden), which will promote the development of future teachers’ ability to self-presentation, the effective formation of their professional competence. The article is devoted to the analysis of modern approaches to the organization of the educational process, which would contribute to the formation of a category of lawyers with the necessary knowledge and are capable of preparing and implementing reforms in the political and legal system of their state. It is determined that modern legal education poses its own requirements to the applicant, namely to be a comprehensively developed, independent, self-sufficient person, guided in life by his own knowledge and beliefs, in this regard, the issue of professional training of a modern lawyer, which could withstand modern challenges, becomes especially relevant. It is noted that the training of the future lawyer should be aimed at forming a versatile specialist (lawyer), ready to fulfill a complex set of modern practical tasks for the legal protection of the rights, freedoms and legitimate interests of a person and citizen. On this basis, the training of future lawyers should take into account modern approaches to the educational process. The most important of them are analyzed on the example of the National University of Life and Environmental Sciences of Ukraine (hereinafter - NULES of Ukraine). First, the quality of specialists’ training substantially depends on quality of teaching subject matters which is defined by providing applicants with the corresponding training material (modern qualitative textbooks, manuals, study guides, didactic materials, etc.). And most importantly - the use of computer technology, electronic educational resources, with the help of which the interaction of the sphere of higher education with other spheres of life of society is ensured. Of course, modern ICTs increase the efficiency of the educational process, open the possibility of introducing completely new methods of teaching and learning. However, the implications of the growing importance of ICT in general, and the Internet in particular, should also be taken into account. The use of modern ICTs has become an integral part of the educational process of NULES of Ukraine during the Covid-19 pandemic. Secondly, taking into account modern trends in the field of education, the training of future lawyers should not ignore one of the most important indicators of the quality of higher legal education - the use of a foreign language in the educational process, in particular English. In particular, the NULES of Ukraine provides teaching in English of certain legal disciplines for applicants for higher education of the first (bachelor's) level. Thirdly, the training of a lawyer should be not only theoretical, but also practical. Practical training of a lawyer involves work during practical classes, internships in enterprises, institutions and organizations, self-training by independently performing certain tasks. However, it is worth highlighting another form of practical component of the training of future lawyers - these are legal clinics. To date, such a form of specialists’ practical training in the field of law has been effectively introduced into the educational process of higher educational institutions of Ukraine of the III-IV levels of accreditation. NULES of Ukraine is no exception. The Legal Clinic «Protection and Justice» operates on the basis of the Department of International Law and Comparative Law. It is proved that the quality of specialists’ training in the field of law depends on many factors (the use of modern ICT in the educational process, electronic educational resources, the possibilities of foreign languages in teaching legal disciplines, etc.). However, to a large extent, the quality of training depends on the practical component of the educational process, and therefore special attention should be paid to this component. More than once it was said that it is objectively impossible to prepare for four years in the university a universal specialist, ready for legal practice immediately after receiving diploma; that is still not found treatment of a disease called "substandard legal education". In 2006, the rector of the Moscow State Law University Oleg Kutafin said: "We hope that the decision on the switchover to the Bologna system for law schools will be canceled "; "In general, I welcome the Bologna process, but it does not mean that we must blindly copy other systems. In our country law schools used to prepare specialists of wide profile, which can then become a judge, a prosecutor, and a lawyer. We believe that breaking this system is dangerous for the legal field of the country ". Unfortunately, so far the hopes of Academician Kutafin do not meet the expectations. Bachelor - Master programs continue to be realized. Rector of Moscow State University. after M.V. Lomonosov Victor Sadovnichy called a mistake the transition to the Bologna system of higher education and proposed to return to the five-year education. There are more cons of implementation of the Bologna system in legal education in Russia is more than pluses. A serious modernization of the specialty programs is required. No less important is the creation of a system of real motivations for teaching staff of law schools, including a decent payment for teaching activities. To promote the quality of educating of lawyers in our country could the system, similar to existing in Germany. On February 16, 2017 Federal state educational standard of Higher education 40.05.04: judicial and prosecutorial activities (level of specialty) was approved. I would like to hope that in the nearest future relevant standards for all Legal specialties time will be approved. If the legal community of Russia will not unite in such an important issue as the transmission of the legal education on the "modernized specialty", and will not make the state to adopt the appropriate decision, then the worst Oleg Kutafin’s fears regarding legal field of the country may come true.

Качество образования во многом обусловлено готовностью выпускников выполнять служебные (трудовые) обязанности. Практическая подготовка в образовательных организациях МВД России стремится приблизить образовательный процесс к условиям профессиональной деятельности. В статье предпринята попытка не только предложить решение проблемных вопросов, возникающих в сфере практической подготовки обучающихся, но и обосновать ее связь с реализацией конституционного права на образование. Научное осмысление предложенных постулатов способно создать эффективную модель практической подготовки в вузах МВД России. The quality of education is largely by the graduates’ readiness to perform their official (labor) duties. Practical training at educational institutions of the Ministry of Internal Affairs of the Russian Federation tends to bring the educational process closer to the conditions of professional activity. The author makes an attempt not only to propose the solution of problematic issues in the field of the practical training, but to substantiate its connection with the implementation of the constitutional right to education. The scientific interpretation of the proposed postulates can create an effective model of practical training at higher educational institutions of the MIA of Russia.

The Bologna Declaration of 19 June 1999, committed 29 European nations, including Germany, to develop a system of higher educationbased on two main cycles, undergraduate and graduate. Access to the second cycle shall require successful completion of first cycle studies, lasting a minimum of three years. The degree awarded after the first cycle shall also be relevant to the European labour market as an appropriate level of qualification. The second cycle should lead to the master and/or doctorate degree as in many European countries.

The article is dedicated to the problems of international educational standards. The areas in which at present at the national and international levels active work is underway on standardization and drawing up a unifi ed system of requirements are identifi ed. The defi nition of educational activity, which is understood as a purposeful activity involving a certain form of communication aimed at learning, is clarifi ed. The stages of development of standards of the Bologna process are allocated. In accordance with the main objectives and requirements of the Bologna process, the main standards and guidelines for assessing and ensuring the quality of higher education developed and published by ENQA are grouped into three groups: internal standards for ensuring the quality of education; standards for assessing the quality of the educational process by the external environment; standards for the activities of specialized agencies for assessing the quality of education. It covers major aspects of internal and external quality standards.

The continuous modernization of the education system makes the problems of the quality of teacher training increasingly relevant. Moreover, the measures taken to improve the system of teacher education are largely confined to the introduction of new organizational and managerial mechanisms and practically do not affect the internal content and technological structure of the teacher training process.Modern pedagogical universities are constantly looking for innovative models of training teachers that will be able to solve non-standard social and professional tasks. However, recent studies in this area do not fully take into account the nature of pedagogical activity and conditions of its formation. Thus, the need arises for a special study of the processes and means of updating the content and technologies of teacher training in order to control the level of students’ professional competencies development, as required by educational and professional standards. This means the creation of a special educational system in a pedagogical university, which can provide a harmonious and synchronous mastering by future specialists of both subject knowledge and methods of pedagogical activity.The article provides a theoretical study aimed at identifying key patterns of designing a new content for teacher education, the basis of which is the formation of a future teacher as a subject of his own professional activity. The author describes the experience of using a subject-oriented model of education, implemented at Bashkir State Pedagogical University n.a. M. Akmulla. The effectiveness of this model is confirmed by the high level of students’ mastery of designing methods and constructing the educational process, as well as their positive experience in the implementation of educational activities.

Представлены результаты исследования, затронувшего актуальную проблему системы профессионального юридического образования, – степень соответствия специалиста требованиям рынка труда, а также повышение качества их практической подготовки. Научно обоснована эффективность применения практико-ориентированных технологий в образовательном процессе колледжа с целью успешной адаптации будущих юристов в профессиональной деятельности. В качестве основного метода исследования выступил педагогический эксперимент, целью которого стала апробация практико-ориентированных технологий в процессе обучения. В исследовании использованы методы анализа и обобщения, опрос, тестирование, педагогическое наблюдение и методы математической статистики. Представленные практико-ориентированные технологии направлены на овладение обучающимися профессиональных компетенций и предусматривают поэтапное прохождение студентом трех модулей: целеполагание дидактических циклов, отбор оптимальных средств с учетом особенностей этапа обучения, реализация образовательной деятельности, характеризуемой интеграцией проектной и проблемной технологий при соблюдении условия дифференцированного обучения. Введение в образовательный процесс практико-ориентированных технологий обучения студентов колледжа – будущих юристов, предусматривающих поэтапное освоение знаний и умений, позволяет на достоверном уровне сформировать основные профессиональные компетенции у обучающихся с целью их успешной адаптации в будущей профессии юриста. Применение в процессе обучения деятельностных и интерактивных методов, введение имитационного моделирования и проектирования, а также технологии решения ситуационных задач можно рассматривать в качестве эффективного инструмента формирования у студентов профессионально-ориентированных умений и навыков. The article presents the results of the study that touched upon the actual problem of the system of professional legal education – the degree of specialist’s compliance with the requirements of the labor market as well as the improvement of the quality of their practical training. The aim of the study is to scientifically substantiate the effectiveness of practiceoriented technologies in the educational process of the college in order to successfully adapt future lawyers in professional activities. The main method of research is a pedagogical experiment, the purpose of which is approbation of the developed author’s methodology. Also, the study used methods of analysis and generalization, questioning, testing, pedagogical observation and methods of mathematical statistics. The presented practice-oriented technologies are aimed at mastering students’ professional competencies and provide for the gradual passage of three modules by the student: goal-setting of didactic cycles, selection of optimal means taking into account peculiarities of the training stage, implementation of educational activity characterized by integration of project and problem-based technologies while observing conditions of differentiated training. According to the results obtained during the implementation of the pedagogical experiment, the introduction of practice-oriented technologies in the educational process of training college students of future lawyers, providing for the gradual development of knowledge and skills, allowed to form the basic professional competencies of students at a reliable level. Thus, the use of activity and interactive methods in the learning process, the introduction of simulation modeling and design, as well as technology for solving situational tasks can be considered as an effective tool for shaping students’ professional-oriented skills and abilities.

Legal clinical education as an innovative form of legal education is studied in the article. The analysis of the influence of the legal clinic on the formation of the legal consciousness and culture of the future lawyer, his formation as a specialist is carried out. The process of modernization of legal education in Ukraine, where the emphasis is on the practical training of future lawyers, and where clinical education plays a crucial role is considered. It is substantiated that legal clinic is a necessary component in obtaining the profession of a lawyer; consolidation of theoretical knowledge and acquisition of practical skills by students, implementation of legal education activities, provision of free legal aid to people in need are grounded. It is proved that the presence of legal clinics within the structure of higher education institutions, their activities and importance for improving the practical training of future lawyers indicates the indisputability of the necessity to study and research legal clinical education. Emphasis is placed on the need to improve the system of future lawyers training. It is legal clinical education that is the best form of legal influence on a person, and is an integral part of the overall reform of higher education, which is being carried out today in Ukraine and aims to train lawyers with high level of competencies and legal awareness. Legal clinics allow students to be creatively realized, to reveal their intellectual potential; and are a link between the traditional educational process and future practical activities. Increase the number of legal clinics, separation of legal clinics into a separate structural unit with the staff in all higher education institutions, the introduction of teaching of a mandatory course in legal clinical education will contribute to the formation of a future lawyer. Legal clinic is a special kind of legal education (for the population) and an innovative form of legal education (for the applicants for law schools).
