La investigación tiene como objetivo determinar si los gobiernos municipales de la provincia de Santo Domingo de los Tsáchilas, Ecuador, como parte esencial de la administración pública elaboran el presupuesto anual de manera participativa, como lo determina la Constitución de la República, el Código Orgánico de Organización Territorial, Autonomía y Descentralización, Código Orgánico de planificación y Finanzas Públicas y el código orgánico de Participación Ciudadana. El desarrollo de la metodología se establece a través de un enfoque mixto, con una población de estudio en los cantones de Santo Domingo y La Concordia, se aplicaron 385 encuestas con un cuestionario estructurado y también semiestructurado a hombres y mujeres entre 18 y 69 años, se realizaron entrevistas a líderes de opinión tanto locales como nacionales; la técnica de observación, fue empleada en visitas a las zonas vulnerables, además se realizó una experimentación social. Dentro de los resultados, se evidencian las causas para el deficiente acceso a las necesidades prioritarias y las razones para que los recursos económicos que ingresan a la entidad municipal no son distribuidos de manera adecuada. Existe un marco legal propicio para que los gobiernos locales elaboren su presupuesto de forma participativa, de acuerdo a los datos obtenidos en la encuesta, existe carencia de un modelo de gestión simplificado.   The objective of the investigation is to determine whether the municipal governments of the province of Santo Domingo de los Tsáchilas, Ecuador, as an essential part of the public administration, prepare the annual budget in a participatory manner, as determined by the Constitution of the Republic, the Organic Code of Territorial Organization, Autonomy and Decentralization, Organic Code of Planning and Public Finance and the Organic Code of Citizen Participation. The development of the methodology is established through a mixed approach, with a study population in the cantons of Santo Domingo and La Concordia, 385 surveys were applied with a structured and semi-structured questionnaire to men and women between 18 and 69 years old. interviews were conducted with local and national opinion leaders; The observation technique was used in visits to vulnerable areas, and a social experimentation was also carried out. Among the results, the causes for the deficient access to the priority needs and the reasons for the economic resources that enter the municipal entity are not distributed adequately. There is a favorable legal framework for local governments to prepare their budget in a participatory way, according to the data obtained in the survey, there is a lack of a simplified management model.

Es importante la gestión presupuestaria para superar la debilidad y deficiencia en la implementación del presupuesto participativo en los gobiernos municipales de la provincia de Santo Domingo de los Tsáchilas; el objetivo busca que las entidades tengan una herramienta para elaborar el presupuesto y cumplan con el marco legal. Pese a las leyes, se observa debilidad en la gestión que provoca que los recursos asignados por el gobierno central y los recaudados no lleguen a los sectores vulnerables. La investigación se desarrolló en los cantones Santo Domingo y La Concordia, Se abordó, el enfoque mixto, se realizaron 656 encuestas con cuestionario estructurado y semiestructurado a personas mayores de edad, entrevistas a las autoridades, equipo técnico y a líderes de opinión. Los resultados evidenciaron el deficiente acceso a las necesidades prioritarias, debilidad de gestión, se concluye, que los recursos propios y las asignaciones no son distribuidos de manera participativa, equitativa y solidaria.   Palabras clave: participación social, política, derechos, economía, gestión   ABSTRACT Budget management is important to overcome the weakness and deficiency in the implementation of the participatory budget in the municipal governments of the province of Santo Domingo de los Tsáchilas; The objective is for entities to have a tool to prepare the budget and comply with the legal framework. The need for effective, capable self-government inevitably faces the need to change the spatial organization of local governments. In turn, the territorial organization of executive bodies also turned out to be far from optimal. In Ukraine, there have been discussions for many years about the reorganization (reform) of the entire system of public power in the country. But they have mainly always concerned the redistribution of powers in the power triangle at the national level: President - Parliament - Government. Since independence, changes have taken place here many times. However, despite the changes taking place in this redistribution at the national level, people living in specific towns and villages continue to face the same problems. To date, not clear enough mechanisms have been implemented to form effective local self-government and territorial organization of government to ensure the provision of high quality and affordable public services, meet the interests of citizens in all spheres of life in the territory, harmonize the interests of the state and local communities, establishing cooperation between the authorities and local governments. Currently, the second stage of decentralization in Ukraine continues in 2020-2021. The Cabinet of Ministers of Ukraine has identified the need for further reform process, introduction of decentralization in Ukraine as one of the priorities in the state, which will continue the development of local self-government, territorial communities and in general will enable the growth of Ukraine's economic indicators. In this regard, this article is aimed at studying the state of administrative-territorial reform in Ukraine, as well as outlining areas for improving the legal aspect of decentralization reform in Ukraine, as for further development of the legal framework, to continue the reform requires a number of important laws.

For the first time in the history of humanity, the world encountered a global emergency that showed all the weaknesses of emergency management and the unwillingness of states to respond to that challenge adequately. Although it is evident that the governments in which the state-owned health care system adapted more quickly to the epidemic, it was also apparent that the emergency management was practically on local governments, but also that the states with a clearly defined legal framework and established management systems emergencies are easier to deal with such an emergency. In the Republic of Serbia, there is a legally prescribed procedure for acting in epidemics, which is a sufficient basis for engaging emergency management. The organizational challenges of the epidemic are practically the responsibility of local self-government units, and so far, although the epidemic is still ongoing, according to available data, it seems that they are adequately responding to that challenge. This paper is based on the legal framework analysis for introducing the state of emergency and the practical research of the engagement of local self-governments during the epidemic.

The article focuses on the issue of Croatia’s ethnic policy towards minorities at the level of administrative and territorial organization. It attempts to answer the question whether and to what extent the ethnic and territorial conflict in the 1990s influenced the processes of transformation of the administrative and territorial organization of the state. The Croatian state, given as an example, at the time of declaring its independence in 1991 had to face the threat of territorial disintegration from the Serb minority living in its territory. The Italian minority was also suspected of such tendencies, but it soon turned out that these suspicions were groundless. The Serbian community could, however, threaten the unification of the state, which initially happened as a result of an armed conflict. After its end, fears did not diminish, especially in the face of the changes in territorial borders that took place until the end of the first decade of the 21st century. The threat could be reduced using one of the tools, which was the local government administration and the shape of its territorial units. The Author analyses this issue basing on the projects of Croatian experts dealing with the issues of administrative and territorial organization of the last three decades and at various stages of Croatian statehood, data on demographic changes and laws regulating the functioning of local and regional local governments as well as regulations concerning the position of national minorities in the state.

Student of the Department of Municipal Law of the Law Institute of the Peoples’ Friendship University of Russia (PFUR) This article examines the legal framework for the organization and functioning of local government in the Finnish Democratic Republic. The characteristic features inherent in the development of local self-government in such a Scandinavian country as Finland are analyzed. The active activity at the local level of government in the Republic of Finland is quite progressive. In Finland, local governments are decentralized and characterized by a high degree of autonomy and independence. Particular attention is paid to programs implemented in the communes. The conclusion is made about the productive influence of local authorities on the development of the state. The functions of local self-government bodies in various areas are discussed in detail. The article also pays special attention to the Association of Local and Regional Authorities of Finland, which provides the necessary assistance and protection to municipalities. Thus, close contact of local authorities with residents of communes has a positive impact not only on the development of municipalities, but also on the economic development of the entire state.

In the wake of the economic crisis in 2007, many municipal governments faced a variety of financial challenges. Scholars and practitioners call for citizen participation in various parts of government; however, it is unclear how efforts to engage the public can be sustained when municipalities undergo tough financial times. This research explores the impact of internal and external factors—(a) impact of financial crisis, (b) environmental and organizational complexity, and (c) administrative decentralization—on whether citizens are given the opportunity and resources to be involved in decision-making. Findings suggest that, despite their concerns for the diminishing fiscal capacity, local governments provide supportive institutional arrangements that may encourage public participation. Organizational complexity in local government also has a positive impact on facilitating public involvement and providing resource. Finally, the analyses indicate mixed findings for environmental complexity faced by local jurisdictions.

This article presents the basic aspects of noncommercial concession theory and determines the possible results of its use. Noncommercial concession is an analog of franchising, which transfers advantages of its use onto the level of subfederal and local authorities interaction. Legal framework of noncommercial concession is based on the regional laws and regulations, signed between regional and municipal governments. Intermunicipal social and economic development alignment is a result of noncommercial concession introduction that reduces social tension in both donor municipalities and recipients. The main instruments of intermunicipal alignment are: unification of regional and municipal control and planning systems, creation and implementation of uniform strategic and branch planning documentation system, a possibility for regional government to exert a directive influence on local governments within the signed contracts, accelerated development on the territory of the Russian Federation using noncommercial concession, those branches which have been recognized as priority ones resulting from a comprehensive analysis of the current situation.

SYNOPSIS We examine whether unfunded public pension liabilities are associated with citizen oversight through legislative and electoral means in local governments. Our focus on municipal pension plans is timely and relevant, given the prevalence of underfunded pension plans and the GASB's recently issued statements on state and local pension reporting. Using a sample of 84 locally administered municipal defined benefit pension plans in 2009, we find evidence that the level of unfunded pension obligations is negatively associated with both provisions allowing direct citizen participation in the legislative process and electoral voter activism in the form of recent recall attempts. Overall, our empirical evidence is consistent with citizen oversight mechanisms playing an important role in the pension funding decisions of municipal governments. Engaging citizens in the decision-making process is becoming an important priority for many local governments. This article evaluates three citizen engagement events in two jurisdictions in western New York: public forums held by the Buffalo Fiscal Stability Authority, Citizen Participation Academy, and Participatory Budgeting Project. Using in-depth interviews with public and nonprofit employees, the article outlines several findings, including a distinctly higher level of effectiveness of engagement strategies when advanced by not-for-profit organizations. The engagement initiated by state and municipal governments reflects authoritarian and bureaucratic models of participation. This study highlights several challenges to the sustainability of citizen involvement at municipal levels, and its results have important implications for other towns implementing participatory tools. RÉSUMÉ Pour plusieurs gouvernements locaux, l’engagement des citoyens dans la prise de décision devient prioritaire. Cet article examine cette situation en évaluant trois événements portant sur l’engagement des citoyens dans deux juridictions de l’ouest de l’État du New York, à savoir des forums publics organisés par le Buffalo Fiscal Stability Authority, le Citizen Participation Academy et le Participatory Budgeting Project. Au moyen d’entrevues en profondeur auprès d’employés des secteurs public et sans but lucratif, cet article fait plusieurs constats, y compris celui d’une efficacité beaucoup plus grande des stratégies d’engagement suivies par les organisations sans but lucratif. En revanche, l’engagement sollicité par les gouvernements des États et des municipalités reflète des modèles de participation relativement autoritaires et bureaucratiques. Cette étude souligne plusieurs défis soulevés au niveau municipal par les tentatives d’inclure la citoyenneté. Les résultats de cette étude ont des implications importantes pour d’autres villes qui s’efforcent d’encourager la participation.
