Dozens of Deeper Reasons for Denial in Internationalizing IndoNepal Border Dispute

Nepal has been having quite endless and unsolved ruffle with neighbouring nation India in light of border dispute. Since long, despite cordial and amicable nexus as well as having almost an airproof proximity in terms of culture, social values and other traits, often Nepal has to present a gesture of unceremonious unwelcome and decent denial over India’s highhanded stance on border issues, more precisely an act of an unethical encroachment. Given the situation, many scholars and analysts often urge and strongly counsel Nepal to internationalize the issue and bring it in notice of International Court of Justice, hereafter said only ICJ. This paper makes an engagement to analyse dozens of prominent bases on why not this will be a beneficial issue for Nepal; thus, Nepal has to more rationally explore other diplomatic routes to resolve it, or should forbid on internationalizing it.

<p align="center"><strong>A</strong><strong>b</strong><strong>s</strong><strong>t</strong><strong>rac</strong><strong>t</strong></p><p><em>T</em><em>his study discusses alternative resolutions on maritime boundary dispute between Indonesia and Malay- sia. It was based on a legal research, which used statutes and case approach. The research materials were collected by literature study and analyzed by applying the interpretation analysis technique.T</em><em>he result shows that the alternative resolutions of Indonesia-Malaysia border dispute can be carried out through several mechanisms. First, by referring to the UNCLOS 1982, through Bilateral Mutual Agreement on drawing an equidistant line using the equity principle and considering relevant circumstances. Second, by means of ASEAN; and third, by means of International Court of Justice mechanism regarding the equitable principle and relevant circumstances.</em></p><p><strong><em>Keywords: </em></strong><em>the outermost islands, border management, maritime dispute settlement, archipelagic state</em></p><p> </p><p align="center"><strong>A</strong><strong>B</strong><strong>S</strong><strong>T</strong><strong>R</strong><strong>A</strong><strong>K</strong></p><p>Penelitian ini membahas alternatif penyelesaian sengketa batas maritim antara Indonesia dan Malaysia. Kajian ini berdasarkan penelitian hukum dengan menggunakan pendekatan undang-undang dan pendekatan kasus. Pengumpulan bahan hukum melalui studi kepustakaan dan dianalisis dengan teknik analisis interpretasi hukum. Hasil pembahasan menunjukkan alternatif penyelesaian sengketa batas wilayah Indonesia-Malaysia dapat dilakukan dengan beberapa cara. <em>Pertama</em>, mengacu pada UNCLOS 1982 melalui <em>Bilateral Mutual </em><em>Agree- ment </em>dalam menarik garis sementara yang menggunakan prinsip sama jarak dan mempertimbangkan faktor yang relevan, <em>kedua,  </em>melalui mekanisme ASEAN, dan k<em>etiga</em>, melalui mekanisme Mahkamah Internasional dengan mengedepankan <em>equitable principle </em>dan <em>relevant circumstances.</em></p><p><strong>Kata kunci : </strong>Pulau-pulau terluar, pengelolaan batas wilayah, penyelesaian sengketa maritim, negara kepulauan</p>

The chamber of the ICJ entrusted with solving the Benin–Niger dispute based its judgment on the colonial heritage left to the two countries at the time of their independence, as prescribed by the uti possidetis juris principle. The dispute actually stemmed from that heritage: the chamber's role was to interpret and clarify it. But while the uti possidetis juris principle underlines border stability, features such as river boundaries, because of their intrinsic movable nature, can put this stability under intense strain. The judgment lends itself to further reflections on this dichotomy, since the disputed areas revolved around two rivers.

On 11th November 2013, the International Court of Justice issued a judgment regarding the request for Interpretation of the Judgment of 15th June 1962 in the case concerning the Temple of Preah Vihear, a border dispute between the Kingdoms of Cambodia and Thailand. In this article, the authors have elaborated both the original judgment and its recent interpretation. They begin by providing the historical context that led to the dispute before the Court. The main part of the article is dedicated to the legal analysis of the judgment and its interpretation. Special attention is given to the Court?s manner of reasoning and the implications which this manner has for the substantial settlement of the dispute and the clarification of several principles of international law that deal with territorial delimitation between states on natural borders, but also to the wider jurisprudence of the Court in similar instances.

В статье автором предпринята попытка по ее всестороннему анализу. The Statute of the UN International Court of Justice contains a provision that the competence of the Court includes not only the function of resolving any kind of international disputes arising between two or more states, but also the function of providing advice on any emerging issues of an international nature. In the article, the author made an attempt to comprehensively analyze it.
