AbstractThe sport of surfing is best enjoyed with one rider on one wave, but crowding makes that optimal assignment increasingly hard to attain. This study examines the phenomenon of surf localism, whereby competitors are excluded from waves by intimidation and the threat of violence. An alternative way to accommodate crowds is contained in the surfer’s code, which sets informal rules and self-enforced regulations to avoid conflict in the water. Both regimes establish property rights over common pool resources with no state intervention, creating a setting wherein users face the question of cooperation or conflict. The disposition to cooperate and follow norms has been shown to vary substantially across different cultures, though. Employing data from over seven hundred surf spots on the European Atlantic coast, this study reports evidence that certain informal cultural norms significantly reduce the probability of violent exclusion, while formal state institutions mostly are irrelevant. The results also indicate that informal norms become more important with greater resource quality and, possibly, with increasing scarcity.

The appeals to minimize state intervention in the Russian economy are counterproductive. However the excessive involvement of the state is fraught with the threat of building nomenclature capitalism. That is the main idea of the series of articles by prominent representatives of Russian economic thought who formulate their position on key elements of the long-term strategy of Russia’s development. The articles deal with such important issues as Russia’s economic policy, transition to knowledge-based economy, basic directions of monetary and structural policies, strengthening of property rights, development of human potential, foreign economic priorities of our state.

In this article, I examine whether information ethics is culture relative. If it is, different approaches to information ethics are required in different cultures and societies. This would have major implications for the current, predominantly Western approach to information ethics. If it is not, there must be concepts and principles of information ethics that have universal validity. What would they be? The descriptive evidence is for the cultural relativity of information ethics will be studied by examining cultural differences between ethical attitudes towards privacy, freedom of information, and intellectual property rights in Western and non-Western cultures. I then analyze what the implications of these findings are for the metaethical question of whether moral claims must be justified differently in different cultures. Finally, I evaluate what the implications are for the practice of information ethics in a cross-cultural context.

With the aim of improving farmland use efficiency without damaging the social function of farmland, Chinese policymakers have proposed the ‘trifurcation of land rights’ reform. When it comes to realization of the law, however, neither the Ownership Model nor the Bundle of Sticks Model can adequately explain this reform. The tree concept of property, which provides a new perspective in delineating property rights based on the function served by specific properties, is thus adopted. We find that this tree concept of property helps to better understand and realize the trifurcated rights on farmland in China. Also, a balance between the social and economic functions of farmland can be reached through reconstruction of the property rights involved, a process which comprises three steps: identification of the nature of the newly-established rights; configuration of the rights and duties of relevant entities; and state intervention in the enforcement of relevant rights with the aim of realizing certain social values. Finally, this paper argues that success of this trifurcated structure requires a systematic design of the Chinese Civil Code. In particular, it requests further improvements in legal rules on farmland lease.

This article examines customary institutions governing rangeland resources in the Oromia Region, Ethiopia. Using data from different pastoral groups, we employed a case-study approach to explore how property rights are defined and enforced. The study indicates heterogeneity in systems of defining and enforcing rights. Due to the fugitive nature of resource use in pastoral systems, property rights vary seasonally. Though flexibility in the definition of such rights has become central to the survival of pastoral herders, formal administrative boundaries and policies have limited resource access, becoming sources of violent conflict and obstacle to customary systems. Government policies favouring private land use, expansion of large-scale investment on pastoral land, establishment of national parks, and certification of privately used land challenged the smooth functioning of customary land governance. This implies that state intervention should not undermine customary systems but permit them to exercise rangeland governance and ensure pastoral rights to secure livelihoods.

This contribution tries to unify two recent research strands in English linguistics: studies in academic writing and in New Englishes. This is useful because, in line with the prominent theory of social constructionism, discourses in both strands can be seen as practices of communities that negotiate their cultural norms. The relationship between language, cognition, and (national) culture is illustrated on the basis of several models, research and its application in teaching is discussed. A proposed socio-cognitive model offers new insights into old concepts and stimulates exchange in academic discourses between researchers from different cultures.

Background: Different countries may have different cultures that are influenced by their religion, traditions, or norms. These differences affect the way they speak, such as when they are commenting or giving opinions. Due to the way people express speech acts can be varied and lead to misinterpretation because of their differences, the researcher was intrigued to conduct this study. Methodology: This cross-cultural study was carried out to observe and compare the speech act of criticism between Korean and American YouTubers and to investigate the role of their cultural background in influencing the directness level they conveyed. First, the researcher selected three Korean Youtubers and Americans as well with food review content. Second, the researcher watched one video from each channel and took notes on every expression of criticism they used. Findings: The result of this study demonstrates that in American YouTubers speech, direct strategy emerges more frequently than the indirect one. Conversely, Korean YouTubers tend to use the indirect one. The finding also indicates that their speech behavior is related to their cultural norms, in which American culture encourages clear personal opinions, while Korean culture is a restraint to express their opinion or feeling clearly. Conclusion: Due to the considerable difference between Korean and American YouTuber speech, it can be concluded that culture takes a significant part in shaping one’s speech behavior. That is why people with different cultural backgrounds may have different ways of speaking.  Keywords: Criticism; cross-culture pragmatic; directness-indirectness.

However conceptualised, the institutions and relations associated with the state are clearly crucial to political ecological research. Environmental policies are enacted through state institutions, and property rights over land and resources are enforced by the legal framework and monopoly power associated with the state form. Nevertheless, political ecologists have sometimes had an uneasy relationship with conceptualisations of the state, leading to recurring questions over the adequacy of political ecological theorisations. Over the last decade and a half such questions have led to a call for dialogues with political geography and, more recently, with critical geopolitics. In this second progress report, I review recent political ecological theorisations of the state, pointing to a set of shared concerns associated with the processes, relations and struggles through which states are brought into being and acquire certain effects. I will conclude with a note of caution when it comes to an uncritical dialogue with more abstract interpretations of state power.

In this chapter, we propose the complementary model of culture and creativity (CMCC) to account for three pairs of contrasting forces that characterize the manners in which individuals manage their cultural experiences and that produce impacts on creative pursuits. We theorize three bidimensional psychological processes that explain the effects of culture on creativity: (a) stereotyping versus destabilizing cultural norms, (b) fixating on one cultural mindset versus alternating between cultural frames, and (c) distancing from versus integrating cultures. We contend that a broader and diversifying cultural experience offers an impetus to break down cultural confines, to oscillate between a variety of cultural perspectives, and to synthesize a multitude of ideas from different cultures, which can bring about discernible enduring benefits to creativity. We discuss the CMCC by putting it in the perspective of the state-of-the-art empirical findings on culture and creativity.

The Kingdom of Guatemala, a neglected backwater of the Spanish Empire under the Habsburgs, figured prominently in the long-term strategic planning of the Bourbon state. Royal preoccupation with this impoverished colony was reflected in the wide-ranging program of reform that the crown sought to put into practice in the isthmus over the course of the 18th century. For Philip V and his successors, the most pressing concern was the crown’s lack of control over the colony’s Caribbean coast (also known as the Mosquito Shore), a swampy and insalubrious region that for decades had been under the effective control of British interlopers and their native allies, the indomitable Sambo-Mosquitos. The main thrust of the reform project was therefore directed at addressing that serious security gap, a situation which, at the same time, severely limited Spain’s capacity to reap the benefits of Central America’s economy and trade. In its initial stages, the effort to implement the reforms proved to be a protracted and frustrating process, hampered by resistance from vested interests, lack of funds and personnel, natural disasters, and above all by recurring military conflict. It was not until the aftermath of the Seven Years War (1756–1763) that Charles III, facing the prospect of an even more damaging British attack, resolved to take decisive action and commanded his ministers to expedite the pace of reform. Royal orders were then issued that called for the de-Americanization and overhauling of the civil administration, direct state intervention to stimulate economic productivity and expand maritime trade, the establishment of a modern, efficient, crown-administered fiscal structure, the strengthening of the defense system, and the assertion of royal authority over the ecclesiastical establishment. Initially, the uncompromising manner utilized by the crown in introducing the changes, particularly the reforms to the fiscal system, provoked much unrest and resistance among wide segments of the population. But in the end, the reforms survived and, by the closing years of the century, most of the measures had largely met the crown’s objectives. The fiscal surplus generated by the economic and commercial expansion of the second half of the 18th century enabled the Bourbons to attain their principal strategic objective in Central America, namely dislodging the British enemy from much of the Atlantic coast. Unfortunately, not long after this climatic point, the decades-long effort quickly unraveled as the monarchy began to collapse in 1808. In the end, the reform project proved insufficient; the dream of attaining modernization and preeminent status among European powers remained elusive. As conditions in the mother country deteriorated, so did the economic and political stability of Central America. The kingdom’s provinces were engulfed by increasing political volatility and economic depression. Following the example of neighboring New Spain, Central Americans declared their independence in 1821. Thus, in the end, the Bourbons had “gained a revenue and lost an empire.”
