The association of specific neuropsychological deficits with capacity to consent to research or treatment

Informed consent is key to ethical clinical research and treatment, but partially rests on the ability of individual patients or research participants to use disclosed information to make a meaningful choice. Although the construct of decisional capacity emerged from legal and philosophical traditions, several investigators have begun examining the relationship of specific neuropsychological abilities to decisional capacity. This line of research may foster development of better consent procedures, as well as aid in refining the construct of decisional capacity toward a form that better reflects the underlying neurocognitive processes. We conducted a systematic search of the published literature and thereby identified and reviewed 16 published reports of empirical studies that examined the relationship between specific neuropsychological abilities and capacity to consent to research or treatment. Significant relationships between neuropsychological scores and decisional capacity were present across all the reviewed studies. The degree to which specific neuropsychological abilities have particular relevance to decisional capacity remains uncertain, but the existing studies provide a solid basis for a priori hypotheses for future investigations. These ongoing efforts represent an important conceptual and empirical bridge between bioethical, legal, and neuropsychological approaches to understanding meaningful decision-making processes. Ethics and personal values are two important theories that underlie management studies that analyze behaviors and decision-making processes. However, the relationship between these two themes is incipient and calls for in-depth investigation, mainly empirical studies. The present study aims at verifying the existence of relationships between personal values (Schwartz, 1992; Schwartz et al., 2012) and the ethical deontological and teleological rationalities. A survey into this issue was conducted with a sample of 453 Brazilian respondents. Consistent with the postulated hypotheses, the results showed that all individualistic-oriented values are positively related to teleological rationalities, just as all collectivist-oriented values are affirmatively related to deontological rationalities, except for the Tradition value. Empirical confirmation of the relationship between ethics and personal values answer the author`s claims on the topic and allows the extension of analyzes of social phenomena supported by such theories.

The approach to construction of model of a problem situation in transport system is resulted, the block diagram of its algorithm is developed. It is revealed that the transition stage from the problem to the formulation of formal tasks is a problem situation, and the tasks can be solved in different ways, forming a set of strategies. It is noted that in the general case the result of operations is uncertain, which is caused by the uncertainty of the conditions of the operation and the action of factors of different nature. It is revealed that the acquisition of values of indicators that characterize one or another result of the operation is associated with the solution of the problem of modeling operations. The stages of the problem of studying the efficiency of the operation in the transport system are given. A number of assumptions are made about the process of obtaining results, which is associated with the formation of the operation model and obtaining efficiency estimates based on modeling results, as well as the process of analyzing the results, which involves solving the selection problem based on the established efficiency criterion or system of such criteria. It is found that the model of the problem situation in transport systems reflects the relationship of the main elements of the decision-making process and the sequence of formation of partial tasks and is built to cover the problem of decision-making as a whole, to present its main elements to be finalized. about the strategy of the operation. It is shown that the presence of a certain component as an independent element in the model of the problem situation assumes that the set of values of uncertain factors in the development of solutions will be either set externally, or finding these values will be an independent task. A list of actions for solving partial problems based on this model is presented. It is shown that in many practical cases it is observed that the a priori task of one of the main criteria of efficiency leads to the selection of some set of alternatives. Therefore, the choice of the best alternative requires the formation of a compound criterion, which includes both formal and informal prescriptions for making a judgment on the basis of which the selection or return and correction of elements of the model of the problem situation.

Despite growing attention to the ability of patients to provide informed consent to treatment in different medical settings, few studies have dealt with the issue of informed consent to major orthopaedic surgery in those over the age of 60. This population is at risk of impaired decision-making capacity (DMC) because older age is often associated with a decline in cognitive function, and they often present with anxiety and depressive symptoms, which could also affect their capacity to consent to treatment. Consent to major orthopaedic surgery requires the patient to understand, retain and reason about complex procedures. This study was undertaken to extend the literature on decisional capacity to consent to surgery and anaesthesia of patients over the age of 60 undergoing major orthopaedic surgery. Recruited patients ( N=83) were evaluated using the Aid to Capacity Evaluation, the Beck Depression Inventory, the State–Trait Anxiety Inventory Y, the Mini-Mental State Examination and a visual analogue scale for measuring pain symptomatology. Impairment of medical DMC was common in the overall sample, with about 50% of the recruited patients showing a doubtful ability, or overt inability, to provide informed consent. Poor cognitive functioning was associated with reduced medical DMC, although no association was found between decisional capacity and depressive, anxiety and pain symptoms. These findings underline the need of an in-depth assessment of capacity in older patients undergoing major orthopaedic surgery.
