Heidegger’s critique of ethics has been interpreted as an abolition of the ethical that nihilistically precludes the possibility of ethics. Yet Heidegger questioned ethics as systematizing discourses about hierarchies of values, prescriptions, norms, and axioms cut off from their worldly and factical contexts. I argue that this questioning of rule-based ethics does not necessarily entail a denial of the ethical, since it has its own ethical preoccupations in the sense of reflection on practical activity (praxis) and the formal indication of how Dasein factically exists. This reading is supported by Heidegger’s later depiction of the ethical as the ethos of an originary dwelling. Further, Heidegger’s practice of thinking indicates and enacts the ethical as confrontation and responsive encounter: (1) even if he did not formulate an ethical system, a universal prescriptive principle, or a moral code; and (2) despite his own undeniable ethical failures. This promising yet underdeveloped ethical dimension is visible both in the style, method, and event of his philosophizing and in his attention to the issue of individuation in the context of the Dasein’s conformity to the power of everydayness and the social. Individuation, a primary issue of Being and Time and other works of the 1920’s, occurs through the attuned comportment and understanding that Dasein each time is, yet as individuation it takes place in being-with others. The identity and difference of human existence is formed in social comportment and understanding—in addressing and being addressed, in the interdependent and interpretive setting apart of encountering and being encountered, in the responsive confrontation, differentiation, and separation of Auseinandersetzung.

This paper examines a sample of fifty news-oriented articles related to the Middle East conflict published on the Reuters proprietary websites across a three month study window. A combination of Ethnographic Content Analysis and primary survey data are employed to identify, code and validate reporting/ethical failures in the articles, i.e., propaganda, logical fallacies, and violations of the Reuters Handbook. Tests are run to measure for 1) shifts in audience attitudes and support for the primary belligerent parties in the Middle East conflict following readings of the sample and, 2) associations between the reporting/ethical failures and audience attitudes/support. Over 1,100 occurrences of reporting/ethical failures across forty-one subcategories are identified and a significant shift in audience attitudes and support following article readings is observed. Significant associations are found between 1) the use of atrocity propaganda and audience favorability/sympathy toward the Arabs/Palestinians; 2) the use of the appeal to pity fallacy and audience favorability/sympathy toward the Arabs/Palestinians; and 3) the use of atrocity propaganda, appeal to pity and appeal to poverty fallacies, and audience motivation to take supportive action on behalf of the Arabs/Palestinians. It is inferred from the evidence that Reuters engages in systematically biased storytelling in favor of the Arabs/Palestinians and is able to influence audience affective behavior and motivate direct action along the same trajectory. This reflects a fundamental failure to uphold the Reuters corporate governance charter and ethical guiding principles.

The fundamental originating principle of law and economics (L&E) is that legal decisions should be (and are) based on maximizing efficiency. But L&E proponents do not define “efficiency” in the way agreed to by most economists, as Pareto Efficiency. A Pareto optimal condition is obtained when no one can be made better off without making someone worse off. Pareto Improvements are win-win changes where no losers exist. In the judicial system, however, there are always winners and losers, because under Article III § 2 of the Constitution a legal case does not exist unless there is a justiciable “case or controversy” in need of resolution. Unable to use Pareto Efficiency, L&E scholars have been forced to adopt alternative definitions of efficiency. Most L&E scholars claim to define “efficiency” based on the work of Kaldor and Hicks, but (perhaps unwittingly) instead use a definition of “efficiency” derived from the 19th century idea of consumer surplus, which encompasses L&E notions such as “wealth maximization,” and “consumer welfare” in antitrust. Neither of these alternative definitions is viable, however. Outside of L&E, the Kaldor-Hicks approach has long been recognized to be riddled with logical inconsistencies and ethical failures, and the surplus approach is even more deficient. Remarkably, virtually none of the numerous L&E textbooks even hint at such problems. Critically, all definitions of efficiency improvements in economics are biased in favor of wealthy individuals or firms, either because they are dependent on the status quo ante distribution of assets, or because they bestow large advantages on parties with political influence or who can afford to bring lawsuits quickly. Many L&E practitioners treat efficiency improvements instead as being objectively good, an error revealing that L&E is primarily motivated by its neoliberal policy agenda.

For many, cosmetic surgery holds the promise that one can reshape his or her body to remove perceived defects and thus have a more perfect body. However, the decision to undergo elective cosmetic surgery is not made in a vacuum, and it is easy to overlook the full range of ethical considerations surrounding cosmetic surgery. Many medical ethicists subscribe to an ethical code that centers mainly on the relationship between the doctor and patient, with a focus on respect for autonomy, nonmaleficence, beneficence, and justice. This chapter builds on this framework by extending the scope of actors to include not only the surgeon and the patient but also the media and the overall society. To illustrate this framework, the author uses the example of actress Heidi Montag, who underwent 10 different plastic surgery procedures in one day. The chapter concludes with a discussion of potential correctives for ethical failures in each of these areas.

Corporate disasters arising from ethical failures have irreversibly eroded the public's trust in organisations. Predictably, executives' public commitments to ethical practices are now routinely viewed with scepticism. Although this obscures the identification of organisations' authentic ethical orientation, organisational change practices can reveal this ethical orientation i.e. function as ‘windows' on corporate ethics. Extending earlier work by Van Tonder, it is argued that organisational change practices have an implicit propensity for risk and harm, substantially ‘fit' with ethical frameworks and are consequently amenable to analysis on a range of ethical parameters. Employing ethics heuristics adapted for organisational change, Quaker Oats' acquisition of Snapple is analysed to reveal how change practices function as ‘windows' on corporate ethics. The implications for management are briefly considered.

Ezenwa–Ohaeto is one of the modern Nigerian poets who, in their creative endeavours, have continued to tap the rich sources of orature in their culture, in what is now known as 'the minstrelsy tradition'. The maturity of his explorations of the minstrelsy tradition comes through in the last volume of poetry he published before his death, (2003). In a close reading of some selected poems from this volume, this contribution not only looks at the minstrelsy tradition so central to Ezenwa–Ohaeto's poetry, but, more broadly, explores the social vision of Ezenwa–Ohaeto as an African poet. Unlike his earlier volumes of poetry, takes a critical swipe at the inadequacies of advanced countries in Europe and America in what we may call the poet's transnational imagination. In his chants across the world (the volume is an outcome of his many travels), Ezenwa–Ohaeto examines the issues of racism, equity in international relationships and, as is characteristic of his oeuvre, the moral and ethical failures of leaders in Africa.
