Summary A phenomenological approach to anthropology should not propose a static definition of man, but inquire into specific human motivations, which never occur isolated. Therefore, the autonomy-dependency connection is presented as a possible human motivational ground. The notion of autonomy, presented with reference to the Kantian idea of the self-determining reason and to the Husserlian account of self-constitution, reveals in itself elements of dependency. On the other side, the notion of vulnerability and reliance is displayed through different approaches of Gehlen, MacIntyre and Toombs in order to illustrate dependency not as a mere capitulation of the subject, but as one of its intrinsic possibilities, which does not exclude autonomous will.

The article defines the meaning of the phenomenological approach to the analysis of the concept of intersubjectivity in the context of social and philosophical problems of the balance of the Self and the Other. The discourse is based on the correlation of phenomenological orientation and communicative action in determining the mechanisms of identity of the Self in relation to the Other in the inseparability of social reality. A sequential analysis of prerequisites and research approaches aimed at testing the problem of intersubjectivity is carried out. The focus is placed on social phenomenological research of A. Schutz and the theory of communicative action of J. Habermas, which are aimed at understanding the correlation between the peculiarities of human existence, his life-world and the area of social relations or the inevitability of establishing overindividual patterns. Relevance of the research lies in elaborating the issue of establishing intersubjectivity under the fundamental non-identity of the subjects of communication and their predetermined attitudes. The article concludes by outlining the feasibility of expanding the rational predetermination of the subject-subjective structure of communicative action with the research area of social phenomenology.

The springboard for this essay is the author’s encounter with the feeling of horror and her attempts to understand what place horror has in philosophy. The inquiry relies upon Leonid Lipavsky’s “Investigation of Horror” and on various textual plunges into the fanged and clawed (and possibly noumenal) abyss of Nick Land’s work. Various experiences of horror are examined in order to build something of a typology, while also distilling the elements characteristic of the experience of horror in general. The essay’s overall hypothesis is that horror arises from a disruption of the usual ways of determining the boundaries between external things and the self, and this leads to a distinction between three subtypes of horror. In the first subtype, horror begins with the indeterminacy at the boundaries of things, a confrontation with something that defeats attempts to define it and thereby calls into question the definition of the self. In the second subtype, horror springs from the inability to determine one’s own boundaries, a process opposed by the crushing determinacy of the world. In the third subtype, horror unfolds by means of a substitution of one determinacy by another which is unexpected and ungrounded. In all three subtypes of horror, the disturbance of determinacy deprives the subject, the thinking entity, of its customary foundation for thought, and even of an explanation of how that foundation was lost; at times this can lead to impairment of the perception of time and space. Understood this way, horror comes within a hair’s breadth of madness - and may well cross over into it.

Dr. Clouston said that when he suggested toxæmia to the secretary as a suitable subject for a discussion at this meeting he had not intended to be the first speaker, because his object was to bring out more fully the views of the younger members who had recently committed themselves so strongly to the toxæmic and bacterial etiology of insanity, and so to get light thrown on some of the difficulties which he and others had felt in applying this theory to many of their cases in practice. It was not that he did not believe in the toxic theory as explaining the onset of many cases, or that he under-rated its importance, but that he could not see how it applied so universally or generally as some of the modern pathological school were now inclined to insist on. He knew that it was difficult for those of the older psychological and clinical school to approach the subject with that full knowledge of recent bacteriological and pathological doctrine which the younger men possessed, or to breathe that all-pervading pathological atmosphere which they seemed to inhale. He desired to conduct this discussion in an absolutely non-controversial and purely scientific spirit. To do so he thought it best to put his facts, objections, and difficulties in a series of propositions which could be answered and explained by the other side. He thought it important to define toxæmia, but should be willing to accept Dr. Ford Robertson's definition of toxines, viz., “Substances which are taken up by the (cortical nerve) cell and then disorder its metabolism.” He took the following extracts from his address at the Cheltenham meeting of the British Association (1) as representing Dr. Ford Robertson's views and the general trend of much investigation and hypothesis on the Continent.

Spirituality as a human phenomenon presents itself as a significant aspect in the understanding and promotion of health, yet its study was neglected by psychological theories, with the exception of Jung's pioneering studies and the transpersonal approach. In this sense, we aim to present the vision of spirituality among psychologists from the city of Recife (in Brazil) who are guided by these theoretical lines, indicating how this phenomenon is experienced in their professional practices. We performed a phenomenological qualitative research that had as instrument the semi-structured interview with eight psychologists. The data were analyzed according to Bicudo's phenomenological approach and are in agreement with the scientific literature in this field, which indicates that there is no hegemonic definition of spirituality. There are visions of spiritualities, sometimes singular, sometimes common. Spirituality sometimes appears as synonymous with unconditional love, sometimes as access to the transcendent, without denying immanence. It also arises as internal energy and access to the Higher Self or just the Self. In the clinic it is considered as health promoter and approached from the demand in the Jungian perspective and seen as contextual in the transpersonal. We raised reflections on the importance of spirituality to the understanding of human being in its complexity.

This article considers the photographs of Francesca Woodman in terms of the complex and ambivalent set of relations they configure between photographer, photographed subject and viewer. Usually described as ‘self-portraits’, the subject of these fleeting, fractured images simultaneously presents itself whilst seeming to withdraw from them. The self, there where it most openly declares itself, disappears. Drawing on Jean-Luc Nancy's concept of exposition, or exposure, which posits the self as being in-exteriority, thinking the intimacy of subjectivity in terms of an originary relation to the outside or the other, I seek to problematize the possibility both of the portrait and the self that is its subject.

This article provides a relation between the problem of shame in both Levinas and Agamben, focusing, for the most part, in the development of Levinas' metaphysics and its relation to the emotional tonality of shame in three works: "On Escape", "Time and the Other" and "Otherwise than Being". In stressing the unique take that Levinas has on metaphysics, I try to point at the tension between Jewish and Greek thought in Levinas, and his option for a radical notion of a situated understanding of the "ethical". Hence my interest in contrasting Levinas and Agamben, as Agamben's appropriation of Levinas' lexicon in his "Remnants of Aushwitz" places the subject in a political, and material, position which is ultimately uncompatible with Levinas' situational and metaphysical take on the self.***Vergonha, des-subjetivização e passividade – a metafísica do Eu em Levinas e Agamben***Este artigo fornece uma relação entre o problema da vergonha tanto em Levinas como em Agamben, focando principalmente, no desenvolvimento da metafísica de Levinas e sua relação com a tonalidade emocional da vergonha em três trabalhos: "De l'évasion", "Le Temps et l'Autre, "e" Autrement qu'être ou Au-delà de l'essence". Abstract Since the 1948 enactment of 28 USC § 1782 in the United States, no consensus has emerged as to the availability of federal court discovery to parties in private foreign or international arbitral proceedings. This year, within months of one another, six federal courts have issued rulings that are widely inconsistent on the availability of section 1782 discovery. The courts have ruled that a proceeding before a private international arbitral tribunal is eligible for section 1782 discovery; that, categorically, no such discovery is available; that the definition of private arbitral tribunal applies to CIETAC; and that discovery is available by virtue of a party’s parallel pursuit of discovery through foreign civil proceedings. As these cases demonstrate, recent US court decisions have brought no predictability, let alone certainty, to the subject. Congress, on the other hand, could and should amend the statute so as to include private tribunals in the scope of section 1782. This article discusses the case law’s state of disarray; proposes a legislative solution; considers the proposed amendment’s merits; and advocates for Congress to act.

According to Marilyn Burns, students will define mathematics based on how they do math. If the majority of their time is spent reciting a list of properties and following a sequence of steps to solve equations, students will think that algebra involves only memorizing a list of rules. If they spend most of their time in geometry practicing vocabulary, they will look at it as simply being a subject in which they spout back definitions. If they spend the majority of their time on paper-and-pencil computation, they will think that mathematics simply involves performing isolated operations on numbers (Burns 1995). On the other hand, students will have a very different definition of the subject if the focus in the mathematics class is on understanding concepts and developing meaningful procedures. Students can learn all of the activities above in a way that will allow them to apply these skills to new situations or know when to use a particular skill or piece of factual knowledge.

Today human right is of great importance. The existence of different minorities such as lingual, ethnic, racial, and religious minorities with different tendencies derived from different civilizations and cultures has brought about social and cultural varieties and differences in each country and also the emergence of this variety has resulted in the development of variety in a specific culture and ceremony in different countries. On the other hand, each country as a member of international society has to observe norms and principles accepted by international society. In other words, although preparation of constitution of each country depends on exclusive qualification of the country’s people and government, it does not mean they are free in each law because international legitimacy of each country’s government and constitution depends on observation of the accepted principles and the governing rules in international law. The subject of minorities was first introduced in Vienna Congress and today different minorities live in different countries. In international documents and treaties, a precise definition of minority has not been provided. The present article seeks to interpret minority rights according to international law and investigate minority rights in international law by using international documents.

AbstractIn England, throughout the early modern period and beyond, the Rape of Lucretia served as a central intertext for literary and non-literary works engaging with the subject of transgression. Not only did legal tracts and social pamphlets prescribe a woman to behave analogously to Lucretia after rape in order to contest the innocence of her soul through her bodily performance. Allegorically, the legend′s iteration within new cultural contexts in contemporary English historiography and drama provided a powerful subtext with which national histories and identities were scripted according to a familiar plot structure in order to represent 'the Turk′ and thereby to interpret and control what was perceived to be a threat to English identity and sovereignty at a time of intensifying Anglo-Ottoman encounters. This paper not only demonstrates the re-staging of the Rape of Lucretia in different texts and contexts; it examines the way in which the national identities and cultural encounters are represented and performed through the legend in order to stage the self and the Other within the radical discourse of alterity in contemporary proto-orientalist contexts.
