La policía comunitaria es una institución de los pueblos indígenas de Guerrero conocida por su capacidad para enfrentar a la delincuencia y generar alternativas de paz social., através de un sistema de justicia y seguridad autónomo. En los últimos años, sin embargo, el sistema comunitario enfrenta el acoso de actores diversos vinculados al incremento de la violencia y la inseguridad que se vive en el país y especialmente en el estado de Guerrero; dicha situación está impactando a la institucionalidad comunitaria, obligando a su redefinición. En este trabajo destaco aspectos centrales de dicha conflictividad así como las respuestas que han dado los comunitarios para hacer frente a las tareas de justicia y seguridad en el marco de nuevos contextos marcados por el despojo neoliberal y la impunidad de actores estatales y no estatales. Nos últimos anos, no entanto, o sistema da UE enfrenta assédio de várias autoridades envolvidas no aumento da violência e da insegurança que reina no país e, especialmente, no estado de Guerrero; essa situação está afetando as instituições comunitárias, forçando a sua redefinição. Neste artigo, destaco os principais aspectos do conflito e as respostas que têm a comunidade para lidar com as tarefas da justiça e da segurança no contexto dos novos contextos marcados por pilhagem neoliberal e a impunidade de atores estatais e não estatais. Neste processo, a relação de policiamento comunitário com o estado é atualizada, revelando o peso da ambiguidade e dos jogos de poder legais, além de usos contra-hegemônicos do direito de disputar a justiça.Palavras-chave: violência neoliberal; Guerrero; comunidades indígenas---SECURITY AND JUSTICE UNDER HARASSMENT IN TIMES OF NEOLIBERAL VIOLENCE: responses of the Community Police of GuerreroThe community police is an institution of the Indigenous Peoples of Guerrero known for its ability to deal with crime and generate alternatives for social peace, using a system of justice and self security. In recent years, however, the EU system faces harassment from various people responsible for the increase of violence and insecurity within the country and especially in the state in Guerrero; this situation is impacting instituitions in the community, forcing their redefinition. In this paper I highlight key aspects of the conflict and the community's responses to deal with the tasks of justice and security in new contexts marked by neoliberal plunder and impunity of the state (as well as non state figures). In this process, the relationship of the community police with the state is updated revealing the weight of legal ambiguity and power plays, as well as counter-hegemonic use of the right to dispute justice.key words: neoliberal vilence; Guerrero; indigenous people.

Marriage is a rule to authorize the relationship of two different gender to become husband and wife. Sociologically, there are marriage that was done by religious law but was not recorded by the state even until it produced children. Law Number 1 from Year 1974 on Marriage confirms that marriage is valid if conducted according to the religion and registered as regulated on binding law.This study aims to examine the law protection of civilization rights on childrens’ birth from the unregistered marriage. Research methods is normative research with statute, conceptual, and case approaches. Conclusion, recording is one of the important aspects in marriage, if marriage is not recorded, even though it is legal based on the religious law, but in the state provision, marriage does not have the legal force. Furthermore,  it is not recognized by the state because it does not have the right to manage all interests related to the state. Law protection on childrens’ birth from the unregistered marriages can be taken by isbat nikah to legalize the marriage of their parents.Key Words:  Legal Protection, Children, Unrecorded, Marriage, Alimentation, Inheritance, Islamic Law

Indigenous peoples and the environment are two things that are difficult to separate, because they are interdependent. The regulation of environmental law in Indonesia and in the world generally regulates the protection of indigenous peoples’ rights of the environment. Over time, conflicts over the environment often occur due to the needs of development that exploit the indigenous peoples’ environment. The problem in this paper is to protect the rights of indigenous peoples and their customary environment based on the Principles of Free and Prior Informed Consent (FPIC). Based on FPIC principles, indigenous peoples' rights of their environment can be protected and it will not cause harm to the indigenous peoples. When governments and investors use the customary environment of the indigenous people for both public and economic development interests, they must pay respect and appreciation to the indigenous peoples in the using the environment based on FPIC principles. This research was conducted by analyzing the rules of law and the principles of law, and examining the relationship of environmental law issues and the regulations that exist. The conclusion of this paper is that the principles of FPIC is the concept of environmental protection on the rights of indigenous peoples which must be applied in the existing laws of environmental law in Indonesia to maintain legal certainty in protecting indigenous peoples' customary environment.

This work problematizes the relationship between University, Indigenous Peoples and the State based on a community experience aimed at revitalizing four of Chile’s most dynamic indigenous languages (Aymara, Quechua, Rapa Nui and Mapudungun). On this occasion, the voices from indigenous students and teachers, State officials, and academics are brought together and find, from their differences, tensions and approximations in a collaborative project that gathers understanding and lessons learnt from this educational experience. This article’s main objective is to analyze the perceptions of the three actors mentioned in this joint initiative, emphasizing the following scopes: a) purposes and meanings; and b) characteristics of the relationship between actors. The main findings explain problematic junctions and key aspects regarding joint action, particularly, opportunities and challenges for the configuration of new relational spaces.

AbstractCommunal right cannot implemented even legality of that was recognized. This research want to know the concept and implentation of arrangement about relationship of communal right and the right of controlling of the state in Rawa Aopa Watumohai National Park. This research is an empirical law. The results are Firstly, concepts regulation of relations communal rights of indigenous people and to the right control of the state contained in Article 33 paragraph (3) NRI 1945 Constitution. Secondly, to implementing the right still have to wait stipulation from the National Parks in this case related to the central government as the implementing authority. IntisariHak ulayat tidak selalu dapat diimplementasikan meskipun memiliki dasar pengakuan hukum. Penelitian ini untuk mengetahui konsep pengaturan dan implementasi dari hubungan antara hak ulayat dengan hak menguasai Negara di Taman Nasional Rawa Aopa Watunohai. Penelitian ini penelitian hukum empiris. Hasil penelitian adalah pertama, konsep pengaturan hak ulayat dan hak menguasai negara diatur Pasal 33 ayat (3) UUD NRI 1945. Kedua, implementasi hak ulayat ditentukan pihak Taman Nasional terkait dengan pemerintah pusat sebagai pelaksana wewenang/kekuasaan dari negara.

This chapter examines Merata Mita’s Mauri, the first fiction feature film in the world to be solely written and directed by an indigenous woman, as an example of “Fourth Cinema” – that is, a form of filmmaking that aims to create, produce, and transmit the stories of indigenous people, and in their own image – showing how Mita presents the coming-of-age story of a Māori girl who grows into an understanding of the spiritual dimension of the relationship of her people to the natural world, and to the ancestors who have preceded them. The discussion demonstrates how the film adopts storytelling procedures that reflect a distinctively Māori view of time and are designed to signify the presence of the mauri (or life force) in the Māori world.

The conservation of environment and the protection of human rights are two of the most compelling needs of our time. Unfortunately, they are not always easy to combine and too often result in mutual harm. This book analyses the idea of biocultural rights as a proposal for harmonizing the needs of environmental and human rights. These rights, considered as a basket of group rights, are those deemed necessary to protect the stewardship role that certain indigenous peoples and local communities have played towards the environment. With a view to understanding the value and merits, as well as the threats that biocultural rights entail, the book critically assesses their foundations, content, and implications, and develops new perspectives and ideas concerning their potential applicability for promoting the socio-economic interests of indigenous people and local communities. It further explores the controversial relationship of interdependence and conflict between conservation of environment and protection of human rights.

AbstractHans Kelsen is known both as a legal theorist and as an international lawyer. This article shows that his theory of international law is an integral part of the Kelsenian Pure Theory of Law. Two areas of international law are analysed: first, Kelsen's coercive order paradigm and its relationship to the bellum iustum doctrine; second, the Kelsenian notion of the unity of all law vis-à-vis theories of the relationship of international and municipal law. In a second step, the results of Kelsenian general legal theory of the late period – as interpreted and developed by the present author – are reapplied to selected doctrines of international law. Thus is the coercive order paradigm resolved, the unity of law dissolved, and the UN Charter reinterpreted to show that the concretization of norms as positive international law cannot be unmade by a scholarship usurping the right to make law.

Задачей данной статьи является рассмотрение лингвопрагматических особенностей комментариев пользователей социальной сети «Твиттер» на выход Великобритании из ЕС. Анализ данных комментариев с лингвопрагматической точки зрения представляет интерес, так как показывает наиболее актуальную картину отношения пользователей социальных сетей к произошедшему событию. Приоритетными методами анализа лингвопрагматического потенциала Интернет-комментариев для нас являются: описательный метод, метод прагматического анализа, т.е. рассмотрение языкового материала в его непосредственном контексте в функциональном аспекте, метод частичной выборки, метод контекстологического описания. Контекстуальный метод был использован с целью установления особенностей комментариев в среде социальной сети «Твиттер»; описательный метод - для выявления непосредственного отношения пользователей социальных сетей к выходу Великобритании из ЕС; частичной выборки - для отбора наиболее эффективных и целостных комментариев с позиции прагматики и их реализации в данном контексте. Проведённое исследование позволило установить, что большинство людей удовлетворено результатами выхода Великобритании из ЕС и положительно отзывается об этом событии. Об этом свидетельствует как большое количество экспрессивов, использованных в интернет-комментариях в отношении данного события, так и активное употребление в них оценочной лексики. Результаты проведённого исследования могут быть применены в теоретических работах по описанию характеристик речевых актов, в курсе теоретической грамматики, стилистики, прагмалингвистики. The purpose of this article is to review the linguo-pragmatic features of Brexit represented in the comments in Twitter. Their analysis from a linguistic-pragmatic point of view may be of interest, since it shows the most relevant picture of the relationship of social network users for the event. The priority methods for analyzing the linguo-pragmatic potential of Internet comments for us are: a descriptive method, a pragmatic analysis method, i.e. consideration of linguistic material in its immediate context in the functional aspect, partial sampling method, contextual description method. The contextual method was used to establish the characteristics of comments on the Twitter social network; descriptive method was used to identify the direct relationship of social network users to the UK exit from the EU; partial sampling was used to select the most effective and holistic comments from the position of pragmatics and their implementation in this context. The study found that most people are satisfied with the results of the UK exit from the EU and respond positively to this event. The results of the study can be applied in theoretical works on the description of the characteristics of speech acts, in the course of theoretical grammar, stylistics, pragmalinguistics.

Patient as service users have right and obligations to be hospitalized and patients also have the right to medical information in receiving medical practice services. This study aims to determine the relationship between patient attitudes towards the rights and obligations of being hospitalized in the hospital Pekanbaru Medical Center (PMC). This research method using observational analytic method with cross sectional design. The total sample used in this study 107 sample were taken as simpel random sampling. Chi square test is used to determine the relationship between variables. The data were processed using SPSS statistical software and analyzed using univariate and bivariate analyzes. Of the result obtained of the study namely the relationship between patient attitude to the rights and obligations of patient with chi-suare obtained pvalue 0.016 (<0,05), the relationship of attitude patients to the rights and obligations of choosing a doctor and class of patient care with chi-square obtained pvalue 0,070 (<0,05), the relationship of patient attitudes to the right and obligations of confidentiality of disease by inpatient medical staff with chi-square obtained pvalue 0,000 (<0,05), the relationship of patient attitudes to the rights and obligations of consent to the patient treatment with chi-square obtained pvalue 0,000 (<0,05), the relationship of patient attitudes to the right and obligation of patient safety with chi-square obtained pvalue 0,000 (<0,05), the relationship between patient attitudes towards the right and obligations of patient safety with chi-square obtained pvalue 0,000 (<0,05).
