The Right to Information in India Implementation and Impact

The Right to Information Act 2005 was passed by the UPA (United Progressive Alliance) Government with a sense of pride. It flaunted the Act as a milestone in India’s democratic journey. It is five years since the RTI was passed; the performance on the implementation frontis far from perfect. Consequently, the impact on the attitude, mindset and behaviour patterns of the public authorities and the people is not as it was expected to be. Most of the people are still not aware of their newly acquired power. Among those who are aware, a major chunk either does not know how to wield it or lacks the guts and gumption to invoke the RTI. A little more stimulation by the Government, NGOs and other enlightened and empowered citizens can augment the benefits of this Act manifold. RTI will help not only in mitigating corruption in public life but also in alleviating poverty- the two monstrous maladies of India.

Jokaisella vanhuksella on Suomessa yksilöllinen, viime kädessä perustuslaissa taattu, oikeus riittävään hoivaan ja huolenpitoon. Silti tämä oikeus on usein käytännössä riippuvainen siitä, onko vanhalla ihmisellä omaisia tukenaan. Tässä artikkelissa tarkastellaan sitä, miten oikeus hoivaan ja hoitoon taataan lainsäädännössä. Omaisilla ei lain mukaan ole vastuuta hoivan järjestämisestä, mutta silti lainsäädäntö monessa kohdin ikään kuin olettaa omaisten olevan vanhuksen tukena. Vaikka omaiset usein ovatkin tukena, miten perusoikeus hoivaan ja huolenpitoon toteutuu niillä vanhuksilla, joilla ei ole omaisia? Artikkeli nostaa vakavimpana omaisolettaman riskinä esiin ne vanhukset, joilla on omaisia, mutta joiden omaiset eivät osaa tai halua auttaa. Right to care and presumption of family and friends in the Finnish legislation According to Finnish legislation the public authorities must guarantee adequate social, health and medical services for those old persons who cannot obtain means necessary for a life of dignity. Yet in practice this right to receive indispensable subsistence and care often depends on the fact whether the old person happens to have family or friends to help her or him. As if the legislation supposes there are friends and family to help, even though, according to Finnish law, family members do not have legal responsibility to take care of an elderly person. This article elaborates how the right to care is guaranteed in Finnish legislation and what the law says about the responsibilities of the family. Even though most of the relatives do help their elderlies, how is the right to care fulfilled for those old persons who do not have family? Perhaps the elderlies who have family and friends, which do not help or do not know how to, are in the most vulnerable situation.

As we all know that food is the basic Human necessity, without which no one can survive. Making food available for all the people in the world is now days becoming a complex issue. The availability food is decreasing as a result of increase in population that will result in food insecurity or malnutrition. Indian constitution interprets the right to food as part of right to life, which is fundamental human right. Change in climate, the impact of globalization, Global Warming, Carbon dioxide emission from fuel etc. also affects the right to food of many people. This paper examines the situation prevailing in India and looks into the obligations and initiatives by the government of India to ensure Right to Food and make suggestions for addressing the issue and examines the possible way to make the scheme workable to achieve food security.

This chapter examines administrative accountability through the democratic pillar of public transparency. One of the pillars of democratic accountability is the availability of adequate information in the public domain about the functioning government. It has taken a social movement for transparency in government to establish people’s right to information through the passage of the Right to Information Act in 2005. However, traditional administration has not reconciled to its demands and PPPs are kept out of its purview on the plea that they are not public authorities. The Lok Pal (ombudsman) Bill has been passed in response to another struggle of civil society.


Chapter 4 considers the administrative structure created by the Freedom of Information Act 2000; the right to information itself; the public authorities that are subject to the right; and the way in which requests for information should be handled. The chapter addresses the form of the request; the definition of ‘information’; the problems that tribunals have had in deciding whether information is held by a public authority; time limits; the transfer of requests from one authority to another; the duty to provide advice and assistance; fees and costs; vexatious and repeated requests; and the notice which has to be given when a request is refused. The chapter then considers the automatic disclosure of information through publication schemes, the need for consultation with third parties, and record management.

The right to information is a human right as derogable right. Fulfilment of the right to information often leads to information disputes with Information and Documentation Management Officer (IDMO) as administrative officials who are given the task of managing information and documentation. Information dispute resolution becomes important to be resolved immediately because it is related to fulfilling a sense of justice and fulfilling the right to information for the community. The Establishment of the Government Administration Act (GA Act) causes the dualism of information dispute resolution. Article 53 of the GA Act will be the basis for resolving information disputes in the administrative court domain, while the Public Information Officer/PIO Act is the basis for resolving information disputes within the Information Commission domain. This dualism needs to be resolved to ensure legal certainty for the government and society as Justicia Belen. The development of dispute resolution reconstruction of information is conducted by strengthening information dispute resolution in non-litigation. Ideal information dispute resolution should be resolved first through administrative remedies (objections and administrative appeals) and through the Information Commission. The court becomes the ultimum remedium in resolving a dispute. Therefore, strengthening the Information Commission in terms of development, finance and authority is one way to strengthen the resolution of information disputes outside the court.

Every citizen has the right in law and justice, therefore the government makes Law No. 16 of 2011 on Legal Aid to protect its citizens in the event of a catastrophe. The aim of devotion to this community is to emphasize the people or the villagers, as well as other goals aimed at providing this counseling that parents can add information related to the process of handling criminal acts and how to follow up in the event of a criminal offense. The method used is by way of talk and discussion then terminated with question and answer. The results obtained from the devotion to this community are the more sensitive and know how criminal and legal proceedings and the response to legal issues, especially those related to the criminal act of the present crime, are expected with the devotion to this society parents can become work in keeping his family from various possibilities related to crime and legal assistance.�AbstrakSetiap warga negara mempunyai hak dalam hukum dan keadilan, oleh kerana itu pemerintah membuat Undang-Undang nomor 16 Tahun 2011 tentang Bantuan Hukum untuk melindungi warganya dalam hal terjadi musibah yang menimpa masyarakat. Tujuan pengabdian kepada masyarakat ini lebih menitik beratkan kepada orang-orang atau warga desa, adapun sasaran lain yang menjadi tujuan dari diadakannnya penyuluhan ini yaitu para orang tua yang mana dapat menambah informasi terkait dengan proses penanganan tindak pidana dan bagaimana menindaklanjuti apabila terjadi tindak pidana. Metode yang digunakan yaitu dengan cara ceramah dan diskusi kemudian diakhiri dengan tanya jawab. Hasil yang diperoleh dari pengabdian kepada masyarakat ini yaitu masyarakat lebih peka dan mengetahui bagaimana proses tindak pidana dan bantuan hokum serta respon terhadap permasalahan hukum khususnya yang berkaitan dengan berbagai acaman tindak pidana pada sekarang ini, diharapkan dengan adanya pengabdian kepada masyarakat ini para orang tua dapat menjadi bekal dalam menjaga keluarganya dari berbagai kemungkinan yang terkait dengan tindak pidana dan bantuan hukum.�

It is found that the right to information about the activities of public authorities is linked to the more general constitutional right of everyone to freely collect, store and disseminate information in any lawful manner. The analyzed law is subject to international and domestic rules governing the right of access to information in general. At the same time, this right is regulated in great detail by special regulations that establish additional guarantees. An important guarantee that ensures the realization of the right of citizens to information about the activities of public authorities is the principle of transparency, which applies in many democracies around the world. The principle of transparency is manifested, firstly, in the fact that public authorities are obliged to inform the public about their activities, and secondly, every member of society has the appropriate right to receive such information, and the level of access to information about activities of public authorities is very important. Forms of exercising the right to information about the activities of public authorities, taking into account the peculiarities of legal regulation, are divided into passive and active. The passive form presupposes that the citizen himself gets acquainted with the information about the activity of the public authority, which duty is to make it public. An active form of exercising this right involves direct appeals of citizens or their groups to public authorities with requests to provide relevant information. It is concluded that ensuring the exercise of the right to information about the activities of public authorities is the key to building a democratic state governed by the rule of law and relies on public authorities, which are obliged to create all conditions for public participation in the adoption of legal acts by these bodies and to provide adequate access to complete and objective information about their activities.

Every citizen has the right in law and justice, because of that the government made Law number 16 of 2011 concerning Legal Aid to protect its citizens in the event of a disaster that befalls the community. The purpose of community service is more focused on the people or villagers, while the other objectives of this counseling are the parents who can add information related to the process of handling criminal acts and how to follow up in the event of a crime. The method used is by way of lectures and discussions then ends with questions and answers. The development of information technology in the era of globalization makes it easier for people to carry out their daily activities, apart from socializing, it can also be a channel for work. Behind the simplicity coveted by technological developments opens up loopholes related to personal data that is easily misused. Indonesia does not yet have specific laws governing the protection of personal data as a whole. So that the author will examine the urgency of the draft personal data law in Indonesia, personal data protection schemes, to the impact of the implementation of the personal data protection bill. This study uses a normative juridical research method. The results of the study point to a privacy rights protection scheme in which everyone has the right to publish personal data or the right not to publish personal data to the public. The weakness of personal data protection regulations in Indonesia that have not been specifically regulated increases the potential for crimes against the right to privacy, but the drafting of the Personal Data Protection Bill brings fresh air not only to the public but to the government sector to the international business environment.

This study sought to explore the dynamics in managing crisis in the Nigerian public sector and its engagement with the organised labour, with a view to determining the interface between industrial harmony and political stability in the country. This study is predicated on the fact that crisis management is essentially embedded in humanity. Additionally, the study was informed by the established and widely held view by scholars, that social groups by their nature and context, are in fact characterised by conflicts. Consequently, the study established that the public sector in every society is not immune against conflict or crisis, and this will naturally arise as long as there is interaction between and among human elements in the two sectors. The author used the terms—crisis and conflict—interchangeably in the study, and pointed out that the methodology adopted was a descriptive and analytical approach. This is informed by the sources of information accessed which are essentially secondary. The study concluded by asserting that given the humanity-linked nature of conflict, its management in the public sector, particularly in Nigeria, will continue to be an unavoidable responsibility of the government. This is to ensure that the right environment is created to guarantee smooth governance.
