This research departs from the author’s observation that Indonesian government officials are currently very wary and worried being criminally charged for corruption and at the same time brought before the administrative court for abuse of power. The main question here is whether the possibility of being brought before the Administrative Court may or may not have positive effect. The main finding, using a legal normative approach, is that the final decision on the issue, whether there is abuse of power or not, as decided by the Administrative Court, would be important in proving disproving, the corruption charge brought before the criminal court.

Universal jurisdiction permits states to investigate and prosecute perpetrators of certain widely condemned offences, irrespective of whether they possess any of the traditional territorial, nationality, or other jurisdictional links to the offence. As a legal principle, African states accept the principle of universal jurisdiction, but in the past decade they have pushed back against it due to the perception that the courts of various European states have unfairly targeted African government officials that they perceive as enemies. Against this background, the chapter examines the status of the universal jurisdiction debate and how it relates to the role of the International Criminal Court and that of the African Union and its member states, in addition to evaluating the proposals made by African states within the framework of the United Nations to address the African government concerns about double standards in the application of universal jurisdiction through a special ad hoc committee of the General Assembly.

Law No. 30/ 2014 on Government Administration brings the strength and the averment on the performance of the governmental functions which include executive, legislative, and juridical in order to provide the public services (bestuurzorg). Such regulation also aims to prevent and to eliminate any kinds of the maladministration done by the government officials/organs in implementing their functions so that good governance can be realized. In implementing their function, the government should rely on the useful performance (doelmatigheid) and the effectiveness (doeltreffenhgeid) according to the norms of each authority. It is a sophism when the ‘authority’ and/or the ‘competence’ mentioned under the Law No. 30/ 2014 on Government Administration are defined differently in the letterlijk gramatikal wet without associating those terms with an understanding of bevoegheid in an administrative legal concept. An idea that distinctively defines the term ‘competence’ as a right and ‘authority’ as a power is considered as an inconsistent idea, which may cause dualism and distortion in the common law enforcement reffering to the administrative law, particularly related to the concept of the authority abuse of power mentioned under the Law No. 31/ 1999 amended by the Law No. 20/ 2001 on deeds against corruption. As the result, when the notion of ‘authority abuse of power’ is defined as a right (as mentioned in article 1, subsection 5 jo. article 17, Law No. 30/ 2014 on Government Administration), it will be characterized into the absolute competence of the administrative jurisdiction, and when the notion of ‘authority abuse of power’ is defined as a power (as mentioned in article 3, Law No. 31/ 1999 on deeds against corruption), it will be characterized into the absolute competence of the corruption-act jurisdiction. Meanwhile, implementing the government’s ‘competence’ and/or ‘authority’ is characterized into one concept based on the norms of the authority power.

<p>El objetivo de este artículo es analizar el efecto de la Orientación Emprendedora (OE) como estrategia gerencial en el rendimiento de la empresa, diferenciando entre gerentes varones y gerentes mujeres. Para llevar a cabo el estudio fue recopilada información de 170 empresas del sector cuero-calzado del estado de Guanajuato, principalmente en el municipio de León. El modelo diseñado fue contrastado a través de un sistema de ecuaciones estructurales por mínimos cuadrados parciales (PLS-SEM) mediante el software SmartPLS®. Los resultados generales señalan que si bien existe un efecto positivo con rendimiento, existe una diferencia en la conformación de la OE, dependiendo del género del gerente. En el caso de las gerentes mujeres existe una baja orientación hacia la competitividad agresiva y una mayor orientación hacia la autonomía y proactividad que sus contrapartes. Este estudio servirá a los gerentes, a investigadores y a funcionarios gubernamentales para orientar los esfuerzos para fortalecer una gerencia femenina en la región y de igual forma a los académicos a generar nuevos acercamientos teóricos al constructo de OE desde una perspectiva de género.</p><p><em><strong>Palabras clave</strong>:</em> Orientación Emprendedora, Mujeres, Gerencia, Empresa PYME, Guanajuato.</p><p><strong>Abstract</strong></p><p>The main goal of this article is to analyze the effect of Entrepreneurial Orientation (EO) as a management strategy on the enterprise performance, differentiating between male and female managers. To carry out the study, information was gathered from 170 companies in the leather-footwear sector of the state of Guanajuato, mainly in the city of León. The designed model was contrasted through a system of structural equations by partial least squares (PLS-SEM) using SmartPLS® software. The general results indicate that although there is a positive effect with performance, there is a difference in the conformation of the EO, depending on the gender of the manager. In the case of women managers, there is a low orientation towards aggressive competitiveness and a greater orientation towards autonomy and proactivity than their counterparts. This study will serve managers, researchers and government officials to guide efforts to strengthen a female management in the region and in the same way academics to generate new theoretical approaches to the construction of EO from a gender perspective.</p><p><em><strong>Keywords:</strong></em> Entrepreneurial Orientation, Women, Management, SME Company, Guanajuato.</p>

Late last year, in a letter to Congressman Tom DeLay, majority whip of the House of Representatives, twelve former high government officials expressed their support for a bill introduced by Senator Jesse Helms in June 2000, entitled "American Servicemembers' Protection Act."1 The bill, if enacted, would prohibit any agency of the U.S. government from cooperating with the international criminal court (ICC), and proscribe U.S. military assistance to any nation that becomes a party to the treaty of Rome,2 with the exception of NATO members and certain other allied countries.

AbstractThe International Criminal Court (ICC) suffered two notable setbacks in Africa in 2010: the African Union's (AU) renewed call for members not to cooperate in executing ICC arrest warrants for Sudanese President al-Bashir; and the president's first visits to the territory of ICC states parties since warrants were issued in 2009 and 2010. Factors surrounding these developments suggest they do not represent the predominant view or approach to the court in Africa, where there is considerable backing for the ICC among African government officials and civil society. African ICC states parties and civil society should enhance initiatives to demonstrate the support that exists for the court, and to ensure that attacks on it are understood as limited efforts that emanate more from criticisms of the UN Security Council than of the court. Developments in 2011 reinforce these assessments.

With the creation of the International Criminal Tribunal for the Former Yugoslavia and the imminent creation of a permanent International Criminal Court, as well as the proliferation of public statements by high government officials endorsing the norm of justice, many commentators are hypothesizing that the long running tension between peace and justice may be undergoing a period of reconciliation. A brief review of the efforts to incorporate the norm of justice in the Rambouillet/Paris Accords and UNSC 1244 indicates that only minimal progress has been made in the reconciliation between the quest for a negotiated peace and the norm of justice. As the most powerful nation committed to the rule of law, we have a responsibility to confront these assaults on humankind. One response mechanism is accountability, namely to help bring the perpetrators of genocide, crimes against humanity, and war crimes to justice. If we allow them to act with impunity, then we will only be inviting a perpetuation of these crimes far into the next millennium. The involvement of children in the ISIS network has left a complex problem in the legal discourse in Indonesia, including how to deal with children involved in this terrorism network. This article aims to expose the problem of children in conflict with the law in the crime of terrorism. Due to this problem, the Indonesian government is often faced a dilemma between the neccessity to apply serious efforts to eradicate terrorism and the obligation to guarantee a protection to the children. Through a juridical-normative approach, focusing on ISIS children, this article demonstrates that one of the problems in dealing with children involved in terrorism networks lies in the vagueness of the rules addressing the children involved in this terrorism network as well as its implementation by the government. Therefore, this article argues that in order to be able to deal with children involved in terrorism networks, some of the legal instruments concerning the issue, especially the law on terrorism and the laws of children in conflict with the law as long as terrorism is concerned needs to be revised just to accommodate this issue in a more obvious normsto actually maintain a balance between the responsibility to protect the children and the need to preserve stability of the nation and state. Under the new revised laws, the government is hoped to work with and apply the provisions regarding children in conflict with the law in the case of terrorism crimes in the frame of justice and protection for children. Abstrak Keterlibatan anak dalam jaringan ISIS menyisakan permasalahan yang kompleks dalam wacana hukum di Indonesia berikut penanganan anak yang terlibat dalam jaringan terorisme ini. Artikel ini bertujuan untuk memaparkan masalah penangangan anak yang berkonflik dengan hukum dalam tindak pidana terorisme. Terkait hal ini, pemerintah Indonesia seringkali dihadapkan pada dilema antara upaya serius untuk memberantas tindak pidana terorisme dan kewajiban untuk memberikan perlindungan kepada anak. Melalui pendekatan yuridis-normatif, dengan mengambil kasus anak-anak ISIS, artikel ini memperlihatkan bahwa salah satu masalah yang ditemui dalam penanganan anak yang terlibat dalam jaringan terorisme terletak pada ketidakjelasan aturan sejauh menyangkut masalah penangangan anak tersebut berikut pelaksanaannya di lapangan oleh negara. Oleh karena itu, artikel ini berargumen bahwa untuk bisa menangani anak-anak yang terlibat dalam jaringan terorisme, beberapa instrumen hukum yang mengatur masalah ini, utamanya undang-undang terorisme dan undang-undang yang berhubungan dengan anak yang berkonflik dengan hukum harus direvisi guna mengakomodasi permasalahan ini secara lebih jelas yang benar-benar menjaga keseimbangan antara kepentingan anak dan kepentingan bangsa dan negara. Selanjutnya, pemerintah sejatinya mampu mengacu dan menerapkan segala ketentuan hukum yang berlaku mengenai anak yang berkonflik dengan hukum dalam kasus tindak pidana terorisme sebagaimana yang diakomodasi dalam undang-undang tersebut.

This research aims at examining earnings management around Law Nu.36/2008 regarding tax tarif. Indonesian government change tax tarif from progressive tarif to single tarif. Indonesian government also provide incentives for listed companies. There is 5% reduction in tax tarif for listed companies. Sample of this research consists of non-financial firms in Indonesian Stock Exchange during 2006–2010 observations. The result of this research shows that there is no significant different between earnings management before and after the application single tarif for tax. This result is consistent using compare means test and regression analysis. Further analysis shows that ROA and leverage have positive effect on earnings management. Thus, leveraged firms are engaged in earnings management actively. This result also finds similar effect of ROA on earnings management. Firms with high earnings are more aggressive to manage earnings. On the other hand, this research does not find significant effect of firm size on earnings management.

The aim of the research is to reveal the influence of official disinformation through the media on public concern in preventing the spread of Covid-19. The theory used in this research is Carl I. Hovland's Credibility Source theory. A sample of 100 people from various walks of life in Jakarta. The results showed that the inconsistency of information from government officials had a positive and significant effect on community concern in preventing Covid-19. The positive influence shows that the inconsistency of information from Indonesian government officials is responded positively by the concern of the public in preventing Covid-19. the level of public awareness of disinformation, providing official information through the media. The ability to overcome turbulence situations is to display consistency, defined as a unity of motion, between thoughts, speech and actions, in order to arrive at a common goal.
