Confirmation Bias in Simulated Child Sexual Abuse (CSA) Interviews: Abuse Assumption Influences Interviewing and Decision-making Processes

PurposeResearch has shown that confirmation bias plays a role in legal and forensic decision-making processes. However, to our knowledge, no study has examined how it manifests itself when interviewing an allegedly abused child. MethodIn the present study, we used data from a series of experiments in which participants interviewed child avatars to examine how an assumption of abuse based on preliminary information influenced decision-making and interviewing style. Interview training data from eight studies with students, psychologists and police officers were included in the analyses.ResultsWe found that interviewers’ preliminary assumption of sexual abuse having taken place predicted 1) a conclusion of abuse by the interviewers after the interview; 2) higher confidence in their judgment; 3) more frequent use of not recommended question types and 4) a decreased likelihood of reaching a correct conclusion given the same number of available relevant details. ConclusionThe importance of considering how preliminary assumptions of abuse affect interview behaviour and outcomes and the implications for the training of investigative interviewers were discussed.

The article explores the idea of ‘offender-centric’ policing in cases of rape, with its focus on suspect and offender admissions and behaviours. It features discussion of 11 cases, illustrating offender-centric pathways to charge or conviction, the challenges facing complainants, suspects and police officers, along with missed opportunities to focus on a suspect’s behaviour. The importance of victim care and support is discussed, and it is argued that victim care should accompany an offender-centric approach to rape investigation. It is also argued that there are potential dangers with offender-centric tactics, specifically, that without due care it may become a self-confirming investigative tool influenced by confirmation bias which may lead to flawed decision-making. The article concludes by arguing that offender-centric policing has benefits in those cases with suspects who engage in predatory behaviour, have a history of previously undisclosed sexual offending and domestic violence and other problematic behaviours. It also has value in focusing the attention of investigators on what steps were taken by a suspect to ascertain the complainant’s consent. While the offender-centric approach cannot address all investigative challenges in rape cases, it is a useful addition to existing strategies.

Abstract When statistically related to child sexual abuse (CSA), background information can assist decision-making in investigations of CSA allegations. Here, we studied the use of such background information among Finnish police officers. We analyzed their ability to identify and interpret CSA-related and CSA-unrelated background information both when placed in mock scenarios and when presented as separate, individual variables. We also measured the ability to correctly estimate the probability of CSA based on such background information. In the context of mock scenarios, officers were better in discarding CSA-unrelated variables than in identifying CSA-related ones. Within-subject performance across different scenarios was, however, not consistent. When information was presented as separate variables, officers tended to incorrectly consider many CSA-unrelated variables as CSA-related. Officers performed better in recognizing whether actual CSA-related variables increase or decrease the probability of CSA. Finally, officers were inaccurate in identifying variables that are CSA-related only for boys or only for girls. When asked to estimate the CSA probability of mock scenarios, participants were accurate only in assessing low-probability cases, and this was not associated with the ability to identify CSA-related and CSA-unrelated variables. We conclude that police officers would benefit from more training in using background information and from using available decision-making support tools in the context of investigating CSA allegations.

This chapter presents some challenges faced by the police in identifying child pornography images. In particular, three main problems will be discussed throughout this chapter. The first lies in deciding whether an image is explicit enough to be considered pornographic. The second issue lies in determining whether the victim is a child or someone who appears to be a child. A final challenge concerns how to deal with sexually explicit images produced by someone who is a child themselves. It will be argued that despite emerging investigative and forensic methods, the decision-making process engaged in by police officers still presents some specific challenges. These aspects will be discussed through an analysis of semi-structured interviews with 23 French police officers and forensic analysts working in departments specialising in policing cybercrime and online child sexual abuse.

The management of large-scale incidents, such as demonstrations that can affect public order, requires complex decision making. In association with the London Metropolitan Police a computer-based simulation (CACTUS) was designed for improving the strategic and tactical management of public order events by senior police officers. It incorporates a digitized map with active (iconized) police, crowd and hostile agents able to navigate the map and interact autonomously in ways that simulate aggression and disorder if the police resources and their instructions are not managed with some skill. Adaptive training scenarios were designed in CACTUS by the trainer/facilitators covering planning, event management and debriefing. An evaluation study collected audio and video records of the training sessions and these data gave useful insights into the decision-making processes and how the CACTUS simulation, through its design features, became a dynamic mediational tool in developing such skills.

The current study focussed on the decision-making processes of jurors. The study investigated how jurors make a decision, if they integrate information within their decision-making process and if cue utilisation thresholds promote confirmation bias. To do this, 108 participants listened to one of nine cases. These participants were asked to give a likelihood of guilt rating after each piece of evidence, to state what the last piece of information was that they needed to make a decision and to give a final verdict at the end of a trial. The results highlighted that threshold decision making was being utilised, that information integration may allow thresholds to be reached and that thresholds may promote confirmation bias to reduce cognitive dissonance. In conclusion, this suggests that jurors integrate information until they reach a leading verdict, then the evaluation of information is distorted to support the leading threshold. Implications relate to legal instructions for jurors.

Purpose The purpose of the current study was to evaluate the social and cognitive underpinnings of miscommunication during an interactive listening task. Method An eye and computer mouse–tracking visual-world paradigm was used to investigate how a listener's cognitive effort (local and global) and decision-making processes were affected by a speaker's use of ambiguity that led to a miscommunication. Results Experiments 1 and 2 found that an environmental cue that made a miscommunication more or less salient impacted listener language processing effort (eye-tracking). Experiment 2 also indicated that listeners may develop different processing heuristics dependent upon the speaker's use of ambiguity that led to a miscommunication, exerting a significant impact on cognition and decision making. We also found that perspective-taking effort and decision-making complexity metrics (computer mouse tracking) predict language processing effort, indicating that instances of miscommunication produced cognitive consequences of indecision, thinking, and cognitive pull. Conclusion Together, these results indicate that listeners behave both reciprocally and adaptively when miscommunications occur, but the way they respond is largely dependent upon the type of ambiguity and how often it is produced by the speaker.

Purpose The purpose of this investigation was to understand the decision-making processes used by parents of children with autism spectrum disorder (ASD) related to communication-based interventions. Method Qualitative interview methodology was used. Data were gathered through interviews. Each parent had a child with ASD who was at least four-years-old; lived with their child with ASD; had a child with ASD without functional speech for communication; and used at least two different communication interventions. Results Parents considered several sources of information for learning about interventions and provided various reasons to initiate and discontinue a communication intervention. Parents also discussed challenges introduced once opinions of the school individualized education program (IEP) team had to be considered. Conclusions Parents of children with ASD primarily use individual decision-making processes to select interventions. This discrepancy speaks to the need for parents and professionals to share a common “language” about interventions and the decision-making process.
