This research deals with the names of surat Al-A'ala, number of ayas (verses), place and order of the sura its and the context in relation to other suras. This sura was frequently recited by the prophet for reasons having to do with its inclusion of profound meanings in extolling the creator, and what He bestowed upon humans and especially upon his prophet in matters to do with the revelation of the Quran and the sharia (Islamic jurisprudence). In addition the sura contains most of heart-taking facts; varying conditions of people and human life, the hereafter and accompanying rewards and punishments with underlying assertions that life after death is the real life. The sura also stresses that humanity can only be well guided if the values laid down by the Quran are followed, and that the mission of the prophet of Islam is actually a continuation of that of Ibrahaim and Moses, peace be upon them.

According to Islamic Jurisprudence, one of the most important requirements for a sound marriage is the total agreement of the woman under the guardianship of her father or any other mahram relative. In case of none, the ruler or the judge assume to be a guardian or Wali of a woman. A guardian or Wali is responsible for the selection of the righteous person for the woman and assures the protection and welfare of her Rights and interests. He has the authority to reject and refuse the proposal if the suitor did not deem a sound and sincere match. A marriage without a guardian is considered unlawful, as there is no concept of love affairs and courtship without a guardian in Islam. The guardian evaluates the religious, social and economic compatibility of the couple, while on the other hand a woman selects the spouse on physical attraction and romantic notion which vanishes out soon as the real life starts causing potential problems in relationship. That why Islam lays down principle and law of wilayat for a lady to protect her interests and rights and consider to be a shield and safeguard for her welfare in future marital life.

We produce language forms via their relations in coordinate systems: languages. That is virtual language relativity. Languages are related to phenomena and work in the real life of communities. That is real language relativity. We use languages via symbolic behaviors, living in human communities. Relativism collapses at the level of successful exchange of experience between humans belonging to distant cultures. Relativism is a stance of not recognizing the real relatedness of all languages to one and the same human form and world. Absolutism (Universalism) is a stance of not recognizing relativity as definiteness, that is, the virtual interrelatedness of all languages. Languages are shaped by human life processes. We follow the path from “local languages,” which are analogous to ‘inertial systems’, (this represents ‘virtual relativity,’ which is analogous to special relativity in physics) to living people talking about one shared sensual world (this represents ‘real relativity’).

Abstract: The Authority of Kutub al-Sittah Hierarchy and the Stagnant of Fiqh Studies. This paper tries to map predicaments that contributed to fiqh studies that had been claimed to be stagnant at least by a few Islamic legal scholars. The authority of Kutub al-Sittah hierarchy, in fact, has become an important problem that restricted the learned scientific community or ulama to practice ijtihad. This stemmed from the limitation of the hadits books use at the highest level. The so called Kutub al-Sittah should be properly signified as fiqh book. According to the author, this makes Kutub al-Sittah seems to be resistant to criticism, due to the sacred and intrinsic dimension in it. Therefore, it is urgent that understanding the argument of Traditions which are relevant and in line with the social dynamics should be contextualized. He also maintains that legal deduction of the text of the Traditions does not necessarily overrule the principle values of the text as a foundation for the maslahat concept. In addition, the argues that the authority of the study of Islamic jurisprudence is closely related to the normative values of the text, but nonetheless such norms could not be directly applied to the real life.

Kata Kunci: otoritas, Kutub al-Sittah, fikih

Da ’wa is one of the essential parts of religiosity. According to Islam, every believer has the duty to preach Islamic teachings according to his capability. In the real life, this duty is actualized individually or in group. Da’wa includes inviting people to apply religious values and it is not merely done by Muslims. Followers of other religions also have such activity so that they should hcrve the same chance too. However, we should also realize that there are some contradictory doctrines such as tauhid, prophecy, and humanity.Every religion has an important role in human life which has dijferent culture. In spite of the true reasons, cultural diversity, including tribe, religion, and race, is often used to raise conflicts among people. Many conflicts in Indonesia, which seem to be religious conflicts, need to be viewed in relation to politics, economy, and socio- culture of the people. If religious conflicts really exist, it is necessary to build the spirit of togetherness based on the values of justice, freedom, and human rights. It is expected that the deeper the religious spirit, the deeper the sense of justice and humanity. As a result, in developing harmonious society, universal value-oriented da’wa is needed to create the spirit of togetherness and social solidarity.
