This study aimed to analyze the legal policies of Bali regionaldevelopment planning in providing protection for the existence ofSubak sustainability in development. This study employed anormative legal research method with a statutory approach, andanalytical conceptual approach. The results indicated that theexistence of Subak has been recognized as a model of managementirrigation in Bali that has been inherited by ancestors, which isprotected by the 1945 Constitution. However, the direction ofregional development planning within the framework ofautonomy, places the agricultural sector as the preferredgovernment affair of the regional government authority. Hence, itcauses the agricultural sector does not become the leading sectorin development planning, and beside the priority of theagricultural budget from the portion of planning and regionaleconomic development, which is still below 2% (two percent).There are also a lack and difficulties in synergizing regionaldevelopment in agriculture with efforts to protect Subaks acrossdistricts/cities in the province of Bali.

Economic globalization that is sweeping the world today began with the development of transportation facilities and cross-border trade. One of the facilities in the internet world to support economic activity is Electronic Transactions. In Indonesia, problems that arise due to the use of transaction media through telematics technology continue without being followed by the existence of laws that regulate it (cyber law). This study aims to determine legal policies against crime in electronic transaction activities in various sources of positive criminal law in Indonesia and to determine strategies for overcoming telematics crimes in the field of electronic transactions in global trade. This research is a normative legal research that is finding a rule of law, legal principles, and legal doctrines in order to answer the legal issues faced. The results of this study explain the legal policy against crime in electronic transaction activities in various sources of positive criminal law in Indonesia carried out in two stages, namely the Applicative Stage and the Formulation Stage and explain the Legal Strategy for Combating Telematics Crime in the Field of Electronic Transactions in Global Trade which is carried out through the Penalty Policy and non-penal policy.

The essence of law is to provide welfare to the society. Law as a tool of social engineering for society makes people obey it. Dynamic legal developments encourage progress towards society from various aspects of people's lives. One of them, the enactment of Law No. 11 of 2020 on Job Creation, encourages changes to the order of setting norms that affect other laws that are affected by it. One of those affected by the Job Creation Act is the establishment of BUMDes (Village-Owned Enterprises). Through the provisions of Article 117 and Article 185 b of Law Number 11 of 2020 concerning Job Creation, the government needs to establish a derivative norm that regulates Village-Owned Enterprises. In 2021, the Government issued a regulation related to Village-Owned Enterprises, which is Government Regulation of the Republic of Indonesia Number 11 of 2021 concerning Village-Owned Enterprises. In this provision, it is stated that Village Owned Enterprises, hereinafter referred to as BUMDes, are legal entities established by the village and/or together with villages to manage businesses, utilize assets, develop investment and productivity, provide services, and/or provide other types of business for the maximum welfare of the Village community. In a nutshell, the existence of Village-Owned Enterprises aims to prosper the village community, with the type of business sector owned and support the productivity of rural communities based on village community empowerment. In this study, a legal approach was used with the aim of exploring legal policies towards BUMDes with the enactment of the Job Creation Act. Keywords: Job Creation Act, BUMDes, welfare

Additional quotas for hajj have not been resolved, particularly in regard to the financing of hajj, which requires subsidies. The state's goal of distributing subsidies to those who are unable to afford them has not been met, and the state's concept of welfare democracy has not been realized. Accordingly, this investigation employs normative legal research in order to focus on government policies as well as developing issues related to Hajj financing. A constitutional practice that has gradually become law is revealed in this study, namely the existence of subsidies created by the existence of benefit value instruments and the practice of subsidies that have been carried out previously in an indirect manner by the Minister with agreement from the DPR in determining BPIH by applying a 50% discount to the real cost of the hajj. As long as the constitutional practice is carried out in order to complete, perfect, and revitalize the legislation, this is normal. A formal legislative body or statutory regulation is required if there are any actual or potential constitutional issues with the practice of constitutional law.Keywords: Open Legal Policy, Hajj Financing, Non-Subsidized Hajj, Hajj Category. Kebijakan Hukum Pembiayaan Haji Non Subsidi di Indonesia  Abstrak.Banyaknya tambahan kuota haji belum teratasi, terutama perihal pembiayaan haji yang memerlukan subsidi. Target subsidi yang seharusnya menjangkau masyarakat yang tidak mampu secara finacial dan konsep demokrasi kesejahteraan melalui instrumen subsidi yang digunakan oleh negara dalam hal ini belum terpenuhi. Penelitian ini menggunakan jenis penelitian hukum normatif dengan pendekatan perundang-undangan dan kasus sehingga analisis penelitian lebih menekankan kepada kebijakan pemerintah dan permasalahan yang berkembang mengenai pembiayaan haji. Temuan penelitian ini yakni, keberadaan subsidi yang tercipta dengan adanya instrumen nilai manfaat dan praktik subsidi yang secara tidak langsung, telah dilakukan sebelumnya melalui penetapan BPIH dengan besaran 50% dari real cost biaya haji yang dilakukan oleh Menteri dengan kesepakatan DPR, secara tidak langsung menjadi kebiasaan yang praktik ketatanegaraan yang telah berangsur-angsur lama menjadi hukum. Hal ini adalah lumrah, karena selama kebiasaan ketatanegaraan dilakukan demi melengkapi, menyempurnakan, menghidupkan kaidah-kaidah hukum perundang-undangan, hal tersebut konstitusional. Namun jika praktik ketatanegaraan tersebut justru mengalami permasalahan atau potensi konstitusional, maka hal tersebut harus dipertegas dalam sebuah legis formal atau peraturan perundang-undangan.Kata Kunci: Open Legal Policy, Pembiayaan Haji, Haji Non Subsidi, Kategori Haji. Правовая политика для не субсидируемых Финансирование хаджа в Индонезии Абстрактный.Дополнительные квоты на хадж не решены, особенно в отношении финансирования хаджа, который требует субсидий. Задача государства по распределению субсидий среди тех, кто не может их себе позволить, не была достигнута, а концепция государственной демократии всеобщего благосостояния не была реализована. Соответственно, в этом расследовании используются нормативно-правовые исследования, с тем чтобы сосредоточить внимание на государственной политике, а также на разработке вопросов, связанных с финансированием хаджа. В этом исследовании раскрывается конституционная практика, которая постепенно стала законом, а именно наличие субсидий, созданных наличием инструментов оценки выгоды, и практика субсидий, которые ранее осуществлялись косвенным образом министром с согласия ДНР. при определении БПЖ путем применения 50% скидки к реальной стоимости хаджа. Пока конституционная практика осуществляется с целью дополнения, совершенствования и оживления законодательства, это нормально. Официальный законодательный орган или законодательное регулирование требуется, если есть какие-либо фактические или потенциальные конституционные проблемы с практикой конституционного права.Ключевые Слова: открытая правовая политика, финансирование хаджа, хадж без субсидий, категория хаджа.

<p>As Muslim majority country, Indonesia experiences the mushrooming of banks based on Islamic values (called shariah banking). The existence of sharia banking is followed by legal policies intended to support the progress of the business sector, including regulations regarding the Sharia Advisory Board, but the question is whether the policy is effective in the development of sharia banking in Indonesia. Adherent to that context, this study aims to examine the issues faced by the Sharia Supervisory Board in Indonesia. This article argues that there are at least fifth substantial problems related to the policies of the Sharia Supervisory Board in Indonesia, namely: (1) not all Shariah Supervisory Boards in Islamic business units have supported by a strong legal basis on which their operations are inducted to; (2) members of the Shariah Supervisory Board are appointed mostly based on their charisma and popularity in society, not of their knowledge and experience in related field; (3)ideally Shariah Supervisory Board must have recognized the banking system before becoming Shariah Supervisory Board, but the basic knowledge is not easy to understand when entering on technical issues; (4) many Shariah Supervisory Boards are not focused on shariah banks supervision duty because of their multi profession; (5) lack of advice related to product innovation and social needs issues</p>

The consumption culture and concepts of Chinese households have undergone dramatic changes along with the rapid development of the market economy, that consumption in advance and consumption in debt led by young consumer groups has gradually been recognized and accepted by the public, resulting in accumulated financial risks faced by households with high liabilities from fear of liabilities originally. Based on big data, this paper uses descriptive statistical analysis and related technical tests to conclude the reasons why the household indebtedness of the township residents restrains the escalation of household consumption by using sampling survey and quota survey, and proposes countermeasures to improve the financial literacy of the residents, strengthen the relevant business capabilities of the financial institutions, and improve the related legal policies by the government, with the aim of contributing to the government's ability to make and implement economic policies concerning steady growth in the township and town areas.

This article or article aims to examine and analyze the legal rules governing children involved in motorcycle gangs, as well as the factors causing criminal acts against children involved in motorcycle gangs, as well as legal policies carried out by the police against children involved in motorcycle gangs. The problem is focused on how the legal rules regulate children who are involved in motorcycle gangs. In order to approach this problem, the reference theory of law enforcement, theory of legal certainty and theory of policy is used. The research method in this paper is a normative legal research method. The data were collected through primary, secondary and tertiary data sources, then analyzed using qualitative analysis methods. This study concludes that the legal rules regarding children involved in motorcycle gangs are contained in: the 1945 Constitution of the Republic of Indonesia, Law Number 1 of 1946 concerning the Criminal Code, Law Number 1 of 1974 concerning Marriage, Law Number 4 1979 concerning Child Welfare, Law Number 3 of 1997 concerning Juvenile Court, Law Number 23 of 2002 concerning Child Protection, Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection, Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. Factors that cause crime against children involved in motorcycle gangs are as follows: (1) family factors, (2) social environment factors, (3) education factors. The legal policies carried out by the police against children involved in motorcycle gangs are as follows: (1) Penal policies are applied to children involved in motorcycle gangs as well as non-penal policies.

Traffic problems are one of the problems on a national scale that develop in tune with the development of society. The problem faced today is the high number of traffic accidents on the highway. This study aims to determine the accountability and legal policies in an effort to overcome the perpetrators of traffic accidents that resulted in the death of the victim at the Humbang Hasundutan Police Traffic Unit. The research method used is normative or doctrinal juridical legal research as library research or document study, which has descriptive analysis. The results of the study indicate that the law against perpetrators of traffic accidents resulting in the death of the victim is regulated in Article 359 of the Criminal Code, Article 106 paragraph (2), Article 229, Article 310 paragraphs 1 to 4 and Article 312 of the Law. No. 22 of 2009 concerning Road Traffic and Transportation and Government Regulation Number 37 of 2017 concerning Traffic and Road Transportation Safety. Legal policy in an effort to overcome the crime of traffic accidents that resulted in the death of the victim at the Humbang Hasundutan Sat.Lantas Police carried out penal and non-penal where accountability is carried out by applying imprisonment as regulated in Article 310 paragraph (4) of Law no. 22 of 2009 concerning Road Traffic and Transportation.

Central bank digital currencies (CBDCs) are Bitcoin-inspired currencies that combine aspects of virtual currencies with FIAT money. Many central banks and countries around the world are thinking about or planning to introduce some form of CBDC. Among them, China is leading the way, being the first country to issue their CBDC (Digital RMB) into circulation, even if it is yet a pilot program only. This article focuses not only on the Digital RMB and its legal implementation but also on the political, historical, and economic circumstances of its birth, which, when talking about anything related to China, is often crucial to understanding the phenomenon more than the legal provisions themselves. The aim is to deepen the understanding of legal policies in China and open a discussion about the Digital RMB.

<p>This paper will discuss the politics of Islamic law until now, which still leaves debates between pros and cons parties, this debate is based on differences in views between secular Islamic groups and traditionalists, plus global political conditions increasingly influence the direction of Indonesian government legal policies. Library research is the method used in this paper, the legal policy approach and statute approach are used to analyze data found in various literature. The results of this study indicate that the struggle for the positivists of Islamic law in Indonesia is still reaping polemics, these polemics are based on three things; first, differences in understanding of the relationship between religion and state; second, the contemporary Indonesian political system is influenced by western politics; third, liberalism and communism have helped to hinder the positivists process of Islamic law in Indonesia</p><p><br />Tulisan ini akan mendiskusikan tentang politik hukum Islam hingga saat ini yang masih menyisakan perdebatan antara pihak pro dan kontra, perdebatan ini didasari oleh perbedaan pandangan antara kelompok Islam sekuler dan Islam tradisionalis, ditambahkan lagi dengan kondisi politik global semakin mempengaruhi arah kebijakan hukum pemerintah Indonesia. Library research merupakan metode yang digunakan dalam tulisan ini, pendekatan legal policy dan statute approach digunakan untuk menganalisis data yang ditemukan dalam berbagai literatur. Hasil penelitian ini menunjukan bahwa pergulatan positivisasi hukum Islam di Indonesia masih menuai polemik, polemik tersebut didasari oleh tiga hal; pertama, perbedaan pemahaman tentang hubungan antara agama dan negara; kedua, sistem politik indonesia masa kontemporer dipengaruhi oleh politik barat; ketiga, paham liberalisme dan komunisme turut menghambat proses positivisasi hukum Islam di Indonesia <br />Kata Kunci: Politik, Hukum Islam, Positivisasi</p><div><span><br /></span></div>
