Abstract In a recent decision, the European Court of Human Rights concluded that the constitutional complaint before the Hungarian Constitutional Court can be seen as an effective domestic remedy. This decision shows the growing role of constitutional complaint procedures even in the international system of human rights protection; therefore, it is worth examining how national laws ensure efficient access to such procedures. The current paper aims to analyse a specific aspect of this complex problem, namely, the question of legal aid in constitutional court proceedings – particularly constitutional complaints procedures – in Germany, Austria and Hungary. As a general staring point, it is intended to derive the need for legal aid from the national constitutions, followed by an analysis on the availability of legal aid schemes for constitutional complaint procedures and their conditions. The examination is based on the national legal provisions and case-law, as well as the relevant secondary literature. This comparative study can enable some conclusions to be drawn on the question of how constitutional complaints can become more efficient tools in the protection of fundamental rights for those in need, as well.

We cannot Imagine our life without the law as it also governs the human conduct in day to day life, In a young democracy like that of democracy the Importance of Judiciary is Magnified, although it has its flaws, the Indian judiciary, especially the higher judiciary, has come through for the citizens more often than not, Things changed when the pandemic that struck the world in 2019 made its presence in India as well. It brought the life to standstill, like everything and everyone the judiciary was also affected by the deadly virus too, there was delay in justice, when the most foundational mandate of an institution is not being fulfilled, and its credibility will be called into question. On the other hand the Pandemic has blessed the judiciary in many ways, Indian judiciary has always lacked behind when it came to digital access, and digitalization was limited only to those people who wanted to access individual cases. The court proceedings were still based on old aged approach, however like it forced everyone hand to embrace a new way of living , the Pandemic forced the Indian judiciary to come out of its shell.

The authoritarian ideology that guided the authorities of the communist Polish state did not remain indifferent to the emerging model of jurisprudence in petty offence cases. Eliminating the possibility of court proceedings, the location of adjudicating boards in petty offence cases at national councils, the introduction of collegial jurisprudence exercised by the social factor, giving the jurisprudence an educational character, and abandoning it in favour of severe penalties implemented for hooligan petty offences — these are just some of the features that distinguish the jurisprudence model in petty offence cases in the People’s Republic of Poland. The pursuit of the authorities to subordinate the individuals by, on the one hand, handing over the jurisprudence in petty offence cases into the hands of the people, and, on the other hand, filling the adjudication boards with members subordinate to the authority, did not bring independence in the decisions issued. It is evidenced, for example, by the excessive repressive adjudication boards judgments issued against participants of the political crisis of March 1968. The Authors present the development of the model of jurisprudence in petty offence cases in the controversial period of the communist regime.

Family laws are an essence in  settling on and resolving all issues in any country and in this regard tangling disputes between spouses and issues of divorce and Khula are brought forth the courts so that these matters and issues can be resolve and sort out neutrally and fairly. The  court procedure has grave importance  for the finest  resolution of such sort of  issues and cases. Sometime, the matters and cases , which are brought forth the courts , turn into the worst situation and become more complicated than before due to an inadequate and  derisory procedure, Thus, judicial procedure related to the Divorce and Khula is  an immense perceptive and a sensitive matter. Moreover, the  amendments to the Muslim Family Laws of 2001 in actual  were aimed at dealing familial cases and matters promptly, resolve  all those familial cases which women have to confront, as well as to ensure the  protection of  their rights.  Under the sub- Section 4 of section 10 of the family court Act, October,  2005,  the people have been facilitated  by reducing to bare bones the procedure of  Divorce and Khula. According to the legal connoisseurs , the divorce rate has increased after these facilitating amendments and the situation is that the courts are sharing out  the divorce degrees like sweetmeats. While sometime, under such law the grievance of the  oppressed woman  comes forth. In such familial cases,  laws as well as  the procedure of the court proceedings is also a very delicate issue in which the rate of the divorce and Khula can significantly be reduced by doing some effective  changes and reforms. However, in this research paper , the analyses of the court procedure , regarding the issues of divorce and khula would be presented on.

AbstractVisum et repertum (VeR) is a medical certificate used for judicial needs in the form of a written report made by a doctor containing the results of the examination. VeR is one of the five legal pieces of evidence in court. Making a VeR that is not following hospital procedures can lead to the submission of evidence in court proceedings. This study aims to determine the standard procedure for implementing medical information for VeR and the types of cases for which a VeR is requested. This type of research is a literature review using Google Scholar and Garuda databases with a boolean system strategy. The flow of the implementation of patient medical information for VeR begins with the police submitting a letter of request for VeR to the hospital administration by bringing the requirements of an official request letter from the director of the hospital. The visa request letter and the report are placed in the Medical Record Installation for further processing by the Medical Record. The types of cases requested for VeR are divided into two, namely for living victims and dead victims. Living victims are divided into injuries, sexual crimes, and psychiatric.Keywords: literature review, visum et repertum (VeR), fixed procedure, type of request. AbstrakVisum et repertum (VeR) merupakan surat keterangan medis yang sifatnya dipergunakan untuk kebutuhan peradilan berupa laporan tertulis yang dibuat oleh dokter yang memuat hasil pemeriksaan. Visum et Repertum merupakan salah satu dari lima alat bukti yang sah di pengadilan. Pembuatan visum et repertum yang tidak sesuai dengan prosedur tetap rumah sakit dapat menghambat penyampaian bukti dalam proses pengadilan. Penelitian bertujuan untuk mengetahui prosedur tetap pelaksanaan pelepasan informasi medis untuk keperluan visum et repertum serta jenis permintaan visum et repertum. Jenis penelitian adalah literature review menggunakan database Google Scholar dan Garuda dengan strategi boolean system. Alur pelaksanaan pelepasan informasi medis pasien untuk keperluan visum et repertum dimulai dengan pihak kepolisian menyerahkan surat permintaan visum et repertum ke bagian tata usaha Rumah Sakit dengan membawa persyaratan surat permohonan resmi dari kepolisian kepada direktur Rumah Sakit. Surat permintaan visum et repertum tersebut didisposisikan ke Instalasi Rekam Medis untuk selanjutnya diproses. Jenis kasus yang dimintakan visum et repertum dibagi menjadi dua, yaitu untuk korban hidup dan korban mati. Korban hidup terbagi menjadi perlukaan, kejahatan seksual, dan psikiatrik.Kata Kunci: literature review, visum et repertum, prosedur tetap, jenis permintaan

The authors submit to a detailed analysis the historical milestones of the origin and formation of the institution of departmental procedural control in criminal proceedings in Russia. Taking the generally accepted classification as the basis for constructing a preliminary investigation and highlighting seven periods of the formation of the institution of departmental procedural control, the principles for establishing a particular institutional model of a concrete historical period are reflected. As the main method in the process of writing this article, the general systemic method of cognition was used, which made it possible to comprehensively consider and analyze the process of origin and formation of the institution of departmental procedural control in pre-trial criminal proceedings in Russia. In addition, the authors argue that the institution of departmental procedural control of judicial control in the Russian Federation is quite young and its mechanisms need in-depth study. It is concluded that, through the analysis of statistical data, law enforcement practice, as well as the opinions and developments of scientists-processes, made it possible to identify the optimal ways to solve existing problems and directions for improving criminal procedure legislation.

В статье анализируется структура публичного законного интереса в уголовном судопроизводстве, входящих в него элементов на примере института домашнего ареста. Авторская модель публичного законного интереса участников уголовного процесса «привязана» к стадийности и может распространяться не только на вопросы, связанные с мерами пресечения. По мнению авторов, публичный законный интерес в контексте рассматриваемой проблемы воплощается в жизнь на основе нормативно установленного действия, содержащего конкретно сформулированные правила, устанавливающие четко определенные права и обязанности участников правоотношений. Данная деятельность сопряжена с определенными этапами (стадиями), которые в той или иной степени характерны соответствующей мере пресечения, и возможна в той стадии, где осуществляется оценка действий, предпринятых должностным лицом, осуществляющим производство по уголовному делу. Реализация публичного законного интереса, заявленного следователем, дознавателем на избрание домашнего ареста, зависит от того, как соответствующие устремления оценят другие должностные лица - руководитель следственного органа, прокурор (не обладающие правами реализации публичного законного интереса), то есть от их усмотрения. Законодатель не предоставляет следователю, дознавателю возможность «непосредственно» обратиться в суд - участнику процесса, наделенному правом реализовать их устремление на избрание меры пресечения. Подобные «преграды» не предусмотрены в законе для иных участников уголовного процесса, не наделенных публичной властью и стремящихся реализовать свой законный интерес. The article analyzes the structure of public legitimate interest in criminal proceedings, its constituent elements on the example of the institution of house arrest. The author's model of the public legitimate interest of participants in the criminal process is «tied» to the stage and can extend not only to issues related to preventive measures. According to the authors, public legitimate interest in the context of the problem under consideration is brought to life on the basis of a normatively established action containing specifically formulated rules establishing clearly defined rights and obligations of participants in legal relations. This activity is associated with certain phases (stages) that are more or less characteristic of the corresponding measure of restraint, and is possible at the stage where the actions taken by the official conducting the criminal proceedings are evaluated. The realization of the public legitimate interest declared by the investigator, the investigating officer for the election of house arrest depends on how the relevant intentions will be evaluated by other officials - the head of the investigative body, the prosecutor (who do not have the rights to realize the public legitimate interest), i.e. on their discretion. The legislator does not give the investigator, the inquirer the opportunity to turn «directly» to the court - a participant in the process, entitled to realize their intentions for the election of measures of restrain. Such «barriers» are not provided in the law for other participants in the criminal process who are not endowed with public authority and who seek to realize their legitimate interest.

This article analyses the introduction of online court proceedings through the prism of access to justice. It distinguishes between the two major recent developments in terms of justice and court accessibility – ie the institutionalisation of alternative dispute resolution mechanisms and the expansion of online dispute resolution within public courts. Whilst both movements appear to be driven by similar theoretical forces, the practical adoption of fully online judicial proceedings constitutes a step towards a different direction, opening up new opportunities for attenuating the apparently intrinsic efficiency-fairness trade-off. Due to the unique features of digital technology, the emergence of state-provided online courts and tribunals for the resolution of minor civil disputes could significantly improve the efficiency of formal adversarial litigation processes, without the risk of sacrificing proper procedural protections. Overall, this article advocates that the balanced combination offered by online court systems, albeit not a panacea, may be translated into a potential enhancement of both ‘access’ and ‘justice’.

Although writ proceedings in the Polish civil proceedings have been in operation since the beginning of the modern Polish civil process, there are still controversies in the aspect of fairly structured court proceedings. The defendant may be convinced that their procedural rights have been violated. It is a consequence of considering the case without prior notification of the defendant about the initiation of the proceedings. In such an approach, the judiciary may be perceived as not respecting the standards of a democratic state ruled by law. At the same time, to be closer to the notions of a totalitarian or authoritarian state, because it is not the procedural rights of an individual that are primary, but the effectiveness of the authorities’ actions. However, the concerns about the order for payment mechanism are unfounded as long as the model in which the order for payment is applied complies with the necessary requirements. First, the public authority deciding the case should have the attribute of impartiality. It is not necessary that payment orders are issued by a court. However, if the case is not heard by the court, the judicial control of such decisions is necessary. Second, the evidence should not be assessed. The presentation of specific evidence may, however, be a necessary condition for issuing an order for payment. The issue of the public body examining cases is related to the issue of evidentiary proceedings. These two elements define the nature of the order for payment by defining a procedure model. Finally, it should be pointed out that the order mechanism in a democratic state ruled by law should only supplement the examination of cases in ordinary proceedings (or separate proceedings distinguished by the party types). If the number of cases examined in separate proceedings is significant, and even more so if this way of dealing with cases prevails, ordinary proceedings may be merely an illusion. If in a significant number of cases simplified procedures leading to issuing an order for payment are applied, procedural guarantees related only to ordinary proceedings are irrelevant in such cases.

The ratification of the Lanzarote Convention by Russia in 2013 entails several issues that cannot be resolved without the help of social-humanitarian sciences. Information from sociology, psychology, and jurisprudence has been used to create a concept for the empirical study of the domestic violence against children - to improve the implementation of the Convention in Russia. The concept considers two aspects of the problem - social and social-cultural. The article presents the Russian experience of how the provisions of the Council of Europe Convention on the Protection of Children against Sexual Exploitation and Sexual Abuse are implemented. The authors analyze statistical data on the number of families in which a sexually abused child is brought up; the number of abortions and childbirths by minors; the number of minors in educational colonies; the work of the childrens helpline; the number of mediation services; the number of social service organizations for families and children; the number of professionals working with children in programs aimed at preventing and protecting children from sexual exploitation and abuse; the number of organizations providing psychological-pedagogical and medical-social assistance; the number of specialized multifunctional centers providing assistance to families and child victims of sexual abuse; the number of specialized green rooms for investigating crimes related to minors; the number of specialists accompanying minors who have come into conflict with the law at all stages of the investigation and court proceedings; the number of professionals trained under the Child Sexual Violence Protection Program and now assisting families and child victims of violence. The article will be useful for readers who study the implementation of the Lanzarote Convention and the issues of child sexual abuse and domestic violence.
