Purpose Productive waqf is one type of ethical business/investment, which should comply to Islamic law, with so many models to choose from. The purpose of this study is to determine factors of simple productive waqf, propose several simple productive waqf models and select the best simple productive waqf models appropriate to be adopted by waqf institution in Indonesia. Design/methodology/approach This study applies the analytic network process, including field survey, focused group discussion and in-depth interview, with two groups of respondents, namely, expert and waqf practitioner. Findings The results show that the determinants of simple productive waqf in Indonesia are the waqf institution, productive waqf asset to be developed, how to finance the productive waqf, how to manage the productive waqf and the compliance of productive waqf. Proposed productive waqf models include cash-waqf and self-managed model, Islamic bank financing and self-managed model, Sukuk and external partnership model, cash-waqf and external partnership and cash-waqf + co-financing and external partnership. Moreover, the best simple productive waqf model is cash-waqf and self-managed model, followed by cash-waqf and external partnership, where they could achieve the most in all socio-economic variables, well-being compliance and moral/ethics within the theory of unity of knowledge, Tawhid. Research limitations/implications The simple productive waqf models proposed are not exhaustive, since there are so many variations of the model. Moreover, the case and respondents are all Indonesian, so that the results are possibly only applicable to Indonesia. Practical implications To increase the probability of successful productive waqf development, waqf institutions could apply cash-waqf and self-managed model first, while other models could be applied in staged in line with waqf institution experience. Social implications The successful development of productive waqf could increase the social programs provided by waqf institutions to the society. Originality/value Productive waqf development is desperately needed due to many unproductive waqf lands in Indonesia, while studies have been limited, and there is no study discussing the productive waqf model appropriate for Indonesia.

This research is a normative legal research, namely research that focuses on the study or study of positive law. The Advocate profession is related to the task of serving the community to help solve the legal problems it faces. In carrying out their duties, advocates are guided by the Law on Advocates, but the norms of the law are considered insufficient, because the advocate profession is related to behavior that is not infrequently influenced by the moral ethics of advocates in every decision making. For this reason, in carrying out their duties, they still need an ethical guide as a guide in carrying out their professional duties. In this regard, the Advocate Professional Code of Ethics is very much needed in guiding the behavior of Advocates in making decisions and ethical behavior.

This study aimed to analyze the agreement object as good deeds from the legal philosophy perspective. Postulated to legal positivism, this rejects the deviation of the agreement on the good deed of transplanting organs or body tissues. The results compiled using normative legal research methods described the flow of consequentialism and deontology. These doctrines state that kidney transplant procedures conducted voluntarily based on humanity have benefited recipients and donors. Therefore, they increase the happiness level of both parties without leaving the concept of Kantian moral ethics.

Abstract The essay considers Hermann Melville’s character Bartleby as an example of irresponsible power, since, in the story, the scrivener changes deeply his lawyer employer’s way of thinking and living, without giving any single answer to the many questions which the narrator keeps asking him about his apparently absurd behavior. The article offers some reflections about the difficulties that legal rules, as well as other set of rules (moral, ethics) meet when they are called to face irresponsible powers, and about the need to keep asking questions, though knowing that they will meet no final answers (thus accepting the irrationality of life, and coping with it).

This paper aims to examine Ahmad Syafii Maarif’s inclusive thought and reveal the epistemological basis of interpreting the Qur’an. It further explores to what extent Maarif’s thought has contributed to the development of contemporary Quranic studies. Although Maarif is not an expert of Quranic commentator (mufassir) and does not author works related to the Qur’an, he is well-known as an inclusive-pluralist Muslim scholar who is concerned with promoting the moral-ethical values of the Qur’an. In formulating the ideas of the Quranic epistemology, Maarif consistently embarks from an in-depth exploration of historical knowledge and then refers to the Qur’an to examine a contemporary reality. This approach was connected by forming the world-view of the Qur’an in order to propose the spirit of moral ethics and the principle of justice as a theological lens which he then use to generate creative-alternative solutions dealing with the nation’s problems through a process of contextualization. Maarif’s Quranic epistemology affirms his project to achieve an idealistic Islam, namely the realization of a Muslim community that is consistently guided by the spirit of the moral ethics of the Qur’an.
