Abstract Part XII of the United Nations Convention on the Law of the Sea (UNCLOS) on the protection and preservation of the marine environment contains provisions that are worded in a general manner. As “the problems of ocean space are closely interrelated and need to be considered as a whole”, these provisions need to be interpreted in harmony with the wider corpus of international law. However, when marine environmental disputes are brought before the UNCLOS dispute settlement bodies, their jurisdiction is limited to disputes arising under UNCLOS. The tribunals, therefore, have to navigate between deciding disputes in a hollistic manner and remaining within their jurisdictional limits. This article discusses the techniques used by UNCLOS tribunals to resort to other sources of international law when settling marine environmental disputes. It will then assess whether, in doing so, the tribunals have remained within their jurisdictional parameters and the wider implications of this practice.

From the perspective of legal-international and constitutional guarantees of a two-instance procedure one should consider admissible the exclusion of the control of the actual basis in reference to guilt and punishment when such an adjudication constituted the object of a lawsuit-related contract, for the right to instance-based control of adjudications is relinquishable, and the limitations of the challengeability of contractual rulings was regulated in the Polish criminal procedure as not to exclude the right of the parties to bring about control of contractual rulings in a general manner, but only to constrain the catalogue of the admissible appeal-based accusations. However, the complete liquidation of the instance-based control of the establishment of the actual state of affairs contradicts the legal-international and constitutional guarantees, for the reconstruction of the actual state of affairs constitutes a component of the adjudication about someone’s culpability in the trial-related sense, and the control of the solution of this problem is guaranteed at the international level. The abolishment of instance-based control of the establishment of the actual state of affairs, being a manifestation of the pursuit of praxeological economical arrangements, also results in the reduction of the probability of reaching material truth. Moreover, it changes the model of a multi-faceted verification based activities realised within the framework of a typical instance-based course into control which is similar to an analysis and correction peculiar to the extraordinary modes of control-related proceedings.

In this article we show that, even though the classification and diagnosis of Psychiatric Disorders (PDs) are performed according to essentialist terms, the psychiatric diagnoses currently employed, (i.e., clinical psychiatry) do not actually meet these criteria. Diagnosis is performed operationally. In this paper, we suggest a change of perspective. We reject essentialism relating to PDs and argue for the Homeostatic Property Cluster (HPC) model, which allows a greater insight into the ontology of PDs than the operational perspective. More specifically, we argue that the HPC model allows for a synthesis of continuous and discrete methods of understanding the boundaries between PDs. Finally, we specify in a more general manner, the kind of ontology we deal with when adopting the HPC model, arguing that this model can be viewed as a mirror device, reflecting the ontological features of PDs.

The study presents 175 artefacts from the settlement center in Gniezno – beads and rings. The materials come from settlement levels from around the mid-10th to the 13th centuries. The latest chronological findings based on 14C dating have made it possible to refine the dating, especially of the early settlement levels of the stronghold, where the vast majority of glass artefacts come from. Threeba sic groups of beads have been distinguished based on the technique of their production – beads made of a drawing a tube, the technique of winding a glass strip, as well as casting and sintering. The results of 7 physico-chemical analyzes of the glass composition (performed with the X-Ray Fluorescence, XRF method) are presented. Physicochemical analyzes of the chemical composition of the tested beads made it possible to determine the technological group and the type of glass. An attempt was made to explain the origin of the starting material (glass) for jewelery. A comparative analysis made it possible to indicate in a general manner possible manufacturers and to outline the likely directions of the influx of these glass ornaments to Gniezno.

Concept mapping consist of diagrams that represent the relationships between concepts and words that describe them. The present study aimed to examination of student perceptions of using concept mapping in a pharmacy course. A group of undergraduate students from the sixth semester were the participants. Students received the concept mapping before and after the theoretical class, also could make their own map. In general manner, 97% of the students made use of concept mapping, 90% consider that their use may be useful for learning pharmacology. 50% of participants considered the help provided by concept mapping for their learning as satisfactory, 25% as very satisfactory and 25% as regular. Still, 63% of students intend to continue use of conceptual maps and 34% think about continuing to use concept mapping. Therefore, the study demonstrated that use of concept mapping as a teaching tool for pharmacology class, managed to arouse students interest in contents.

The paper discusses the problems associated with the state-owned real estate disposal. Two groups of objects that have the features of disposition and disposal are distinguished: objects whose disposition and disposal occur in a general manner after removal of their special status (cultural heritage objects, protective structures), and objects whose disposition and disposal are regulated by special legislation in connection with the special purpose of such objects (housing, subsoil use, water transport). Features of the disposal of such facilities, in particular the need to remove special status prior to the disposal of the facilities, are considered. The problem of registration of rights to land plots under objects that are subject to demolition or are virtually absent is considered. It is concluded that it is necessary to improve the legislation regarding the disposal of facilities, including the development of a procedure for the sale of materials resulting from the demolition of capital construction facilities.

Some remarks about the development of secondary spatial prepositionsThe literature devoted to spatial prepositions is quite abundant. The present article constitutes a recapitulation of the historical research which has heretofore been done on the subject. It is also an attempt at presenting the general characteristics of the evolution undergone by the class of units being described. This class is treated here in a broad manner, taking into account also equivalence. Spatial prepositions are the oldest layer of secondary forms and as far as many aspects are concerned, they constitute a very peculiar group. The attention of the scholar is drawn to lexemes such as blisko [close to, near] and the complex prepositions such as zza, poza, spoza [from behind, beyond, from beyond], which emerged quite late. Properties which are important for the evolution of the prepositions in question also include the considerable number of their variants. The direction of their evolution is quite clear also as far as their functions are concerned. The Polish language inherited from the Proto-Slavonic language precise distinctions of proximity, in contradistinction to the ablative content or expressions of considerable distances, which are indicated in a relatively general manner. The development of secondary prepositions emphasizes these properties of spatial description even further. As years went by, the disproportion between the indications of approaching and departing, of being near and being far away, did not diminish. On the contrary, it increased. The peculiarity of secondary prepositions is determined by their relationship with other classes of words that also describe spatial relations. Without doubt, this mutual relationship, which determines the evolution in spatial description, requires in-depth research. Kilka uwag o rozwoju wtórnych przyimków przestrzennychLiteratura poświęcona przyimkom przestrzennym jest dość bogata. Niniejszy artykuł stanowi podsumowanie dotychczasowych badań historycznych i jednocześnie próbę ogólnej charakterystyki ewolucji omawianej klasy jednostek. Klasa ta traktowana jest tu szeroko, również z uwzględnieniem ekwiwalencji. Przyimki przestrzenne stanowią najstarszą warstwę form wtórnych i tworzą grupę pod wieloma względami specyficzną. Zwracają uwagę leksemy typu blisko oraz dość późno utworzone przyimki złożone typu zza, poza, spoza. Do cech ważnych dla ewolucji omawianych przyimków zalicza się również znaczną wariantywność. Kierunek ich ewolucji jest dość wyrazisty także pod względem pełnionych funkcji. Polszczyzna odziedziczyła po prasłowiańszczyźnie szczegółowe wyróżnianie relacji bliskości w odróżnieniu od dość ogólnie wskazywanych treści ablatywnych czy określeń znacznych odległości. Rozwój przyimków wtórnych te cechy opisu przestrzennego jeszcze mocniej uwypukla. Dysproporcja między wskazaniem zbliżanie–oddalanie, blisko–daleko z biegiem lat nie zmniejsza się, a wręcz przeciwnie – rośnie. O swoistości przyimków wtórnych decyduje związek z wieloma innymi klasami wyrazów – wyznacznikami relacji przestrzennych. Ta wzajemna zależność, wyznaczająca ewolucję w opisie przestrzennym, niewątpliwie wymaga gruntownych badań.

The crucial interpretive hypothesis of the present book is that central parts of Spinoza’s theoretical philosophy, and in particular his philosophy of mind established in Part Two of the Ethics, can only be understood against the backdrop of the conviction that subjective experience is explainable, and that its successful explanation is ethically relevant because it makes us wiser, freer, and happier. The introduction discusses, in a general manner, what requirements a philosophical system that aims do this must fulfill. Such a system, it is argued, commits itself to a realist version of extreme rationalism that maintains the difference between thought and reality; it cannot, as is sometimes assumed, turn into some form of absolute idealism. Furthermore, in looking at how this fits with Spinoza’s approach in the Ethics, the book shows how the structure of Part Two, along with Spinoza’s proceeding in geometrical manner, must be comprehended.
