The article is devoted to the problem of the validity of determining the wear of component parts when calculating the damage caused to a vehicle due to its deterioration. The authors address the legal line of arguments of the differentiated approach when deciding on the need to consider wear and tear. They also make suggestions on its practical reflection in forensic expert opinions. Finally, it is highlighted that when making decisions regarding wear and tear, it is essential to consider the method of compensation for damage caused and official legal information.The authors justify the necessity to use the provisions of the methodological recommendations developed in the Federal State Budgetary Institution of the Russian Federation under the Ministry of Justice of the Russian Federation in the calculations, which will allow experts to formulate categorical and not relative or multivariate conclusions.

A one-off for family members in the event of the death of an insured person as a result of an accident at work or occupational disease shall be of an insurance nature. It is granted in the event of the death of an insured person who was covered by accident insurance. The benefit is paid by ZUS on the basis of a decision. It is paid from the accident fund, where the premiums paid for accident insurance are collected. In addition, the amount of the premium depends on the degree of risk of accident. The conditions for one-off compensation and its amount were structured in a schematic manner, since it was not necessary to determine the nature and size of the damage. Such rules for determining one-off compensation lead to simplification and scheme for compensation for damage. These features of compensation mean that the damage can be repaired in a limited manner. Accident compensation does little to meet the characteristics of civil law compensation. The extent to which the compensatory function of compensating for damage is to be carried out will depend on the type of damage and its extent, as well as on whether family members will be entitled to other accident benefits.

The authors study the controversial issues of termination of a criminal case (criminal prosecution) on the condition of voluntary compensation for the damage caused by the crime by the suspect (accused) during the preliminary investigation. The thesis is proved that in Russian criminal proceedings the procedure for voluntary compensation for damage caused by a crime is quite clearly regulated, and if the suspect (accused) voluntarily compensated for the property damage caused, then their actions will be evaluated within the current legal framework, when the fact of compensation for damage creates grounds for exemption from criminal liability and termination of the criminal case (criminal prosecution) in accordance with Articles 75, 76, 761, 762 of the Criminal Code of the Russian Federation, Articles 25, 251, 28, 281 of the Criminal Procedure Code of the Russian Federation.

The subject of this research is the set legal norms that regulate public relations arising in the process of compensation for damage inflicted to the environment as a result of oil spills. The goal of this work consists in formulating the theoretical and practical conclusions and proposals on the improvement of the institution of compensation for environmental damage as a whole, and the legal aspects of compensation for damage inflicted to the environment due to oil spills in particular. The relevance of this topic is substantiated by the statistical data; for example, in the Arctic Zone of the Russian Federation, the total area of disturbed land as of 2019 was 218,641 hectares, and most of them (according to the data for the entire observation period) were formed due to the extraction of mineral resources, as well as a result of oil and spills during their transportation. In 2019, 17, 000 accidents related to oil spills took place in the Russian Federation, among which 10, 500 were the accidents on oil pipelines. The article explores the questions associated with compensation for environmental damage. The analysis of the effective legislation in this sphere and its practical implementation allowed making a range of conclusions It is noted that the mechanism of compensation for environmental damage in the Russian Federation has significant flaws, namely with regards to compensation for damage in kind, offsetting the costs incurred by the infliction of environmental damage to repair such damage. The issues related to the procedure of disbursement of compensation for environmental damage to restore the state of the environment remain open and virtually unresolved. Recommendations are made on solution of the indicated problems.

In criminal proceedings of Vietnam, in contrast to the Code of Criminal Procedure of the Russian Federation, it is advisable to separate physical, material and moral damage that may be caused by the crime or socially dangerous act prohibited by the criminal law, the rights and legitimate interests of natural or legal persons. The article is devoted to solving the problem of compensation for damage caused by a crime in pre-trial proceedings in criminal cases, based on the study of Russian and Vietnamese criminal procedure legislation, practice, and results of its application. The existence of significant reserves for the improvement of Ukraine’s domestic legislation norms in the issues of the criminal-procedural guarantees of the safety of the participants of the criminal proceedings strengthening has been stated. The need to expand the list of participants in criminal proceedings to whom security measures may be applied has been proved, due to including: a) persons who have declared another public dangerous act or otherwise participated in or facilitated the revealing, prevention, termination, or disclosure of another public dangerous act; b) civil plaintiffs, civil defendants and their representatives in cases of compensation for damage caused by other public dangerous acts; c) persons, who have committed another socially dangerous act prohibited by the Criminal Code of Ukraine; d) persons regarding which a decision to close criminal proceedings has been made (if they have not facilitated the revealing, termination or disclosure of criminal offenses or other public dangerous acts); e) convicted / acquitted; f) mortgagors; g) figurants. It is stated, that post-criminal impact on a participant in the proceedings is possible not only by causing harm to himself, family members, or close relatives but also by causing harm to any other person (with whom the participant is not connected by any family or close relations). It is proved, that post-criminal impact on a participant in the proceedings can manifest not only in the form of threats and other illegal measures but also do not formally go beyond the law.

The paper presents a continuation of the research on the problem of realization of compensation for damage caused by the commission of criminal offense. In the first paper created within the same project, the author laid the foundations of the problem, dealing with the theoretical notion of damage caused by a criminal offense, the notion of civil torts and tortious liability, and the distinction between the notion of damage and the consequence of a criminal offence. This time, the author will concentrate on settling the receivables for damages by presenting the entire path that one claim for damages should take. Namely, obtaining a property claim should occur primarily in criminal proceedings, but it is most often adjudicated in litigation because in most cases the subject entitled to it is referred to litigation in order to exercise his right to compensation. After the judgement in the civil procedure is rendered, which orders the defendant-convict in the criminal procedure to compensate the caused damage either by compensating the damage in money or by returning the thing, or by annulling a certain legal deal, the concrete execution of the verdict in the executive procedure begins. While studying the manner of collecting the claims of the entitled subject through all three different procedures for the damage caused by the commission of criminal offense, the author also deals with controversial issues that may arise (the issue of statute of limitations for property claim, the issue of subjects who may be holders of property claims, the adequacy of the procedure in which the property claim is exercised, the means of execution of a monetary claim for damages caused by the commission of criminal offense, etc.).
