This study tackles the issue of‘rape crime’ in 1991 Sudan Criminal laws in comparison with the 1974 & 1983 Sudan Criminal, 1983 Egyptian Criminal laws and the Islamic Jurisprudence.   The study defines the linguistic meaning of the word ‘rape’, then it explains the particular use of the term among the scholars of Sharia and in the Sudanese and Egyptian Criminal laws as well as other Criminal laws.   The study identifies the significant social, political, educational, and mass media factors that contribute to the prevalence of this criminal phenomenon.   Plus, the study investigates some of the Sudanese court verdicts on rape crime, particularly those incredible, absurd and gross rape cases which arc absolutely alien to the Muslim community.   The study explores all the legal factors of this crime and then the penalty prescribed in the 1991 Sudan Criminal laws in comparison with the 1974 & 1983 Sudan Criminal laws, 1983 Egyptian Criminal laws and the Islamic Jurisprudence.   The study concludes that its absolutely necessary to implement the Islamic penalties [Hidudl in the Muslim communities.   Also the study calls for the necessity of solving the relevant social and economic questions in the Muslim communities, propagation of the sound Islamic values, simplification of marriage ceremonies and brevention of harmful materials in mass media

This research deals with the names of surat Al-A'ala, number of ayas (verses), place and order of the sura its and the context in relation to other suras.   This sura was frequently recited by the prophet for reasons having to do with its inclusion of profound meanings in extolling the creator, and what He bestowed upon humans and especially upon his prophet in matters to do with the revelation of the Quran and the sharia (Islamic jurisprudence).   In addition the sura contains most of heart-taking facts; varying conditions of people and human life, the hereafter and accompanying rewards and punishments with underlying assertions that life after death is the real life.   The sura also stresses that humanity can only be well guided if the values laid down by the Quran are followed, and that the mission of the prophet of Islam is actually a continuation of that of Ibrahaim and Moses, peace be upon them.

This research examines parameters in taking maximum benefits from recognized Islamic schools concerning the rulings of a person’s Zakat distribution without paying it to Zakat centre. Fatwa of the National Fatwa Committee of Malaysia has been used as a model in this research. This discussion has been completed through a critical descriptive approach to describe the matter, conforming to scholars’ opinion and its analysis through reliable sources in Islamic jurisprudence and its origins, thus coming up with reasonable appropriate results. The directives and principles were extracted from Islamic rulings and linked to the current situation of the Islamic society so that this study would not remain merely imaginary theories, far from the reality of the community. The researchers meditated and criticized the advisory opinion issued by the National Fatwa Committee of Malaysia on the provision of distributing zakat directly to its receiver without paying it to the Zakat centre. The researchers found that the National Fatwa Committee adheres to the parameter in issuing fatwa, as it has issued a fatwa that contrary to the opinion of the official recognized fiqh school in Malaysia by considering appropriate interest.

This article explores moderate and eclectic traditionalism beyond Kiai Haji Muhammad Hashim Ash’ari’s contribution in the shariah and Islamic jurisprudence of social politic (Fiqh al-Siyâsah al-Ijtimâ’iyah) in Indonesia. It is conceptual research referring to some of his works as well as discussion about his thought among Islamic scholars. Based on definition of moderation from the Qur’an, hadith, and some scholars’ opinion, Hashim can be best categorized as Islamic traditionalist figure who enforced both moderation and eclecticism. However, he maintained distinctive features compared to both traditionalist and modernist Islamic figures. It is mainly clear from both his thought and movement which rely on the Ahlus Sunnah wal Jama’ah in theology, four fiqh school leaders (Hanafiyah, Malikiyah, Syafi’iyah dan Hambaliyah), and thariqah sufiyah mu’tabarah. Additionally, he showed appreciation and promoted for adaptation to both local and foreign idea that later inspired distinctive religiosity in Indonesia. This particularly applies in the concept of relation between Islamic law and nationalism, jihad, political fiqh and governmental system in Islam. تستكشف هذه الورقة الوسطية التقليدية والانتقائية التي ساهمها كياهي حاجي محمد هاشم الأشعري في الشريعة الإسلامية وفقه السياسة الاجتماعية. إنه بحث مفاهيمي يشير إلى بعض أعماله وكذلك مناقشة حول أفكاره كعلماء المسلمين. بناءً على تعريف الوسطية من القرآن والحديث وبعض آراء العلماء، يمكن تصنيف هاشم بشكل أفضل على أنه الشخصية الإسلامية التقليدية التي فرضت الوسطية والانتقائية. ومع ذلك، فقد حافظ على سمات مميزة مقارنة بكل من الشخصيات الإسلامية التقليدية والحداثية. يتضح بشكل أساسي من فكره وحركته اللذين يعتمدان على أهل السنة والجماعة في العقيدة، قادة المذاهب الفقهية الأربعة (حنفية، المالكية، الشافعية والحبلية) والطريقة الصوفية المعتبرة. بالإضافة إلى ذلك، أظهر التقدير والترويج للتكيف مع الأفكار المحلية والأجنبية التي ألهمت لاحقًا التدين المميز في إندونيسيا. وهذا ينطبق بشكل خاص على مفهوم العلاقة بين الشريعة الإسلامية والوطنية والجهاد وفقه السياسية والنظام الحكومي في الإسلام.

جريمتا القوة الجنائية و الإرهاب في القانون السوري و السوداني : دراسة مقارنة في الفقه الإسلامي A Summary of The Criminal Force and Terrorism's Research, a study in the light of Islamic jurisprudence and Syrian and Sudanese Laws. This research handles the criminal force and terrorism in accordance with Islamic jurisprudence compared with the laws of Syria and Sudan. It involves two matters: The first searches into the criminal force defined as using force against one's freedom to commit a crime, damage, bother, hurt or scare. This crime has three comers: 1. Physical done by using force against others. 2. Incorporeal: the intention to hurt by force. 3. Jural: this is the very textual law that condemns the act and penalizes the resultant. Then the research pinpoints, abiding Islamic jurisprudehce, the punishment of committing the crime. It is a penalty issued and judged only by the judicial authority because it is not detailed as Qisaas. This punishment is issued by virtue of N.143 Sudanese and N.559 Syrian Law Articles. The second probes terrorism defined as threatening others. This also has three corners: 1- Physical as a process of threatening. 2- Incorporeal by the intention and will to commit the crime. 3- Jural as having a text condemns the act. Then it shows, abiding Islamic jurisprudence, the punishment of the crime, which is issued and judged by the judicial authority by virtue of N.144 Sudanese and N.560-564 Syrian Law Articles

Balagah and usul fiqh are two different sciences. Balagah science is the science that reveals an aesthetic meaning which is clearly used in a real expression, Takes an effect in our soul, and maintains the relevance of each sentence with where the phrase is being pronounced. Moreover, please pay attention to the coherence with the people we talk to. Whereas Usul Fiqih is the Islamic legal sciences (Islamic jurisprudence) studied theories, norms, and sources. Both sciences are studied in relation to fi'il amr, In Balagah, Fi'il amr is the one method from Insya Zalbi decree while in Usul Fiqih, fiil amr is the one of Usul Fiqih Norm which is due to that the law and syari’as can increase. And the result of this research is, in Balagah and Usul Fiqih have the same interpretation about fi’il amar that requires to have to do from a higher authority to underling, and that have 4 sigah. And the difference between the two science is from the meaning of fi’il amar, in Balagah have a special meaning from fi’il amar that there is no meaning in Usul Fiqih that the means is lasting. Permission and exemplary. So in Usul Fiqih have a special meaning from fi’il amr there is no meaning in Balagah that means is: obligatory, mouming, admonition, discussion, degradation, patience, dissuasion, delegation.

This study explores the issue of usury from the point of view of the hadith of the prophet. For the sake of finding supporting data against the argument that usury is not justified in Islamic law. This study uses a hadith science approach and various kinds of scientific approaches as supporters to understand the content of the hadith about usury. In this study, the authors found that before this study many criteria and benchmarks for usury were found in relation to buying and selling, exchanging, saving and borrowing, and knowing the laws of usury transactions clearly. Of course, studies on usury have been written by many Islamic law researchers, including Abdul Gofur with the theme of the concept of usury in the Koran, Riya Rohma Setyawati et al with the theme of usury in the view of Islam, Miriam So Phia with the theme of usury in Islamic jurisprudence, Abdurrahim Abdul Hamid al-sa'ati with the theme al-'illah al-Iqtishadiyah li tahrim al-Riba al-Nasiah wa al-Fadhl. Nevertheless, the author has its own uniqueness in examining the issue of usury in terms of the methods and approaches applied in this study. The approaches applied in this research include: First, the author uses a hadith science approach in conducting research, in order to be able to explore and explore the context of the prophet's hadith accurately. Second, the author uses various scientific approaches that can be a sharp tool in realizing an objective research.   Abstrak Penelitian ini mendalami persoalan riba dari sudut pandangan hadis nabi. Demi ditemukannya data penguat terhadap argumen riba itu tidak dibenarkan dalam syariat Islam. Kajian ini menggunakan pendekatan ilmu hadis dan erbagai macam pendekatan ilmia sebagai pendukung untuk memahami kandungan hadis tetang riba. Pada penelitian ini penulis menemukan bahwa sebelum penelitian ini telah banyak ditemukan kriteria dan tolak ukur riba dalam kaitannya dengan jual beli, tukar-menukar, simpan pinjam, serta mengetahui hukum transaksi riba secara terang. Tentu saja kajian tentang riba telah banyak ditulis oleh para penelisik hukum Islam di antaranya Abdul Gofur dengan tema Konsep Riba dalam al-Quran, Riya Rohma Setyawati dkk dengan tema Riba dalam pandangan Islam, Miriam So Phia dengan tema Riba In Islamic Jurisprudence, Abdurrahim abdul hamid al-sa’ati dengan tema al-‘illah al-Iqtishadiyah li tahrim al-Riba al-Nasiah wa al-Fadhl. Kendatipun demikian, penulis memiliki keunikan tersendiri dalam mengkaji persoalan riba dari segi metode dan pendekatan yang diterapkan dalam penelitian ini. Pendekatan yang diterapkan dalam penelitian ini di antaranya Pertama, penulis menggunakan pendekatan ilmu hadis dalam melakukan penelitian, agar dapat menelusuri dan mendalami konteks hadis nabi secara akurat. Kedua, penulis menggunakan berbagai pendekatan ilmia yang dapat menjadi alat yang tajam dalam mewujudkan sebuah penelitian yang objektif.

This research aims to study the obstacles and solutions related to the application of hudud in Sharia courts in northern Nigeria; This is due to the presence of many problems when applying the hudud in Sharia courts, such as the conflict between the Federal Constitution and the Constitution of the States, especially with regard to the application of the had for theft. The researcher studied the Shariah hudud in general in terms of defining them linguistically and legally, with mentioning their types, while addressing the practical application of Shariah hudud in the Shariah courts in some northern states that were chosen as a model, these states are: Zamfara, Jigawa, Kan, Kaduna, Katsina and Bauchi states.The researcher also touched on the legal system and courts in Nigeria in general and the legal system and Sharia courts in northern Nigeria in particular, and the Islamic penal laws of the states of Zamfara, Kanbuchi and Jigawa were also discussed. The researcher used two scientific research methodologies, including: the inductive theoretical method; where he studied the subject of borders in general and the hudud of theft, especially in jurisprudence blogs, in addition to books, studies, letters, scientific articles, reports and legal documents that were written in this field and stored in libraries, websites and other sources of information. The researcher also used the applied analytical method; Where he studied the issues related to the hudud that were applied in the Sharia courts in northern Nigeria, especially with regard to the hudud of theft, and the study of the obstacles in the application of these hudud in order to find appropriate solutions to them. The researcher reached a number of results, including that Islamic Sharia is the optimal system that should be applied to obtain permanent happiness in this world and the hereafter. The application of legal borders effectively contributes to the elimination of crimes committed and prevalent in Nigerian society, especially in the northern regions. Among the findings of the research, the compatibility of Islamic criminal law with Islamic jurisprudence in most aspects, and the compatibility of the applications of Sharia courts with Islamic law in many cases. The researcher recommends the officials to carry out all the solutions mentioned in the study so that they can better apply the Sharia and implement the Sharia hudud. He also recommends to them the necessity of developing Islamic criminal law to be fully compatible with Islamic law, and the necessity of implementing all judgments issued by Sharia courts.

This research aims to clarify the provisions in which the Kosovan family law violated Islamic Shari’a، the researcher followed the inductive method، the analytical method and the comparative method for its suitability to the study، the researcher reached a number of results، most notably that the Kosovan family law violated the Islamic Shari، a in the folloving issues: prohibiting polygamy, alloving the Muslim woman to marry a non- Muslim, the Kosovan law also allowed the court to allow to marry Non –Marriageable female relatives by affinity for acceptable and clear reasons, the researcher also recommended that the Kosovar legislator shall adopt the provisions of Islamic Shari,a that contribute to protecting the rights of family members from Islamic Sharia.
