The Structural Injustice Turn, the Historical Justice Dilemma and Assigning Responsibility with the Canadian TRC Report

Abstract This article addresses the historical justice dilemma: although critical memory is indispensable for accountability, efforts to use it are often hampered by the unjust relations and systems that caused the wrongs to which historical justice is compelled to respond in the first place. Contemporary authors tackle this problem by focusing on collective responsibility for structural injustice. This article takes a different tack. Studying closely the 2009–2015 Truth and Reconciliation Commission of Canada (TRC) report, it argues that the structural turn may come at the expense of a focus on agency and may thus provide unwitting anonymity for wrongdoers while crimping our thinking about leadership and responsibility. Although this article strongly criticizes the TRC report, it tries to work constructively with it, developing an analysis that compensates for the report's unwitting invisibilization of perpetrators. Distilling portraits and analyses of wrongdoer agency that are latent in the TRC's postwar history volume, this article shows how we can develop the report as a resource of what I call retributive social accountability.

Historical policy was one of the main directions of the domestic policy of the Roh Moo-hyuns government (2003-2008). The ideological justification of revising the 20th century history of Korea was the idea of building a new Korean society based on the principles of democracy and the rule of civil rights and freedoms. Through the implementation of a new historical policy the Roh Moo-hyuns government tried to prove that the creation of such a society was impossible without revealing the truth about the historical past, in which the state repeatedly neglected civil rights and committed crimes. Increased attention to issues of restoration of the historical justice is typical for the current government of Moon Jae-in, the political successor of Roh Moo-hyun. Based on the analysis of the governmental documents, legislation this paper reveals the main disagreements between political parties of the Republic of Korea around the establishment of the Truth and Reconciliation Commission, identifies the key results of its activities.

Many regard South Africa’s reconciliation process as a model for a search for peace in and among nations. The South African Truth and Reconciliation Commission played an admirable part in this. However, problems remain in continuing and completing this reconciliation project. For many the failure to secure social justice through reconciliation remains one challenge. At issue is also how South Africans deal with their fractured and painful past. This article revisits issues of culpability and responsibility by asking whether a primary obstacle towards reconciliation might be that South Africans, instead of taking personal and collective responsibility for reconciliation, have hidden behind two major and completely opposite South African figures: Nelson Mandela and Eugene De Kock. It is argued that the ‘deification’ of Mandela and the ‘demonization’ of De Kock pose an important obstacle for the acceptance of culpability and responsibility for addressing historic wrongs with a view to true reconciliation.

Two significant twentieth century female philosophers, Hannah Arendt and Antjie Krog, critically evaluated two of the most egregious humanitarian crimes of the past hundred years. In the essay ‘Personal responsibility under dictatorship’, Arendt (1906-1975) used the trial of Adolf Eichmann, who was convicted and executed for crimes against humanity committed during World War II, to explain the connection between existence and thought and the necessity of a commitment to thinking; it was also a mouthpiece to voice her opinion on judgment, punishment, vengeance, collective responsibility and morality. In her book Country of my skull2 Krog (1952- ) reported on and analyzed the history, process and effects of the Truth and Reconciliation Commission (‘the TRC’), a commission established to assist the new democratic South Africa in dealing with Apartheid crimes.

Truth and Reconciliation Commissions (TRCs) are established to document violations of human rights and international humanitarian law in post-conflict societies. The intent is to excavate the truth to avoid political speculations and create an understanding of the nature of the conflict. The documentation hence results in a common narrative which aims to facilitate reconciliation to avoid regression to conflict. TRCs therefore do a tremendous job and create compound documentation that includes written statements, interviews, live public testimonies of witnesses and they also publish final reports based on the accumulated materials. At the end of their mission, TRCs recommend the optimal use of their documentation since it is of paramount importance to the reconciliation process. Despite this ambition, the TRCs’ documentation is often politicized and out of reach for the victims and the post-conflict societies at large. The TRCs’ documentation is instead poorly diffused into the post conflict societies and their findings are not effectively disseminated and used.

The ignorance of many Canadians regarding residential schools and their traumatic legacy is emphasised in the reports of the Truth and Reconciliation Commission (TRC) as a foundational obstacle to achieving reconciliation. Many of the TRC's calls to action involve education that dispels and corrects this ignorance, and the commission demands ‘age-appropriate curriculum on residential schools, Treaties, and Aboriginal peoples' historical and contemporary contributions to Canada’ to be made ‘a mandatory education requirement for Kindergarten to Grade Twelve students’ (Calls to Action 62.i). How to incorporate the history of residential schools in kindergarten and early elementary curricula has been much discussed, and one tool gaining traction is Indigenous-authored picturebooks about Canadian residential schools. This article conducts a close reading of Margaret Pokiak-Fenton and Christy Jordan-Fenton's picturebook When I Was Eight (2013). The picturebook gathers Indigenous and settler children together to contest master settler narratives regarding the history of residential schools. Using Gerald Vizenor's concept of ‘survivance’ and Dominick LaCapra's notion of ‘empathic unsettlement’, the article argues that picturebooks work to unsettle young readers empathetically as part of restorying settler myths about residential schools and implicating young readers in the work of reconciliation.
