La participación de la víctima en la fase de ejecución del proceso penal en nuestro ordenamiento es un hecho novedoso que, más allá de la reparación civil, arranca del Estatuto de la víctima en año 2015, el cual introduce la Justicia Restaurativa en ese momento procesal. Este instrumento puede ser una importante alternativa o complemento a la Justicia tradicional en aras de lograr una mejor satisfacción de los intereses de la victima. Siendo este el objetivo, se viene desarrollando desde el año 2019 una experiencia en el CIS “Máximo Carrera” de Valladolid en la cual se trabaja con liberados condicionales, penados clasificados en tercer grado y condenados a la pena de trabajos en beneficio de la comunidad, con el objetivo de elaborar un protocolo de actuación extensible a otros centros. The participation of the victim in the execution phase of the criminal process in our legal order is a novel fact that, beyond civil reparation, starts from the Statute of the victim in 2015, and introduces Restorative Justice at that procedural moment. This instrument may become an important alternative or complement to traditional Justice in order to achieve a better satisfaction of the interests of the victim. A Program dealing with conditional parole inmates, convicts classified in third degree and sentenced to comunity services has been developed in the CIS “Máximo Carrera” of Valladolid since 2019, with the aim of drawing up an action protocol that may be extended to other prisons.

In the 21st century, the concept of restorative justice has become widespread in criminal proceedings. The introduction of special compromise procedures into the criminal process allows for the restoration of the rights of the victim and reduces the level of repression in the criminal justice system. The traditional system of punishment is considered ineffective, not conducive to the purpose of compensating for harm caused by the crime. Restorative justice enables the accused to compensate for the harm caused by the crime and is oriented not towards their social isolation, but towards further positive socialization. The introduction of the ideas of restorative justice into the Russian criminal process requires the introduction of special conciliation procedures. The purpose of the article is to reveal promising directions for introducing special conciliation procedures into the Russian criminal process. The use of the formal legal method provided an analysis of the norms of criminal procedure legislation and the practice of its application. Comparative legal analysis revealed common features in the development of models of restorative justice in modern states. Conclusions. The introduction of conciliation procedures into the Russian criminal process is in line with the concept of its humanization and reduction of the level of criminal repression. The consolidation of the mediator»s procedural status and the mediation procedure in the criminal procedure legislation will make it possible to put into practice the elements of restorative justice.

In this article we outline a typology of ‘models’ or conceptual contexts within which a variety of victim-based measures has been proposed, and in many cases adopted, in various common law jurisdictions. The purpose of the typology is to clarify some of the confusion surrounding these measures and, in particular, the scope they offer for reparative and restorative approaches to operate either within or alongside the mainstream criminal process. Drawing on recent empirical findings and theoretical writings we also seek to evaluate the victim-oriented measures that are associated with each of the models. Within the typology three distinct models of restorative justice are examined and we argue that one of these, the Communitarian Model, emerges as the most coherent, credible and constructive challenger to the hitherto predominant Retributive Model.

De há muito é possível verificar que o processo penal não tem proporcionado soluções efetivas à prática de um delito. Diante de uma sociedade insegura, que exige o recrudescimento do sistema penal e processual penal, apoiando ideias punitivistas, de lei e ordem e tolerância zero, e leis eminentemente simbólicas, faz-se imprescindível a busca de uma alternativa que atenda às necessidades das vítimas e dos ofensores, bem como da comunidade envolvida com o ilícito. Nesse contexto surge a Justiça Restaurativa como promissora possibilidade. Já aplicada em outros países, defendida pela Organização das Nações Unidas (ONU) e acolhida pela Resolução n. 225/2016 do Conselho Nacional de Justiça, ela começou a ser utilizada no Brasil, especialmente a partir da metodologia dos Círculos de Construção de Paz. Assim, compreender essa realidade e a solução que se nos apresenta é de sobremaneira importância aos aplicadores e estudiosos do processo penal pátrio.
