Research in informal settlements in South Africa has shown that conflict is inherent between groups within a settlement and between the broader community and the land administration authorities. In general, groups and sub-groups continually form, reform and dissolve within informal settlements. Moreover, the internal rules that a community creates relating to land tenure tend to be manipulated by sub-groups as they compete for land, resources and power. Internal rules are not static but are subject to continual change. Similar characteristics were observed in Elandskloof, a rural land restitution case in the Western Cape province of South Africa.

AbstractThrough two rounds of land contracting, rural households have been allocated a bundle of rights in land. We observe significant differences across villages in the amount of land to which villagers retain a claim and the institutional mechanisms governing the exchange of land rights. This study reveals the perpetuation and expansion of non-market mechanisms accruing to the benefit of village cadres and state officials and only limited emergence of market mechanisms in which households are primary beneficiaries. It identifies factors in economic, political and legal domains that incentivize and enable state officials and local cadres to capture returns from use of land. Relatedly, the study finds differences in conflict over property-rights regimes. Drawing on a pilot survey carried out by the authors in November of 2011 in Shaanxi and Jiangsu provinces (192 households in 24 villages), this paper seeks to explain heterogeneity and change in property-rights regimes over time and across space.

Purpose Economic reforms in rural China have led to the emergence of land and labor markets. The development of rural land rental markets can improve agricultural productivity and equity by facilitating transfers of land to more productive farmers and facilitating the participation in the non-farm economy of less productive farmers. In contrast to the burgeoning development of off-farm labor markets, the development of rural land rental market has lagged. The purpose of this study is to analyze the factors affecting households’ entry and transaction intensity in rural land rental markets, especially the effects of land tenure and off-farm employment. Design/methodology/approach Based on a field survey data of 479 household in Henan Province in 2009, the authors used Cragg’s double hurdle model to identify the determinants for households’ land rental participation and its transaction amount. Findings Off-farm employment is one of main driving factor for household’s land rent-out decision. Tenure insecurity reduces both the propensity and the magnitude of rental market transactions. Land use certificates significantly contribute to participation in land-rental markets and the rental amount. Originality/value This paper treats household land rental market participation as a related two-step process, focusing on both land transfer and its transaction amount. This paper also builds on a broad view, including analysis on both demand and supply side of land rental market.
