While Ibn ʿArabī (d. 638/1240) continues to receive much attention within the academe as a preeminent Sufi philosopher, his jurisprudence, by contrast, rarely elicits the same attention, despite the prominent mention of the Sharīʿa throughout his many works. This paper provides an exhaustive overview of his sophisticated legal doctrine in terms of his legal methodology and substantive law. An analysis of his legal epistemology would situate him within the ‘scripturalist’ stream of legal theorists, commonly associated with the Zāhiri school. However, while Ibn Ḥazm (d. 456/1064) certainly influenced Ibn ʿArabī’s legal doctrine, the Shaykh’s jurisprudence remains markedly original in that it is ultimately rooted in an overarching metaphysical doctrine. This is evident in his personal reframing of ijtihād as a personal process of spiritual refinement, as opposed to a methodical process of ratiocination, which leads him to develop a distinctively personalist theory of legal pluralism that transcends the limitations of school conformity.

Jumhur ulama berpendapat bahwa walīmah al-‘urs hukumnya sunnah mu’akkad. Namun demikian, ada juga sebagian ulama memandang wajib, pendapat ini dipegang oleh Ibn Ḥazm al-Andalusī. Penelitian ini secara khusus menelaah pemikiran hukum Ibn Ḥazm al-Andalusī yang mengatakan hukum wajib melaksanakan walīmah al-‘urs. Dalam konteks ini, Ibn Ḥazm al-Andalusī cenderung memahami dalil-dalil hadis sebagai dasar hukum perintah wajib melaksanakan walīmah al-‘urs. Fokus penelitian ini adalah: Bagaimana pandangan Ibn Ḥazm tentang hukum melaksanakan walīmah al-‘urs?, dan Bagaimana dalil dan metode istinbāṭ yang digunakan Ibn Ḥazm dalam menetapkan hukum walīmah al-‘urs?. Dalam penelitian ini penulis mengunakan penelitian kepustakaan (library research). Dalam menganalisis data, penulis menggunakan metode kualitatif dengan menggunakan cara analisis normatif. Setelah melakukan analisa mendalam terhadap fokus penelitian, penulis dapat menyimpulkan menurut Ibn Ḥazm, pelaksanaan walīmah al-‘urs hukumnya wajib dan disesuaikan dengan kemampuan. Dalil yang digunakan Ibn Ḥazm mengacu pada tiga riwayat hadis. Pertama hadis qawliyyah riwayat Muslim dari Yaḥyā bin Yaḥyā al-Tamīmī terkait perintah Rasulullah SAW untuk melaksanakan walīmah al-‘urs walaupun hanya sekadar satu ekor kambing. Kemudian, kedua hadis fi’liyyah riwayat Muslim dari Abī Bakr bin Abī Syaibah dan riwayat al-Bukhārī dari Muḥammad bin Yūsuf terkait Rasulullah SAW melaksanakan walīmah al-‘urs. Terhadap pendapat dan dalil hukum yang digunakan Ibn Ḥazm, pola penalaran yang ia gunakan ialah cenderung pada metode istinbāṭ bayānī, yaitu melihat sisi kaidah kebahasaan pada lafaz “أَوْلِمْ” dalam matan hadis riwayat Muslim “أَوْلِمْ وَلَوْ بِشَاةٍ”. Lafaz tersebut menurut Ibn Ḥazm merupakan lafaz amar perintah yang mengandung indikasi hukum wajib. Selain itu, pola penalaran istinbāṭ bayānī juga terlihat pada saat Ibn Ḥazm memandang hadits fi’liyyah Rasul SAW harus didukung dengan petunjuk dalil qawliyyah, sebab perbuatan Rasulullah SAW melaksanakan walīmah al-‘urs tidak dapat dijadikan hujjah wajibnya walīmah al-‘urs, kecuali adanya petunjuk dalil hadis lain yang memerintahkannya. Pola penalaran semacam ini mengarah pada metode istinbāṭ bayānī.

The research’s aim is to present a thematic study of the prohibition of menstruating women to come inside the mosque and recite Al Qur’an. It is based on certain hadith with various Islamic histories.  The analysis of mufradat and the content of hadith are used to reveal its prohibition. The method used in this research was library research or documents with a Maudhu'iy (thematic) approach. The results of this research concluded that menstruating women and Junub people are not forbidden to come inside the mosque for any reasons as long as they can keep their menstrual blood was not scattered in the mosque. It was based on several hadith proposed by Ibn Hazm and Aisyah. The reasons given by Ibn Hazm are relevant to the conditions of the present age. While reciting al-Qur'an, there is no single valid hadith stated by Imam al-Bukhari. It can be assumed that menstruating women may recite Al Qur'an. If they are forbidden to recite Al Qur'an and do dhikr, then she will be far from Allah as quoted in the hadith from Aisyah as explained that the prophet will always remember Allah all times
