This article calls for an increased use of strategic litigation in the anti-trafficking field to ensure long-lasting systemic reforms. While generally, the prosecution of human trafficking or related severe forms of labour exploitation, like forced labour, is quite challenging and prosecutions and convictions lag seriously behind, it is argued that strategic litigation, meaning continuing legal action, aimed at achieving rights-related changes in law, policy, practice, and/or public awareness, can help to ensure that justice is delivered to victims, as several landmark cases also show. Efforts to counter human trafficking through strategic litigation by NGOs remain in their infancy, among others as they are resource-intensive and require access to experienced lawyers in high level courts. The author discusses some examples and dilemmas and identifies needs for NGOs to use strategic litigation more often as an effective tool to effectuate systemic change.

'Access to law' examines both personal and substantial conditions of access to the different phases of law creation and its legislative, executive and judicial manifestations. These conditions also include actual authority structures which affect threats to freedom and equality. The conference volume addresses access to legal and extrajudicial knowledge, private influence on legislation, the relationship between courts and legislatures, and access to the government and its offices. The volume discloses strategic litigation approaches and state actors’ attempts to escape from legal scrutiny.

Abstract The South African Constitution, particularly its Bill of Rights, is regarded as one of the most progressive in the world. The Ugandan Constitution, adopted around the same time as its South African counterpart, also has a Bill of Rights. Lawyers and advocacy groups in both countries have taken advantage of their constitutions to challenge the government to enforce several rights ranging from health care services, education, water and sanitation, to housing and social security, albeit at a lower scale and with less impact and significance in Uganda than South Africa. The purpose of this paper is to discuss and determine the constitutional impact of strategic litigation in South Africa and Uganda. The paper begins with a conceptual context of strategic litigation. The specific reasons for the choice of the two countries are highlighted before focusing, in a comparative way, on some relevant organizations and the various court decisions that have emanated from strategic litigation in both countries. The paper identifies similarities and differences between Ugandan and South African approaches to strategic litigation. Conclusions are then made after highlighting the comparative lessons that both countries can learn from each other, but also what other African states can learn from these two countries’ experiences.

Ausgehend von dem zwar unpräzisen, aber etablierten Begriff der Strategic Litigation beschreibt und reflektiert der Beitrag das entsprechende Phänomen und seine aktuelle Entwicklung in Deutschland aus einer die juristischen Teildisziplinen übergreifenden Perspektive. Er rezipiert dafür aus der internationalen Literatur, fokussiert aber auf die hiesige Praxis der Strategic Litigation, der er eine zunehmende Verbreitung, Bündelung und Professionalisierung attestiert. Zugleich werden Zielsetzungen, Deutungen und soziale Kontexte dieser Praxis behandelt, frühe und verwandte Erscheinungsformen identifiziert und auf diese Weise auch das Begriffsverständnis konturiert. Der Beitrag geht auf die noch wenig durchdrungenen Fragen der praktischen Wirksamkeit und Legitimität von Strategic Litigation ein und skizziert im Anschluss daran, wie sich diese Praxis rechtlich beeinflussen lässt. Nach einem Blick auf künftige Herausforderungen und mögliche Entwicklungslinien schließt der Beitrag mit einem Appell zu einer breiteren rechtswissenschaftlichen Befassung mit dem Thema.
