Feminists working to prevent and respond to campus sexual assault should encourage universities to adopt an intersectional public health approach that incorporates Restorative Justice. An intersectional framework responds to the ways that the general campus climate for students of color, LGBTQ students, foreign nationals, immigrants, and low-income students shapes experiences of sexual assault and help-seeking. An intersectional framework also addresses the risk that implicit bias will infect school investigations and hearings. Feminists should also encourage schools to reject “Crime Logic” thinking and the related belief that campus assaulters are irredeemable “predators.” The predator narrative is based in misapplied research and is contradicted by the results of more sophisticated longitudinal studies. Finally, feminists should encourage schools to adopt Restorative Justice (RJ) alternatives. An RJ approach supports victim healing and autonomy, encourages the student who caused harm to take responsibility for repairing the harm, and enables larger changes in campus culture.

Research finds that “problematic” victim behaviors—for example, alcohol consumption—influence sexual assault case outcomes. Questions remain, however, regarding officer perceptions of what constitutes a problematic victim and how these victims complicate case processing. Indeed, most case processing research has relied on quantitative methods and inquiry into officer attitudes has primarily relied on the use of vignettes. Using data from in-depth interviews with 52 Los Angeles Police Department sex crimes detectives, we examine attitudes toward problematic victims. Overall, we aim to determine whether rape culture beliefs and efforts to operate in a “downstream orientation” influence detective views regarding victims who have been deemed problematic.

This essay examines the use of restorative justice in sexual offending. Restorative forms of intervention have been used in cases of violent or sexual offending, from first-time and ‘acquaintance’ rape as well as young sexual abusers to high-risk sexual offenders in the form of circles of support and accountability. Such schemes are often presented as a counter to the failings of retributive forms of justice and are premised on Braithwaite’s notion of ‘reintegrative shaming’ that seeks to reintegrate offenders into the community. The essay sets out and seeks to counter arguments against using restorative justice for sex crimes. For the most part, restorative justice has not reached its potential as a full-fledged sentencing rationale and has not been used in more serious cases. The essay examines barriers to restorative justice in contemporary penal policy and highlights some of its controversial applications, including those related to clergy sexual abuse.

Scholars, advocates, and victims have repeatedly criticized the police treatment of sexual assault (SA) complainants. Apathetic attitudes and hostile behavior on the part of the police have likely resulted from socialization into a culture that condones the use of force and violence and blames SA victims for their victimization. Using data from in-depth semistructured interviews with 52 Los Angeles Police Department sex crimes detectives, we examine officer attitudes toward teenage complainants of SA. Notably, almost three fourths of the respondents ( n = 38; 73%) mentioned that teenagers lie about SA. Practical implications, theoretical advancements, and directions for future research are discussed.
