El aumento de los flujos migratorios en las últimas décadas ha hecho que conociéramos en nuestro país y en los de nuestro entorno la mutilación genital femenina, práctica perteneciente a las tradición cultural de algunos grupos de inmigrantes, que constituye una manifestación de violencia de género, un atentado a los derechos humanos de las mujeres y que lesiona bienes jurídicos fundamentales recogidos en la Constitución. La tolerancia y el respeto a la identidad cultural de los inmigrantes tiene como límite el respeto de los derechos fundamentales, por lo que no se pueden admitir como lícitas en nuestro país la mutilación de las mujeres inmigrantes, que en la mayoría de los casos son menores de edad. Desde hace tiempo a nivel mundial se lucha para eliminar estas prácticas. Nuestro país se ha unido a esta lucha y siguiendo las recomendaciones internacionales, ha incluido el delito de mutilación genital en el Código penal y en el principio de justicia universal, en virtud de mismo, los Tribunales españoles serán competentes para juzgar las mutilaciones genitales realizadas fuera de nuestro territorio si los responsables se encuentran en España.Increased migration in recent decades has made us to know in our country and in our environment female genital mutilation, a practice belonging to the cultural tradition of some immigrant groups, which are a manifestation of gender violence, a attack on the human rights of women and injured fundamental legal rights enshrined in the Constitution. Tolerance and respect for the cultural identity of immigrants is limited to the respect of fundamental rights and therefore can not be permitted in our country as lawful mutilation of immigrant women, who in most cases are lower of age. It has long worldwide are struggling to eliminate these practices. Our country has joined this struggle and following international recommendations, included the crime of female genital mutilation in the Criminal Code and the principle of universal justice, under it, the Spanish courts are competent to judge genital mutilation carried out our territory if those responsible are in Spain.

Despite being outlawed in many of the countries where it is the most prevalent, female genital mutilation (FGM) still persists. It is critical that innovative interventions be adopted in order to better address the cultural roots of this gender violence epidemic. The aim of this study is to explore the use of performing arts to fill this gap in effective preventative and treatment interventions. Due to the lack of data in this field, this study comprises of an extensive literature review. Existing programs were evaluated through thorough web searches, interviews of program leads, and analyses of the results. After reviewing existing evidence, it has been concluded that performing arts interventions provide positive outcomes in the field of FGM due to their ability to engage with cultural assumptions, incite empathy, and cross educational boundaries, all through community-connected approaches. Local outcomes were connected to government intervention in the recommendations to conclude that all governments should ban FGM, allocate public funds to the field of arts and health, and increase the validity of performance-based interventions through increased and improved research.

RESUMEN: Los cambios en la nueva concepción del Estado Democrático de Derecho que surgen a partir de la toma de conciencia de la existencia de determinados derechos que se consideran como fundamentales por la comunidad internacional, influyen de modo directo en el diseño de políticas públicas, de creación de normas jurídicas y en el modo de resolver los casos judiciales. Es así que se presenta a la Teoría Neoconstitucional como una nueva teoría del derecho que permite integrar los derechos con sus respectivas garantías, y que se ocupa tanto de las normas como de los principios y los valores de Derechos Humanos y de su internalización en los ordenamientos de los Estados, es decir, se ocupa del fenómeno de mundialización de estos derechos. Dentro de los derechos fundamentales encontramos los que poseen las mujeres en lo que concierne a vivir una vida libre de toda violencia en la que se respete su dignidad y autonomía de la voluntad, amén de que los índices de violencia contra ellas aumentan día a día en todos los países del mundo. De este modo los Estados deberán cumplimentar con las medidas de acciones positivas tendientes a garantizar el efectivo goce de los derechos reconocidos por los Pactos internacionales de Derechos Humanos.ABSTRACT: The changes in the new conception of the Democratic State of Law that arise from the awareness of the existence of certain rights that are considered fundamental by the international community, have a direct influence on the design of public policies, the creation of legal norms and how to solve judicial cases. This is how the Neoconstitutional Theory is presented as a new theory of law that allows integrating rights with their respective guarantees, and that deals with both the norms and the principles and values of Human Rights and their internalization in the legal systems. of the States, that is, deals with the phenomenon of globalization of these rights. Within the fundamental rights we find those that women possess in what concerns to live a life free of all violence in which their dignity and autonomy of the will is respected, in addition to that the indices of violence against them increase every day in all the countries of the world. Female circumcision is central to African traditional religion and entails transgression of fundamental rights. However, the rationale for female circumcision seems to be consistent in most African societies, and is based for the most part on myth, ignorance of biological and medical facts, religion, and culture. The thinking and argument in many communities is that the clitoris is perceived variously as repulsive, filthy, foul smelling, dangerous to the life of the emerging newborn, and hazardous to the health and potency of the husband. This study therefore is an attempt to respond to the thesis that despite the right to freedom of religion or belief, including its manifestations, the right of ethnic, religious, and linguistic groups to enjoy their culture, the religio-cultural ritual of female circumcision as a rite of passage in Africa is shrouded with some traditional practices that has reconfigured the moral basis of female circumcision.

Resultando evidentes las desigualdades por razónde sexo existentes en el ámbito del fenómeno religioso dentro yfuera de nuestras fronteras, se antoja sobradamente interesanteafrontar el desafío jurídico de estudiar, en el contexto de la diversidadreligiosa, el papel de la mujer y su posible discriminación o noen dicho ámbito en nuestra España del siglo xxi. Dentro de la inmensadimensión que abarca el referido fenómeno, nos centraremosen los conflictos en los que sean parte los intereses de la mujercuando se desarrollen en el ámbito de las principales confesionescon arraigo en nuestro país. El objetivo principal de este estudioha sido describir los más importantes conflictos acaecidos y en losque se observa discriminación de la mujer en el ámbito religioso, asaber, principalmente el debate suscitado en torno al porte del veloislámico, pero también otras posibles discriminaciones en el ámbitoreligioso: los delitos de odio por razón de género en el ámbitoreligioso, el acceso a los puestos de autoridad eclesiástica por partede las mujeres en las distintas confesiones religiosas, la mutilacióngenital femenina…, dejando palpable la necesaria exigencia deigualdad de género que consideramos debería existir en el ámbitode la diversidad religiosa. Finalmente, vamos a plantear en este estudioaquello que, a nuestro entender, puede ser exigible a los Estados,y más concretamente al Estado español, para garantizar launiversalidad de los derechos de las mujeres en el marco de las religiones.Being evident the inequalities by reason of sex existingin the scope of the religious phenomenon inside and outsideour borders, it seems very interesting to face the legal challenge ofstudying, in the context of religious diversity, the role of womenand their possible discrimination or not in this area in our Spain ofthe xxi Century. Within the immense dimension encompassed bythis phenomenon, we will focus on the conflicts in which the interestsof women are part when they develop within the scope of themain confessions rooted in our country. The main objective of thisstudy has been to describe the most important conflicts that haveoccurred and in which there is discrimination against women inthe religious sphere, namely, mainly the debate about the wearingof the Islamic headscarf, but also other possible discriminations inthe religious sphere: hate crimes on the grounds of gender in thereligious sphere, access to positions of ecclesiastical authority bywomen in different religious confessions, female genital mutilation..., leaving palpable the necessary requirement of equality of genderthat we believe should exist in the area of religious diversity. Finally,we will propose in this study that which, in our opinion, maybe required from the States, and more specifically from the SpanishState, to guarantee the universality of women’s rights withinthe framework of religions.
