Conserving indigenous knowledge (IK) has long been discussed in international fore for more than five decade. The core issues is there is unanimity among scholars, governments, indigenous peoples and local communities on whether and how issue of IK could be harmonise within intellectual property rights law framework particularly copyrights. This paper aims to highlight the issues of conserving indigenous knowledge since indigenous knowledge does not belong to one generation but all generations. Discussion will embark on from the perspective of intellectual property jurisprudence through the works of Henry Reynolds, James Tully and Will Kymlicka. The outcome of this paper demonstrates promising thought into the role of intergeneration justice in protecting indigenous peoples in Malaysia. It is the contention of this paper that perhaps such conditions could apply to traditional knowledge too in addressing the plight of indigenous peoples.

The role of Indigenous peoples and local communities (IPLCs) in sustainably using and managing natural resources is becoming broadly recognised within some international platforms (e.g., the UN Permanent Forum on Indigenous Issues and Intergovernmental Platform on Biodiversity and Ecosystem Services). However, the support for IPLCs to continue managing their land is either completely absent or scanty. This paper presents the value of only four ecosystem services, estimated at USD 1.16 trillion per year, that are delivered from IPLCs managed lands alone (excluding coastal, marine, and other resources). These four ecosystem services (ES), i.e., carbon sequestration, biocontrol, air, and water regulation offer offsite benefits to the wider regional and global populations yet without returns to the IPLCs themselves except for facing more climate and natural disaster-related challenges mainly caused by the actions of mainstream society. It further outlines key challenges and advocates for establishing stewardship mechanisms to promote and support IPLCs land management practices that will effectively help in protecting and preserving biodiversity, water, and other natural resources on Earth to sustain and enhance human well-being.

This article is about Indigenous peoples’ involvement in the Nagoya Protocol negotiations from 2006 to 2010, as well as in its implementation to stop biopiracy in order to protect Pachamama, Mother Earth, and to ensure our survival and the survival of coming generations. The Nagoya Protocol is an international instrument that was adopted in Nagoya, Japan in October 2010 by the Conference of Parties (COP 10) and ratified by 51 countries in Pyeongchang, South Korea in October 2014 at COP 12. This protocol governs access to genetic resources and the fair and equitable sharing of benefits arising from their utilization (access and benefit sharing [ABS]). It has several articles related to Indigenous peoples and traditional knowledge, as well as: The interrelation and inseparable nature between genetic resources and traditional knowledge; The diversity of circumstances surrounding traditional knowledge ownership, including by country; The identification of traditional knowledge owners; The declaration of Indigenous peoples' human rights; and The role of women in the biodiversity process. In addition, this protocol lays out obligations on access, specifically participation in equitable benefit sharing, the accomplishment of prior and informed consent, and the mutually agreed terms and elaboration of a national legal ABS framework with the participation of Indigenous peoples and local communities in order to have well-defined roles, responsibilities, and times of negotiations.

The Penan of Sarawak, East Malaysia, on the island of Borneo, are an indigenous community who have adapted to survive under the strictures and expectations of the Malaysian nation-state while proudly holding on to their traditions and identities. One such tradition is the practice of Penan storytelling (tosok), which plays a remarkably effective exogenous role in engaging the attention of everyone from state functionaries to visiting anthropologists while continuing to perform the endogenous function of reinforcing community bonds. The role of storytelling in mediating the relationships between indigenous peoples and the nation-state, which claims the territory they inhabit, has rarely been subjected to scholarly scrutiny. This article explores how Penan elders and community members have used and adapted their practice of storytelling to engage with the Malaysian state, civil society, and the public imagination, ensuring that Penan voices are heard on issues as varied as access to education, the predations of logging companies, and the existential questions of land tenure. In setting aside space for a Penan storyteller to speak in his own eloquent words, this article is itself a channel for Penan perspectives to be heard, an opportunity the Penan are not hesitant to use where available.

This study reviews the status of the legal recognition of the rights of Indigenous Peoples, local communities, and Afro-descendant Peoples to the carbon in their lands and territories across 31 countries in Africa, Asia, and Latin America. Together, these countries hold almost 70 percent of the world’s tropical forests and represent at least 62 percent of the total feasible natural climate solution potential, and thus the bulk of nature-based emissions reductions and carbon offset opportunities in tropical and subtropical forest countries.

The present study investigates the role of ecotourism as a potential catalyst for land sparing in Latin America, with a particular focus on indigenous and community-based ecotourism. The research question is investigated within a comprehensive empirical land sparing–agricultural expansion framework, which uses the Jevons paradox as its theoretical foundation. It also allows for environmental governance and includes several socioeconomic control variables. In doing so, a panel data set based on secondary data from institutional sources and comprising 10 Latin American countries for the period from 1995 to 2015 is employed, which resulted in 209 observations in total. Panel estimation results show that there is only moderate evidence of land sparing associated with ecotourism, when it occurs on indigenous peoples’ and local communities’ land. To achieve land sparing through ecotourism, titling land to indigenous peoples and local communities as stakeholders is therefore crucial, but this beneficial effect should not be overestimated.
