Interpreting Deliberative Democracy: Speech Acts, Strategic Action and Coercion

This chapter argues that deliberative democracy is morally desirable but not strictly a moral requirement by focusing on superdeliberators and superdeliberation. The superdeliberator is a close relative of the philosopher-citizen. Each corresponds to the two meanings of “deliberation” in democratic theory, as reasoned thought and reasoned talk. The chapter first describes four necessary conditions that make a democratic theory deliberative before presenting two claims for the supererogation of deliberation at the micro- and macrodemocratic level. It then considers the belief by deliberativists that citizens have a standing obligation to participate periodically in contestatory forums. It also rejects the notion that the quantity and diffusion of public speech acts envisaged by deliberative theory is a necessary property of a morally acceptable social order. Finally, it examines the bare moral obligations that attach to citizens' reasoning about politics.

Deliberative democracy has grown into an influential normative paradigm for political theory and reform programs alike, but doubts persist about its desirability in a world where strategic action and inequality are prevalent. This problem has spurred efforts to understand the empirical dynamics of power relations in institutionalized participation. This article argues that sociolegal scholarship has yet to join this turn to power but that doing so can help it to specify law’s causal and normative relevance in deliberative governance. This is because the legal environment within which actors interact affects causal mechanisms by distributing opportunities for the exercise of power between potential participants, actual participants, and participants and government. The utility of a power-distributional perspective is illustrated through a study of São Paulo’s health councils, one of the world’s largest experiments in deliberative governance. The study demonstrates that the councils’ trajectory and current functioning—including some of their normatively problematic aspects—cannot be understood without reference to legal arrangements. This article is meant as a building block for sociolegal scholarship to continue investigating deliberation.

This essay argues that the systemic turn in deliberative democracy has opened up avenues to think about disabled citizenship within discursive processes. I highlight the systemic turn’s recognition of the interdependence of individuals and institutions upon each other in a system as key to this project. This recognition has led to three transformations: (1) a more generous account of deliberative speech acts and behaviors; (2) recognition of the role of enclaves; and (3) incorporating the role of discursive representatives. These changes normalize the participation of cognitively disabled individuals and suggest institutional opportunities for more effective participation.

The food safety security (FSS) concept is perceived as an early warning system for minimizing food safety (FS) breaches, and it functions in conjunction with existing FS measures. Essentially, the function of FS and FSS measures can be visualized in two parts: (i) the FS preventive measures as actions taken at the stem level, and (ii) the FSS interventions as actions taken at the root level, to enhance the impact of the implemented safety steps. In practice, along with FS, FSS also draws its support from (i) legislative directives and regulatory measures for enforcing verifiable, timely, and effective compliance; (ii) measurement systems in place for sustained quality assurance; and (iii) shared responsibility to ensure cohesion among all the stakeholders namely, policy makers, regulators, food producers, processors and distributors, and consumers. However, the functional framework of FSS differs from that of FS by way of: (i) retooling the vulnerable segments of the preventive features of existing FS measures; (ii) fine-tuning response systems to efficiently preempt the FS breaches; (iii) building a long-term nutrient and toxicant surveillance network based on validated measurement systems functioning in real time; (iv) focusing on crisp, clear, and correct communication that resonates among all the stakeholders; and (v) developing inter-disciplinary human resources to meet ever-increasing FS challenges. Important determinants of FSS include: (i) strengthening international dialogue for refining regulatory reforms and addressing emerging risks; (ii) developing innovative and strategic action points for intervention {in addition to Hazard Analysis and Critical Control Points (HACCP) procedures]; and (iii) introducing additional science-based tools such as metrology-based measurement systems.

In today’s world of global wicked problems, constraints and imperatives imposed by an external and uncertain environment render strategic action a quite complex endeavour. Since the 1990s, within community initiatives and philanthropic projects, the construct of Theory of Change has been used to address such complexity. Theory of Change can be defined as the systematic and cumulative study of the links between the activities, outcomes, and context of an intervention. The area of focus for this paper is to explore whether Theory of Change can support more strategic approaches in design. In particular, the paper examines how Theory of Change was applied to DESIGNSCAPES - a project oriented, among other things, toward offering a supporting service for all those city actors interested in using design to develop urban innovation initiatives that tackle complex issues of broad concern.

Drawing on speech acts theory, this article discusses the illocutionary and perlocutionary forces of discursive practices with which certain academic circles seek to discredit the Saidian ‘Orientalism’ framework. Identifying the unusual value attached to Said as object of attachment or detachment, desirability and exceptionality, this analysis turns away from deliberations about ‘orientalism’ as a party in a battle of ideas, and studies common cautionary statements and other responses by peers as actions in the social (academic) world, that enculture and police expectations. Cautioning subjects about this framework, or conditioning its employment to preceding extensive pre-emptive complicating mitigations, in effect constructs this framework as undesirable and ‘risky’. While strong discursive reactions are not uncommon in academia, comparing them to treatments of less-controversial social theories reveals formulations, meanings and attentions which are arguably reserved for this ‘theory’. Conclusively, common dismissals, warnings and criticisms of Said and ‘Orientalism’ often exemplify Saidian claims, as they deploy the powerful advantage of enforcing hegemonic, and indeed Orientalist, views.
