La geopolítica siempre ha influido en el panorama energético global y, en particular, en el de los combustibles fósiles. El caso arquetípico es el de la crisis energética de los años setenta. No obstante, el contexto actual de tensiones energéticas y volatilidad de los mercados ha vuelto a poner sobre el tapete la relevancia de la geopolítica en el suministro y precio de los combustibles fósiles y, en particular, del gas. Un ejemplo de esto es el caso europeo, donde tanto Argelia como Rusia están privilegiando los gasoductos directos (Medgaz y Nord Stream), frente a aquellos que transitan por terceros países como Marruecos o Ucrania, por motivos e intereses que van más allá de lo económico.

Using publicly available information, the article examines the economic concepts, which underlie the arguments of the decision of Polish competition authority UOKiK in relation to the participants of the Nord Stream 2. It explains the interrelation between economic and legal concepts, which are to be applied to interpret the competitive impact of joint venture and probable theory of harm for infrastructure investments under competition law of European Union, including in comparison with Russian competition law. It has been demonstrated that the resolution of a consortium case should be based on the proof of two statements. The first statement implies that the joint venture is a firm (and therefore the creation of a joint venture is a deal leading to economic concentration). The second statement means that despite Gazprom adopted the commitments about decision of the European Commission and trends in the development of the European gas market, the possibility of price discrimination is retained. Discussion and contestation of the decision against PJSC Gazprom testify in favor of maintaining the relevance of institutional studies and studies of industry markets for resolving legal disputes arising from the application of competition law.


Significance Despite this, Biden indicated no change in the US position after a bilateral agreement with Germany effectively paved the way to completing the pipeline. Technically, Nord Stream 2 could begin partially operating in October. Impacts The recent spike in European gas prices to levels unseen since 2008 reinforces the case for Nord Stream 2's speedy completion. EU energy diversification, with a focus on renewables, poses long-term questions about the viability of both the Nord Stream pipelines. From October, Hungary will switch to Gazprom gas supplied via Serbia and Austria instead of through Ukrainian pipelines.

Significance The two sides have suspended tariffs arising from their dispute over subsidies to Airbus and Boeing, are working on an international deal on corporate taxation and have established a high-level council to discuss issues at the nexus of security, technology and trade. Impacts A major aim of closer transatlantic cooperation is better coordination of policies with respect to China. Closer transatlantic cooperation over China might soften US opposition to the Nord Stream 2 gas pipeline. It will be difficult for the US government to pass legislation concerning trade given the Democrats' precarious majority in both houses.

In 2021 in Ukraine as a result of several objective reasons prerequisites were formed for a serious internal political crisis. Problems related to the shortage of energy resources may become a catalyst for negative processes in the economy and politics which will most likely lead to early parliamentary elections. In the south-east of the country, the Ukrainian leadership is deliberately escalating the conflict, which may lead to the resumption of active hostilities in the region. On the outer contour, Kiev’s Western partners continued a military development of Ukrainian territory, although they are still in no hurry to grant Ukraine the status of a full member of NATO. There have also been no changes in the country's relations with the European Union. Fearing the undesirable consequences of the launch of the Nord Stream 2, Kiev continued to actively fight for the preservation of gas transit through its GTS.
