The article deals with the special procedure of UN human rights council in the first part where it discusses the origin and development of the special procedure and its nexus with UN Commission on Human Rights. Similarly, the article outlays the special procedure in Human Rights Council discusses its origin and development as well. The article also deals with the work and status of the special procedures experts and also discusses institution building process and review mandate. Then the article investigated the code of conduct that is to be followed by the special procedures mandate holder. After this the article looks into the merit and limitation of the special procedure. The article concludes with the analysis of the special procedure and its impact.

A relatively young body with roots in an older institution, the UN Human Rights Council has enjoyed some success and continued to serve important positive goals, many of them not easily realized. However, the system has always had significant internal and external limitations and continues to be beset by many problems – some more serious than others, and others more imagined than real. In our own time, the rise of right-wing populist regimes around the world, the continuities and discontinuities of the challenge that this sort of populism has posed to multilateralism in global governance, the economic crises that recently beset many parts of the world leading to serious resource constraints among many of the States that contribute the most to the UN’s budget, and the on-and-off withdrawals of the US (one of the most powerful States in the world) from the Council amidst charges of selectivity, appear to have combined to produce heightened crisis within and about that body. What to do? Informed by the cross-fertilization of the author’s academic thought and practical experience at the UN, the article offers an analysis of the Council’s attainments (including its embrace of a broader and more inclusive agenda, upr reduction of selectivity, the reform of its system of appointing special procedure mandate holders, increase in the number of standing invitations issued by States to such mandate holders, and establishment of an effective sids/ldcs fund); discusses the problems that presently confront the Council (many of which have already been referred to above); and works out in some detail some of the ways in which these difficulties can be effectively ameliorated so as to enhance the Council’s performance in the near- to medium-term future.

This chapter assesses the Human Rights Council Advisory Committee, which was created under the Council’s Institution-building resolution with the aim of providing expert advice to the Council. Indeed, the idea behind its creation was that this body would analyse issues and problems at the Council’s request, provide expert advice, and make recommendations to the Council. The Committee’s focus is mainly on studies and research-based advice and it is designed to be implementation-oriented. As a result, its margin of manoeuvre and scope of advice are limited to themes pertaining to the Council’s mandate and choice. Since its inception, the Committee has developed a practice of suggesting topics to the Human Rights Council by way of research proposals. The Council has acted upon some of the themes included in these proposals by requesting the Committee to conduct relevant studies.

This article provides an assessment of the replacement of the UN Commission on Human Rights by the Human Rights Council, with a view to ascertaining whether the human rights architecture of the United Nations is now in better or worse shape. Institutionally, it is unique in that an international organ is dismantled and replaced by a new one for the sake of achieving greater effectiveness. What are the chances for success? For a proper assessment, the article first examines the status, functioning, and falling into disgrace of the UN Commission on Human Rights and, second, reviews the establishment of the new Human Rights Council as part of the UN reform process and identifies the new features of the Council compared with the previous Commission. Third, it discusses the work of the Council in its first year, in particular the extensive June 2007 decision on institution building of the UN Human Rights Council. The article concludes that the Council had a far from fresh and easy start, but that its establishment and functioning so far are not a radical departure from the acquis of the UN human rights regime. The first years of the Council are crucial for solid institution building and functioning credibly in an action-oriented way. The first members on the Council bear the heavy responsibility of seizing this historic opportunity.

SUMMARY Special procedure mechanisms form an important aspect of the human rights architecture of the African Commission. Although introduced gradually, these mechanisms have grown in both size and scope. This article considers the overall nature, scope and standard operating procedures of the African Commission's special procedure mechanisms in light of development and evolution by reference to its composition; selection and appointment ofmandate holders, code of conduct of mandate holders (that is, independence and conflict of interest), working modalities, immunities and privileges and procedure. It also identifies and analyses possible areas of reform in this system. Key words: African Union; African Commission; human rights; special procedure mechanisms; standard operating procedures
