REGISTRATION SYSTEM OF PROPERTY RIGHTS IN FRANCE (EXPERIENCE ANALYSIS)

The article deals with the questions of French law and the recent French judicial practice concerning the type of the registration system of property rights and the nature of the list of property rights. The author briefly reveals the basic essence of the two main types of registration systems of property rights in Europe — the French model and the German model. The author considers the idea of creating in France the new property rights by the efforts of law enforcers and the will of turnover participants and without stipulation of these new rights in the law. Then the author analyzes the arguments of the supporters of open and closed list (numerus clausus) of limited property rights. The author comes to the conclusion that sequential withdrawal of the French law from the principle of numerus clausus. On the basis of the one of judicial decisions of the Cassation Court, which became a continuation of the concept of property right reform, laid down and formed in France in 2007, the author shows that the French law prefers the open list of limited property rights or the transitional mixed nature of the list of limited property rights, which can recognize the new limited property rights created by the entities, and limited property rights already enshrined in law. The author shows and proves, using the example of French and German law that the registration system of property rights based on the “principle of inclusion”, and the registration system of property rights based on transcription-inscriptional approach can affect the nature of the list of property rights — it can be open or closed.

A Case Study on Coal Industry of Shanxi Province in China: Empirical Analyses of Holding Power of the Resource-Based Region-Leading Industry over Regional Employment

The paper made unary linear regression and structure deviation degree analyses with the data of Shanxi province in China from 1992 to 2010. The results show that when the coal output increases by 1% , the employment will increase by 1.202%. And the structure deviation degree in the coal industry fell from-0.11 to-0.56 between 1992 and 2001, then it aggrandized to - 0.15 in 2010. Which presented a note of discord surfaced during industrial structure and employment structure adjusting in Shanxi province. This suggests that there are the disguised unemployment within the coal industry. So this paper emphasizes that the government should implement the coal property right reform policy, and simultaneously develop effective measures to guide the workers to flow from the coal industry to the other secondary industries or the third industry.

Prediction and Analysis of Ecological Effects of Property Rights Reform in State-Owned Forest Based on GM (1, 1)

This paper is base on the 5 pilot Board‘s management data from 2002 to 2010 when the property right reform of state-owned forest were carried out, use the characteristic that the gray model can solve the uncertainty relation of various factors within the system to predict the ecological effects of reform in the period 2011 to 2015. Model prediction accuracy is better, the results show that: the ecological evaluation of the reform--new forest area and tending forest area will decrease while survival rate will increase significantly in the future.
