En esta encuesta un grupo de profesores de Derecho Constitucional contestan un conjunto de preguntas sobre el concepto de nación, el papel que ha desempeñado tal concepto en el desarrollo histórico del constitucionalismo y en el desarrollo de los movimientos nacionalistas, y la relación actual que mantiene con la idea de constitución; sobre el significado del término «nación» en la constitución española, y el del término «nacionalidades»; y, finalmente, sobre la idea de supranacionalidad que define el proceso de integración europea y su relación con el concepto de nación.In this academic survey a group of Constitutional Law Professors answer some questions about the concept of nation, its role in the historical evolution of constitutionalism and of nationalist movements, and its relation nowadays with the idea of constitution; about the meaning of the term «nation» in the Spanish constitution and of the term «nationalities»; and finally about the idea of supranationality that defines the European integration process and its relationship with the concept of nation.

European integration has forced constitutional law scholars to abandon the perspective of methodological nationalism. Prior to the emergence of the interpretative problems raised by the intersection of domestic and European law, the dominant legal paradigm conceived of “constitution” and “state” as two inseparable terms. With the intensification of European integration and economic globalization, many different constitutionalist interpretations have emerged which all share a belief in the State's loss of centrality, such as post-, supra- and transnational constitutionalism, constitutionalism without the state and multilevel constitutionalism.

A problematic ‘German constant’ can be observed in the Federal Constitutional Court: It is the ‘Staat’ (state) as a sovereign political entity. And it is the ‘Volk’ (people) as a homogeneous community. The Constitutional Court’s political theory—so the thesis goes—‘oscillates’ between a liberal and pluralistic conception of citizens, constitution and society and a national and identitarian form of statism. In this book, this is exemplified by: the theories of constitution and democracy that are represented, fundamental rights in relation to domestic security, European integration, foreign policy and the emergency constitutional law as a result of 9/11 and the coronavirus pandemic

ABSTRACT This paper discusses the problems and dangers of proceeding with European integration without facing a transparent constitutional debate. The crucial issue demanding clarity is whether the current integration in the form of the EU shall be seen within the framework and concepts of public international law or within those of constitutional law. The authors argue that more intensive integration cannot be achieved on the basis of undermining rule of law and democracy by vacillating between different international law or constitutional law models of proceeding without taking any clear standpoint.

The article is devoted to the issue of the concept of «constitutional and legal mechanism for ensuring the right to transplantation in Ukraine». The author’s definition of the concept «constitutional and legal mechanism for ensuring the right to transplantation in Ukraine» is formulated. Some elements of the constitutional and legal mechanism for ensuring the right to transplantation in Ukraine are determined.In the process of development of Ukraine as a democratic and legal state, European integration of Ukraine, scientific and technological progress, evolution of the fourth generation of human rights, development of medicine, development of transplantation in Ukraine, research on the defence of the constitutional and legal mechanism of ensuring the right to transplantation in Ukraine.The right to transplantation belongs to the fourth generation of human rights, which has been actively developing in recent years.The issue of ensuring the right to transplantation in Ukraine is an important element of the constitutional law of Ukraine.Ensuring the right to transplantation in Ukraine is an integral part of a single integrated human rights system in Ukraine.The constitutional and legal mechanism for ensuring the right to transplantation in Ukraine is a set of norms and principles of law on transplantation in Ukraine, as well as the system of authorized entities and their activities in the field of realisation of the right to transplantation in Ukraine, its guarantee and protection. The main elements of the constitutional and legal mechanism for ensuring the right to transplantation in Ukraine are:1. Realization of the right to transplantation in Ukraine.2. Protection of the right to transplantation in Ukraine.3. Guarantees of the right to transplantation in Ukraine.The constitutional and legal mechanism for ensuring the right to transplantation in Ukraine is an integral part of a single integrated system of the constitutional and legal mechanism for ensuring human rights in Ukraine.
