Mediante uma metodologia dedutiva, por meio de pesquisa bibliográfica especialmente doutrinária em documentos e obras desenvolvidos no Brasil e no exterior, objetiva-se analisar os Direitos da Personalidade a partir do pensamento contemporâneo de Wittgenstein, no viés de sua obra Investigações Filosóficas, e do existencialismo de Sartre. Para tanto, analisa-se os pensamentos de Sartre e de Wittgenstein em face dos Direitos da Personalidade. Posteriormente, aborda-se a concepção de linguagem privada em face dos Direitos Subjetivos da Personalidade. Por fim, conclui-se pela possibilidade de se adotar uma perspectiva reflexiva dos Direitos da Personalidade na contemporaneidade, por uma hermenêutica que assuma o Direito na sua impossibilidade de alcance e controle direto da linguagem privada dos sujeitos regulados.

The paper discusses the history and the function of the Roman actio funeraria. It is argued that the claim for reimbursement of the funeral of another person is historically older than the recognition of negotiorum gestio at large and can be seen as a precursor of the actio negotiorum gestorum.

Looking back, in December 2020, at the year since Boris Johnson’s Conservatives were swept back into government with a huge majority, the author identifies a raft of new laws, Home Office measures and government proposals in the fields of policing, crime, and immigration and asylum which embody long-held rightwing projects. Coming on top of already discriminatory practices, these include restrictions on the fundamental right of peaceful protest and freedom from invasive and racist policing, the subjection of migrants and asylum seekers to dangerous and inhumane conditions and the removal of legal protections for asylum seekers. Simultaneously, Bills going through parliament restrict or remove altogether the legal accountability of state actors, including soldiers on overseas operations and police informants, for crimes including torture and murder. Citizens’ recourse to the courts to challenge unlawful ministerial decisions is also under threat.

The thriller “Split” by M. Night Shyamalan showed a glimpse into the multiple personalities of the antagonist in the film. While many elements were added for intense suspense, the existence of such a disorder was factual. Dissociative Identity Disorder is defined by the American Psychiatric Association as a “psychological illness with 2 or more distinct identities, each accompanied by changes in behavior, memory, and thinking” (American Psychiatric Association). In a legal setting, the actions of the patients with DID have numerous ramifications. This paper aims to illustrate how the accountability of DID patients during a crime should be assessed. To find out how DID patients could be held accountable, we analyzed the disorder by researching the transformations in the brain, identified its origins, and explored the consequences in a judicial milieu. After conducting this research, we identified the solution that could be seamlessly embedded into our current society and benefit the patient as well as the courts. Through the analysis of the psychological disorder with a social lens, we evaluated that the jury and the public should be made more aware of the disorder and the court should not automatically assume innocence based on just the Insanity Defense. This plan is the best course of action for patients and the court systems and also aims to adapt societal thought to be more aware of DID’s difficulties.
