With the adoption of the Warsaw International Mechanism in 2013, the international community recognised that anthropogenic climate change will result in a range of adverse effects despite policies of mitigation and adaptation. Addressing these climatic ‘losses and damages’ is now a key dimension of international climate change negotiations. This article presents a normative framework for thinking about loss and damage designed to inform, and give meaning to, these negotiations. It argues that policies addressing loss and damage, particularly those targeting developing countries, should respect norms of compensatory justice which aim to make victims of unwarranted climatic disruptions ‘whole again’. The article develops a typology of different kinds of climate change disruption and uses it to (1) explain the differences between ‘losses’ and ‘damages’, (2) assign priorities among compensatory measures seeking to address loss and damage and (3) explore a range of equitable responses to loss and damage.

Climate change is a growing challenge to socio-economic development and sustainable environmental management worldwide. Developing countries with low adaptive capacity and high vulnerability to the phenomena are affected severely. This study assessed the climate change situation in a developing country, its effects on the water sector and adaptive responses to improve climate change resilience using Kenya as a case study. Findings showed that Kenya is experiencing temperature and rainfall rises currently, and future projections showed an even worse situation. Climate variability and change however differed based on time and space. Highlighted effects on the water sector included fluctuations in its quantities and deterioration of its quality. Adaptive responses such as infrastructural modifications of water body environments, forecasting using models to predict climate change uncertainties and disseminating early warnings are discussed. Their success relies on strong policy and institutions to steer their implementation in Kenya.

The topic of loss and damage in the context of climate change has gained increasing importance in the UNFCCC climate change talks in recent years. The Warsaw International Mechanism for Loss and Damage was established after two years of deliberations by the Conference of the Parties (COP) 19 in 2013. It is supposed to be the main vehicle under the United Nations Framework Convention on Climate Change (UNFCCC) to promote the implementation of approaches to address loss and damage associated with climate change impacts in developing countries that are particularly vulnerable to the adverse effects of climate change in a comprehensive integrated and coherent manner.


Subject Prospects for global climate policy in 2016. Significance Collective efforts to respond to climate change, as in previous years, will prove a source of domestic and international political controversy, particularly as vulnerable states cope with climate-induced loss and damage in a post-COP21 global climate regime. Pledges made by countries themselves at the COP21 summit -- both for emission reductions and for financial contributions to support developing countries -- will draw international scrutiny to avoid backsliding or double-counting.

AbstractThree sets of social institutions deal with catastrophic risk: government regulation through rule making, the market, and civil liability. Climate disasters expose the limitations of all of these social institutions and often result in extensive uncompensated losses, particularly in developing countries. The author proposes the establishment of a fossil fuel-funded Climate Disaster Response Fund to compensate victims for the ‘residual’ risk of climate disasters in developing countries that are particularly vulnerable to the impacts of climate change. This Fund, established under the UNFCCC’s Warsaw International Mechanism for Loss and Damage Associated with Climate Change Impacts, would comprise levies placed on the world’s top 200 fossil fuel companies. This proposal is modelled on various domestic and international funds which have been established to overcome the difficulties posed by tort law and which require companies to pay for the hazardous consequences of their activities and products. Precedents include funds to compensate for the damage caused by toxic chemicals, oil pollution spills, asbestos and nuclear accidents.

The issue of loss and damage has historically been politically contentious, with developed countries being afraid of being held responsible, and developing countries demanding some form of compensation for being disproportionately impacted by climate change-induced loss and damage. After much debate between developed and developing countries, the Paris Agreement took the middle road between the varying outcomes envisioned by developed and developing countries. The Agreement recognised the most vital demands of the developing countries to incorporate loss and damage as an independent pillar of the UNFCCC process and made the Warsaw International Mechanism permanent. Considering the discomfort among the developed block, the language of the Agreement was general and non-binding in character, overtly excluding the possibility of liability or compensation under loss and damage, which many have been described as a failure for vulnerable countries. Thus, the major challenge for the COP22 will be to expedite the discussion around financing and legal responsibility for loss and damage. This article discusses the road towards the Paris Agreement in light of the history of negotiations on loss and damage under the UNFCCC and aims to understand how it will impact the future of loss and damage.

AbstractThe impact of climate change has emerged as a major threat to sustainable development and poverty reduction efforts in many less developed countries, in particular in the least developed countries (LDCs) such as the countries in the African region and Small Island States. New technologies are necessary for the stabilization and reduction of atmospheric greenhouse gases and to enhance the capacity of poor countries to respond to shifts in resource endowments that are expected to accompany climate change. Therefore, technology transfer, particularly in the case of access to environmentally sound technologies (ESTs) is widely seen as an integral part of climate change resilience. Concerted efforts will be required for the development, deployment and transfer of ESTs to reduce vulnerability and increase resilience to the risks of climate change. Thus, development and transfer of ESTs has emerged as a fundamental building block in the crafting of a post-Kyoto 2012 global regime for climate change resilience. In this context, the role of intellectual property rights (IPRs) has been the subject of increased attention in the climate change discussions since the Bali conference of the United Nations Framework Convention on Climate Change (UNFCCC) in 2007. Different conflicting views and positions have emerged pointing to the role of IPRs in either facilitating or hindering the transfer of ESTs. The dissemination of ESTs from developed countries to developing countries and LDCs is a very complicated process often simplified by the argument that patent waiver for ESTs or allowing copying with weak intellectual property rights will help the developing countries and LDCs to better cope with the climate change problems. This article tries to examine the relationship between the IPRs (with special reference to patent system) and the resilience discourse with a starting point in the terms of social and ecological resilience.
