AbstractThe traditional freedoms of the high seas, set out in Article 87 of the 1982 United Nations Law of the Sea Convention, are now overlaid with a network of conventional international law provisions which seek to regulate a wide range of criminal activity, the taking of resources and environmental despoliation occurring on the high seas. Many of these regimes impose enforcement obligations on states parties but contain scant detail as to the practical mechanisms for enforcement. The high seas as an arena for maritime law enforcement presents new challenges for navies charged with implementing co-operative regimes. The development of uniform enforcement procedures and an equitable division of enforcement responsibility among regional navies or regional maritime security forces is essential if high seas regimes are to be implemented effectively. This article identifies some of the jurisdictional issues which can arise for navies or maritime security forces tasked with enforcing multilateral regimes beyond national jurisdiction.

Fokus pada analisa perangkat hukum, buku ini menggunakan pendekatan historis untuk memahami proses, diskursi tentang keberlanjutan (continuity) dan perubahan kepentingan negara di laut. Meski buku ini seakan melegitimasi dominasi perspektif negara dalam pendefinisian keamanan seperti yang dikatakan oleh Michael Reisman dalam kata pengantarnya, tetapi penulis, Natalie Klein, berhasil meyakinkan pentingnya pendekatan konstruktivisme dalam memformulasi pertanyaan riset dan menghadirkan analisa kritis.Ulasan buku ini akan dipaparkan dalam tiga bagian. Pertama, tentang pendekatan penulis dalam memetakan permasalahan maritim dan pengaturannya oleh negara. Kedua, mengulas struktur paparan di buku ini yang menggunakan pendekatan tematik. Bagian terakhir membahas kritik dan relevansi buku ini dengan kondisi di Indonesia, termasuk saran yang berkaitan dengan agenda lanjutan bagi diskursi dan riset keamanan maritim dan hukum laut.

This chapter assesses maritime security under the 1982 UN Nations Convention on the Law of the Sea (LOSC). It discusses critical issues in contemporary maritime security, highlighting ongoing boundary disputes, transnational crime, and intelligence gathering. It considers the question of what the future may hold for maritime security. It suggests that maritime security will likely remain of fundamental concern and continue to influence legal developments, but perhaps only to the extent that national interests can be asserted and accepted as shared interests.

<p><em>The Indonesian waters is for world seaborne trade, military and naval movement, and other maritime interests. So it has a strategic value for maintaining economic security, peace, and stability in the region. Indonesia has the responsibility to address the challenges presented by activities conducted in its waters, such as marine pollution, depletion of marine resources and criminal activities at sea. These challenges also arise out of the fact that there are only a few provisions in the United Nations Law of the Sea Convention which regulate the obligations of ships or user states to share the burden faced by states which possess sea lanes of communication. The purpose of this paper is to provide an overview of maritime security challenges within Indonesia in light of its obligations to ensure safety of navigation and security. A number of recommendations are brought up to show efforts have been made by Indonesia in maintaining the safety and security in its waters in the light of defense and naval diplomacy.</em></p><p> </p><p><strong><em>Key</em></strong><strong><em>words</em></strong><em>: maritime safety and security, Indonesian waters, cooperation, diplomacy</em><em></em></p>
