This paper considers the experience of the implementation of the Directive 2007/2/EC of the European Parliament and of the Council of 14 March 2007 establishing an Infrastructure for Spatial Information in the European Community (INSPIRE) as a case study of qualitative monitoring in building information infrastructures. It considers the nature of information infrastructures and possible approaches to qualitative monitoring in situations of this kind and describes the outcomes of two rounds of qualitative country reports prepared by the European Union national Member States in 2010 and 2013. The findings of the analysis highlight the great diversity of approaches developed by the participating countries and the complexity of the tasks involved as well as pointing to a number of areas of potential research on the implementation of information infrastructures.

The European Commission publishes a yearly “Report on the Monitoring of the Application of Community Law in the Member States of the European Union”. The 2005 edition was reviewed by a member of the Parliament, namely Monica Frassoni, from Italy (Greens/EFA-IT). Her report has recently been adopted by a noteworthy resolution of the European Parliament. The resolution points out both the structural problems of enforcing European Community law and the disputable approach of the Commission during the last few years. The European Parliament recognises that European Community law is not being applied consistently. The Members of the European Parliament (MEPs) refer to the annual report of the Commission in which the infringement proceedings initiated by the Commission are listed. This report illustrates that the number of detected infringements decreased from 2709 (in 2003) to 2653 (in 2005). This drop by 56 infringements seems at first sight not to be significant. But this reported decrease of procedures happened despite the fact that the European Union increased the number of Member States from 15 to 25 in 2004. Against this background, the lower level in 2005 is indeed questionable. Basically, the enlargement of the European Union was expected to cause a significant increase of infringement procedures against the Member States. This applies in particular to new Member States whose legal systems had been – in terms of compliance with European law – divergent from those in the other Member States.

The Covid-19 pandemic put a heavy burden on member states in the European Union. To govern the pandemic, having access to reliable geo-information is key for monitoring the spatial distribution of the outbreak over time. This study aims to analyze the role of spatio-temporal information in governing the pandemic in the European Union and its member states. The European Nomenclature of Territorial Units for Statistics (NUTS) system and selected national dashboards from member states were assessed to analyze which spatio-temporal information was used, how the information was visualized and whether this changed over the course of the pandemic. Initially, member states focused on their own jurisdiction by creating national dashboards to monitor the pandemic. Information between member states was not aligned. Producing reliable data and timeliness reporting was problematic, just like selecting indictors to monitor the spatial distribution and intensity of the outbreak. Over the course of the pandemic, with more knowledge about the virus and its characteristics, interventions of member states to govern the outbreak were better aligned at the European level. However, further integration and alignment of public health data, statistical data and spatio-temporal data could provide even better information for governments and actors involved in managing the outbreak, both at national and supra-national level. The Infrastructure for Spatial Information in Europe (INSPIRE) initiative and the NUTS system provide a framework to guide future integration and extension of existing systems.

Abstract In the central part of the European Union soybean, lupin and camelina are minor agricultural crops. The paper presents analysis of plant protection products availability for those crops in Austria, Belgium, Czech Republic, Germany, Holland, Hungary, Poland and Slovakia. Data from year 2019 show that availability of products is generally insufficient. For camelina in some countries, there are no chemical products available whatsoever. For lupin and soybean, there are not always products available to control some pest groups. However, the products on the market differ significantly among the member states. The results show that in protection of soybean, lupin and camelina, no single active substance is registered for the same crop in all the analysed member states. In very numerous cases, active substance is registered in one out of eight analysed member states only.

This article aims to provide a general overview of the regime of claims for private damages caused by breaches of competition law. The possibility for private damages claims existed even prior the adoption of the Directive 2014/104/EU of the European Parliament and of the Council of 26 November 2014 on certain rules governing actions for damages under national law for infringements of the competition law provisions of the Member States and of the European Union. Nevertheless, these claims were not popular among the business, even when the Commission for Protection of competition established breaches and imposed sanctions for breach of competition. With the transposition of the directive in the Bulgarian Competition Protection Act, an increased interest towards private damages claims is expected.

The decision on Britain’s secession from the European Union, taken by the British Parliament and agreed by London and Brussels, divided the Union history into “before” and “after”. Not only will the remaining member states have to “digest” the political, commercial, economic and mental consequences of parting with one of the largest partners. They will also have to create a substantially new algorithm for the functioning of United Europe. On this path, the EU is confronted with many geopolitical and geo-economic challenges, which should be answered by the new leaders of the European Commission, European Council, and European Parliament.

Article 229a EC Without prejudice to the other provisions of the Treaties, the Council, acting unanimously in accordance with a special legislative procedure and after consulting the European Parliament, may adopt provisions to confer jurisdiction, to the extent that it shall determine, on the Court of Justice of the European Union in disputes relating to the application of acts adopted on the basis of the Treaties which create European intellectual property rights. The aims of this chapter are threefold. It first briefly considers the events that have led to the creation of the European Community (EC) and the European Union (EU). Secondly, it introduces the reader to the principal institutions of the Union: the European Council; the Council of Ministers; the European Commission; the European Parliament; and the Court of Justice of the EU and General Court. The nature and functions of each of these bodies is considered. Thirdly, the chapter indicates, where appropriate, the nature of the institutional reforms which have occurred following the ratification of the Lisbon Treaty by the member states.

<p>The securitisation market worth trillions of dollars collapsed during the financial crisis of 2007–2009 and for many years its volume remained quite low in the European Union, i.a. due to lack of confidence in securitisation products. The purpose of this article is to draw attention to simple, transparent and standardised securitisation (STS securitisation), almost unnoticed in Polish doctrine, being a specific type of securitisation that has appeared lately and develops in the European Union, including Poland, as a way to revive the securitisation. In the course of considerations, after a brief presentation of securitisation, its development and collapse, attention is turned to the Regulation (EU) 2017/2402 of the European Parliament and of the Council of 12 December 2017 laying down a general framework for securitisation and creating a specific framework for simple, transparent and standardised securitisation, and amending Directives 2009/65/EC, 2009/138/EC and 2011/61/EU and Regulations (EC) no. 1060/2009 and (EU) no. 648/2012 (OJ EU L 347/35) and the premises it contains that must be met so that the securitisation could be designated as “STS” or “simple, transparent and standardised”. The remarks are especially focused on requirements of due diligence, transparency, risk-retention, simplicity and standardisation. The article ends with conclusions on the effectiveness of the adopted solutions in the economic sphere as well as with respect to the unification of securitisation law in the Member States and the restoration of credibility for securitisation in the European Union.</p>

Regulations for Supply Security and in Emergency Situations Before and After the Lisbon Treaty Entry into Force Exemplified by Supply with Natural GasThe text presents selected aspects of the issue of the provision of energy supplies security in the European Union illustrated by the example gas supply before and after the entry into force of the Lisbon Treaty. The legal frameworks oriented toward provision of gas supplies security as well as proper functioning of internal market gas in case of disruptions in gas supplies in the European Community/European Union has been discussed in the text. Among the legal acts described in the text are: Council Directive 2004/67/EC of 26 April 2004, Regulation (EU) No 994/2010 of the European Parliament and of the Council of 20 October 2010, Regulation (EU) 2017/1938 of the European Parliament and of the Council of 25 October 2017. In order to provide energy supplies security in case of disruptions in supplies the secondary legislation enhances capabilities of transport, storage and reacting.
