From ignorance to knowledge: Sexual consent and queer stories

The problem of sexual assault has received increasing public attention over the last few years, with an increasing focus on the concept of sexual consent to solve the problem. Education efforts focus on teaching people what consent is and how to explicitly communicate about sex, constructing consent as a knowledge problem. Using the stories of queer adults, this study calls for the development of an epistemology of sexual consent. I argue that the current research and scholarship fail to recognise existing knowledge about sexual consent, relegating sexual consent to an epistemology of ignorance. Queer participants in this study demonstrated sophisticated knowledge of sexual consent through their talk on the role of verbal consent cues and articulating how they “tune in” to their partners during sex. Within their talk, verbal consent was sometimes viewed as essential to consent, while at times was not necessary, and at other times was not enough to understand a partner's sexual consent. Importantly, they described deep knowledge about partners’ comfort, discomfort or hesitation through “tuning in”. Developing an epistemology of sexual consent requires recognising and valuing what participants tell us about what they know about their partners’ willingness to engage in sex.

The presence or absence of sexual consent distinguishes between sexual contact that is sexual assault and sex that is not assault. While temporality is an implicit focus in studies of sexual consent, it has received relatively little attention as an object of analysis. Drawing on in-depth ethnographic research conducted as part of a mixed methods study on sexual health and sexual assault among college students, this article examines the role of time in sexual consent. Specifically, we attend to how socially- and discursively-patterned experiences of time influence college students' capacity to grant or withhold consent. We identify three important temporalities. “Calendar time” refers to how events throughout the year influence the expectation of sexual contact and the negotiation of sexual consent. “Relationship time” refers to how the temporal dimensions of a sexual relationship impact how consent is navigated. Finally, “sexual time” pushes us to think of sex itself as a temporal process that locates consent at different points in time: before, during, and after a single sexual encounter. We conclude by outlining how time-based approaches to sexual consent may contribute to more effective sexual violence prevention initiatives.

Posttraumatic stress disorder (PTSD) is associated with a wide range of risky behaviors (e.g., substance use and risky sexual behaviors); however, few studies have examined mechanisms that may underlie risky behaviors in this population. The present study utilized a prospective experimental design to examine the effects of emotion dysregulation and impulsivity on risky behaviors across time. Thirty women with sexual assault–related PTSD were randomly assigned to receive emotion modulation (EM), impulsivity reduction (IR), or healthy living (HL; comparison condition) skills trainings. Participants completed measures of emotion dysregulation, impulsivity, and risky behaviors pre-manipulation and 1-month post-manipulation. Participants in the EM and IR conditions reported a significant reduction in risky behaviors from pre- to post-manipulation relative to the HL condition. Changes in emotion dysregulation from pre- to post-manipulation fully accounted for reductions in risky behaviors over time. Results provide preliminary experimental support for the role of emotion dysregulation in risky behaviors.

AbstractThis article examines public debates on the legitimacy of banking profits in the 2008 credit crunch. A content analysis of 957 newspaper articles published in Germany and the UK in the early weeks after the Lehman Brothers collapse examines critical statements directed at illegitimate forms of financial profit in order to identify the cultural legitimacy of financial capitalism. The conceptual framework provided by the French sociology of justification points to the role of shared orders of value as a normative reference for public discourses. In both national debates, four important boundaries for legitimate profits were drawn that concerned the problems of ownership, risk-management capacities of traders, fraudulent client relations, and speculative gambling. The meaning of this classical moral criticism of banks was transformed in the context of the 2008 crisis: a line between “normal” and “excessive” financial profits was drawn, defining an area of legitimate profit-seeking that hewed to the basic assumptions of the market model. Economic theory was used as a scheme of public economic morality. The seemingly harsh critical debate effectively reproduced a legitimate image of a functioning financial market, deflecting public attention away from the structural ambivalences of financial profit-seeking and granting legitimacy to the institutional status quo of financial capitalism.

This article examines the operation of “reasonable steps” as a statutory standard for analysis of the availability of the defence of belief in consent in sexual assault cases and concludes that application of section 273.2(b) of the Criminal Code, as presently worded, often undermines the legal validity and correctness of decisions about whether the accused acted with mens rea, a guilty, blameworthy state of mind. When the conduct of an accused who is alleged to have made a mistake about whether a complainant communicated consent is assessed by the hybrid subjective-objective reasonableness standard prescribed by section 273.2, many decision-makers rely on extra-legal criteria and assumptions grounded in their personal experience and opinion about what is reasonable. In the midst of debate over what the accused knew and what steps were “reasonable,” given what the accused knew, the legal definition of consent in section 273.1 is easily overlooked and decision-makers focus on facts that are legally irrelevant and prejudice rational deliberation. The result is failure to enforce the law. The author proposes: (1) that section 273.2 be amended to reflect the significant developments achieved in sexual consent jurisprudence since enactment of the provision in 1992; and (2) that, in the interim, the judiciary act with resolve to make full and proper use of the statutory and common law tools that are presently available to determine whether the accused acted with mens rea in relation to the absence of sexual consent.

Computational censorship in the form of fake news and toxic comments regulation is a subject that comes up quite often in the public discourse, as a result of the volatile political circumstances on a global scale and due to the unquestionable impact of journalism on these circumstances. Public attention has been directed to the role of mainstream and other media in the formation of public opinion, either in the form of articles or in the form of usergenerated comments. The purpose is to analyse and allow a deeper understanding of a project that is under development, namely, computational-censorship and to show that algorithmic regulation is not a solution, but rather another layer to a more fundamental problem. This article examines the implicationsof developing Machine Leraning/Artificial Iintelligence (ML/AI) which aims to regulate the internet and we attempt to allow a glimpse into the technical aspect of the problem as a way to back arguments that could be re-jected by the ML/AI research community as “non-pragmatic”. Finally, it aims to highlight the absurdity of the current approach to research in this area, which is the exact opposite of the rationalism that the field claims to be embracing.
