DRM systems have been implemented in the past few years by the Content Industry as the panacea against all copyright (and Intellectual Property Rights in general) infringements over the Internet. The validity of this statement shall be assessed in this analysis, identifying its strengths and record to-date and highlighting its shortcomings in an increasingly complex e-commerce (Web 2.0) environment. While doing this, particular attention shall be given to (mostly EU) Intellectual Property Law, Consumer Law, Data Protection Law, and Competition Law.

Big data has a very important role in the digital economy, because firms have accurate tools to collect, store, analyse, treat, monetise and disseminate voluminous amounts of data. Companies have been improving their revenues with information about the behaviour, preferences, needs, expectations, desires and evaluations of their consumers. In this sense, data could be considered as a productive input. The article focuses on the current discussion regarding the possible use of competition law and policy to address privacy concerns related to big data companies. The most traditional and powerful tool to deal with privacy concerns is personal data protection law. Notwithstanding, the article examines whether competition law should play an important role in data-driven markets where privacy is a key factor. The article suggests a new approach to the following antitrust concepts in cases related to big data platforms: assessment of market power, merger notification thresholds, measurement of merger effects on consumer privacy, and investigation of abuse of dominant position. In this context, the article analyses decisions of competition agencies which reviewed mergers in big data-driven markets, such as Google/DoubleClick, Facebook/ WhatsApp and Microsoft/LinkedIn. It also reviews investigations of alleged abuse of dominant position associated with big data, in particular the proceeding opened by the Bundeskartellamt against Facebook, in which the German antitrust authority prohibited the data processing policy imposed by Facebook on its users. The article concludes that it is important to harmonise the enforcement of competition, consumer and data protection polices in order to choose the proper way to protect the users of dominant platforms, maximising the benefits of the data-driven economy.

This chapter examines how the Antitrust Damages Directive has been transposed in France. It begins with an overview of the transposition procedure, focusing on the French private enforcement context from the Ordinance of 1 December 1986—the ‘Magna Carta’ of French competition law—to Law no. 2008-776 of 4 August 2008 and the Consumer Law Act of 17 March 2014 (Hamon Law). It then discusses the scope of the transposition measure, noting that the French government went beyond the Directive and instituted a single regime for damages actions, before analysing specific issues that arose during the transposition, including those relating to the concept of an undertaking, the binding effect of competition authorities' decisions, the presumption of harm, the passing-on of overcharges, types of harm and assessment of damages, joint and several liability and the recovery of contributions from co-infringers, consensual dispute resolution, time-barring deadlines, access to evidence, and class actions.

After 9/11, states looked at transportation as if it was a matter of paying taxes: “We cannot make it fun, but we can make it efficient.” When traveling, we are asked to pass on data, give body samples, and pass through body scanners in the name of the general interest and in the name of our safety. Technology complements existing human checks and controls. Here we take a fresh look at the new security apparatuses and make transportation of humans more passenger-centered. Consumer protection law might help to complement the existing use of data protection law principles by citizen organizations. It should be possible to satisfy consumer needs, without forgetting the perspective of the citizen.

Resumen: El proceso emprendido a nivel europeo de revisión, modernización y adaptación de las reglas de protección de consumidores al entorno tecnológico ha puesto en contacto dos esferas nor­mativas de contrapuestos intereses: protección de datos personales y Derecho de consumo. El primer punto de inflexión de la compleja interacción entre ambos marcos regulatorios ha venido de la mano de la Directiva (UE) 2019/770 del Parlamento Europeo y del Consejo, de 20 de mayo de 2019, relativa a determinados aspectos relacionados con los contratos de suministro de contenido digital y servicios digitales, que ofrece los mismos remedios contractuales tanto a consumidores que abonan un precio como a quienes, a modo de contraprestación, facilitan sus datos personales. De las nuevas e interesantes perspectivas de análisis que ofrece la imbricación del derecho fundamental a la protección de datos en la esfera contractual, este trabajo centra su atención en la determinación de las bases de licitud, conforme al Reglamento General de Protección de Datos, de los tratamientos de datos personales derivados del ámbito de aplicación de la Directiva y su incidencia contractual.Palabras clave: Mercado Único Digital Europeo, interacción derecho de consumo-protección de datos personales, suministro de contenidos y servicios digitales, datos personales como contrapresta­ción, principio de licitud del tratamiento.Abstract: The European process of revision, modernization and adaptation of consumer protec­tion rules to the technological environment has brought into contact two regulatory spheres of opposite interests: personal data protection and consumer law. The first inflection point of the complex interac­tion between both regulatory frameworks has come from the hand of Directive (EU) 2019/770 of the European Parliament and of the Council, of 20 May 2019, on certain aspects concerning contracts for the supply of digital content and digital services, which offers the same contractual remedies both to consumers who pay a price and to those who, by way of counter performance, provide their personal data. Of the new and interesting perspectives of analysis offered by the overlapping of the fundamental right to data protection in the contractual sphere, this paper focuses on the determination of the bases of lawfulness, according to the General Data Protection Regulation, of the processing of derived personal data of the scope of the Directive and its contractual impact.Keywords: EU Digital Single Market, interaction consumer law - data protection regulation, supply of digital content and digital services, counter-performance in the form of personal data, princi­ple of lawfulness of the personal data processing.
