COMMUNITY CORRECTIONS IN THE LIST OF THE MAIN CORRECTIONAL MEANS FOR CONVICTS: SOME ASPECTS

В статье рассматривается ряд теоретических проблем общественного воздействия как средства исправления осужденных (его содержание, субъекты осуществления, соотношение с другими средствами исправления и пр.) и недостатков правовой основы данного института. Приводятся практические примеры осуществления общественного воздействия в отношении осужденных к лишению свободы. Делается вывод, что общественное воздействие при ненадлежащем законодательном регулировании представляет собой важнейшее средство исправления осужденных (наряду с режимом), которое с учетом разносторонности субъектов его осуществления имеет многообразное содержание и фактически отчасти дублирует другие средства исправления. The article examines a number of theoretical problems of community corrections as a means of correcting convicts (its content, subjects of implementation, correlation with other means of correction, etc.) and the shortcomings of the legal basis of this institution. Practical examples of the community corrections implementation in relation to persons sentenced to imprisonment are given. It is concluded that community corrections with improper legislative regulation is the most important means of correcting convicts (along with the regime), which, taking into account the versatility of the subjects of its implementation, has a diverse content and in fact partially duplicates other means of correction.

Temporary access to objects and documents is one of the most common means of ensuring criminal proceedings and an important means of gathering evidence. This measure of criminal proceedings represents the undoubtedly basic instrument for the formation and consolidation of evidence, which will further serve as a legal basis for the promulgation of a correct and well-founded procedural decision by the investigator or prosecutor during a full, complete and impartial pre-trial investigation. The author of the article is intended to investigate the problematic issues of regulation of investigating judge`s authority to consideration of applications for temporary access to objects and documents. Attention is drawn to the lack of legislative regulation of the powers of the investigating judge to issue a decision on the return of the petition and the refusal to grant it in the case of non-compliance of such petition with the requirements of criminal procedural legislation. The decision of the investigating judge, type of which is not provided by the CPC of Ukraine, is contrary to the principle of the lawfulness of criminal proceedings, adversely affects the effective protection of the rights, freedoms and interests of the person in the framework of criminal proceedings, the effectiveness of criminal procedural evidence and the formation of unambiguous legal practice. The author concludes that in order to improve the institute of temporary access to objects and documents, the following changes should be made to the CPC of Ukraine: - Art. 163 as a rule on the procedural possibility of an investigating judge to return to a party of criminal proceedings a request for temporary access to things and documents, if it is filed without observing the requirements of Art. 160 CPC of Ukraine; - the norm of refusal to grant such a request in case of non-compliance with the requirements of Part 5 of Art. 163 of the CPC of Ukraine. In view of the above, the investigating judge will be empowered by law to rule on the results of the consideration of the request for temporary access to the things and documents of the decision on: 1) satisfaction of the request, 2) refusal to grant the request, 3) return of the request. The proposed amendments to the current CPC of Ukraine in terms of improving the procedure of temporary access to things and documents as a means of criminal procedural evidence, in particular the introduction of alternative types of rulings, will certainly increase the effectiveness of criminal procedural evidence, as well as ensure the effectiveness of the functioning of the investigative institution.

Источниками таких знаний безусловно служат найденные письменные правовые акты, хронологически относящиеся к исследуемому периоду. Наибольшее внимание исследователей всегда привлекали источники права общегосударственного значения. В работе предлагается проследить некоторые изменения в отношении к обязательствам, вытекающим из договоров займа (ссуды, торговой ссуды) в исторический период, ограниченный хронологическими рамками XII в. и середины XVII в. The degree of development of certain types of economic activity of people living in a certain territory in a particular historical period can be judged by the level of regulation of its legal basis. The sources of such knowledge are undoubtedly found written legal acts chronologically related to the period under study. Sources of law of national importance have always attracted the greatest attention of researchers. The article proposes to trace some changes in the attitude to the obligations arising from loan agreements (loans, trade loans) in the historical period, limited by the chronological framework of the 12th century and the middle of the 17th century.

SummaryA top quality, effective treatment of haemophilia requires an integrated therapeutical concept and an excellent cooperation of an interdisciplinary team. Since years different models are discussed in Germany in order to enlarge the offers for a suitable care of patients with hard to treat diseases. The healthpolitical targets are expressed in the changes of the Code of Social Law number V (SGB V) and in innovations in the statutory health insurance. This new legal basis provides opportunities to implement innovative treatment concepts outside university hospitals and paves the way for ambulant haemophilia centres to offer an integral care, all legally saved by a contract.The Coagulation Centre Rhine-Ruhr reveals as an example how haemophilia treatment in accordance with guidelines and with the latest results of international research can be realise in an ambulatory network.

Purpose. The purpose of the article is to analyze the Universal Declaration of Human Rights as an international legal instrument, which for the first time formulated the foundations of modern democratic status of a human being and its fundamental rights and freedoms. Methodology. The methodology involves a comprehensive study of theoretical and practical material on the subject, as well as a formulation of relevant conclusions and recommendations. During the research, the following methods of scientific cognition were used: dialectical, terminological, formal and logical, systemic and functional. Results. The study found that the main features of the Universal Declaration of Human Rights as a source of international legal mechanism for the protection of human rights are: 1) it is a fundamental, foundational and universal international human rights act of the United Nations; 2) it establishes a system of fundamental human rights; 3) it defines a common system of fundamental international human rights standards; 4) it determines the principles of legal identity of a human being; 5) it determines the fundamental basis and principles of international legal regulation in the field of human rights protection; 6) it acts as an international legal basis for the adoption of the latest legislation on human rights protection; 7) it acts as an international legal basis for the codification of human rights legislation. Scientific novelty. The study found that the Universal Declaration of Human Rights points to the natural origin of human rights, which must be binding on all States and for the whole population, regardless of citizenship, in order to ensure the human rights protection in a democratic and rule-of-law State. Practical importance. The results of the study can be used to improve Ukrainian legislation on human rights and fundamental freedoms.

The statistical number of this category of convicts is analyzed, problematic issues are considered, contradictions and shortcomings in the legal regulation of the procedure for monitoring convicts suffering from drug addiction, and proposals are made to improve the legislative regulation of the procedure for monitoring convicted drug addicts.

The recognition of topoi, i.e. traditional formulae, is an important means of musical analysis. To illustrate this, the paper discusses the types of the battaglia and the pastoral in Bach’s Cantata Halt im Gedächtnis Jesum Christ, and briefly enumerates different types of allusions to jazz in 20th-century compositions by Stravinsky, Milhaud, Blacher, Tippet, and Zimmermann. Then it raises the possibility of an analysis of topoi in Bartók’s music in four main categories. It considers Bartók’s musical quotations from Bach to Shostakovich; the chorale as special topos appearing in Mikrokosmos, in the Concerto for Orchestra, in the Adagio religioso of the Third Piano Concerto; the topos-like employment of the tritone; and finally the idea of a Bartókian Arcadia in the Finale of Music for Strings, and the integration of bird song in the Adagio religioso.
