THE RIGHT OF REMOTE WORKERS TO BE OFFLINE – SOME COMPARATIVE LEGAL REMARKS

The aim of this study is to define the origins and scope of the right to be offline from a European perspective, both with regard to legal regulations and specific sources of labor law in selected European countries and the resolution of the European Parliament adopted on January 21, 2021, calling on the European Commission to regulate the right to disconnect in a separate directive. These considerations are enriched by the analysis of European-level surveys on working conditions of workers using information and communication technologies (ICT) both before and during the pandemic, with particular emphasis on the impact of digital tools on the life and health of remote workers. The analysis of the results of the presented research both from the perspective of technological development and the situation caused by the COVID-19 pandemic, allows to identify significant threats to the safety of remote workers, primarily in the psychosocial sphere, which in turn may lead to the conclusion that it is necessary to regulate the right to be offline at European level.

Rapidly progressing computerisation of administrative procedures requires reflection on its consequences, both in the legal sphere and in the sphere of the practical functioning of administration. One of the most more important issues connected with topic is the impact that computerisation exerts on the right to good administration. Analysis of Italian legal regulations in this area reveals the need to find the right balance between the efficiency and speed of computerised administration and the protection of citizens’ interests. Facilitating the functioning of administration, which results from the implementation of modern information and communication technologies to administrative procedures, should contribute to better implementation of the right to good administration.

In recent decades as a result of the development of information and communication technologies (ICT) and the Internet, we have witnessed major changes in companies. The ICT support of the processes is becoming more and more extensive and comprehensive, which enables the realization of digitalisation. The interconnection of processes, machines, people in a single network makes another level of optimisation available. The changes turned up by digitalisation are not only technological, but they also have an impact on the company's organisation and strategy. Our study aims to create an analytical framework and map the opportunities that digitalisation promises in the food industry and the organisational changes that ICT and technological development bring, with special emphasis on the impact on strategy, employees, and corporate culture. Our results show that companies are not consciously engaged in digitalisation yet, but they exploit their opportunities and make improvements in this sense. Adaptation of digital solutions is often forced by the labour shortage, the pressure to achieve higher efficiency and thus to remain competitive and to service the growth strategy.

Explaining digital impacts on social movements requires moving beyond technological determinism by addressing two underdeveloped questions: How does political strategy shape the use of information and communication technologies (ICTs)? And how do divergent uses of ICTs influence movement outcomes? This study addresses these questions by examining the 2018 educator walkouts in Oklahoma and Arizona—statewide actions initiated through rank-and-file Facebook groups. To explain why the strike in Arizona was more effective than in Oklahoma, despite more auspicious conditions for success in the latter, this study shows that the impact of ICTs is mediated by leaders’ strategic choices. Whereas Oklahoma’s strike was marked by mobilization without organization—scaling up protest without an organizational foundation—Arizona used digital tools to build, rather than eschew, organization. Digital impacts further depend on the nature of the contentious performance itself, since the efficacy limitations of relying solely on ICTs are particularly pronounced for actions like strikes.

The impact and benefit that information and communication technologies (ICT) have in the educational field require new teaching skills. This fact has been increased by the recent crisis caused by COVID-19. This study tries to investigate the level of digital teaching competence (DTC) of Higher Education teachers of Health Sciences, and its relationship with several variables. For this, it has the participation of 300 teachers from the 9 universities of Andalusia (Spain). The research is structured through a descriptive (RQ1) and inferential (RQ2) design. The answers given to the DigCompEdu Check-In questionnaire adapted to the Spanish context are analyzed. The results, which show high levels of reliability of the questionnaire (Cronbach and McDonald) and validity (CFA), indicate that the level of competence is basic-intermediate. In addition, the area in which teachers excel is digital resources. For this reason, it is proposed to structure personalized training plans and continue expanding the characteristics of this study at an international level.

This article argues for the right to nonparticipation for Global Digital Citizenship (GDC). It recuperates the notion of political nonparticipation in the context of information and communication technologies (ICTs) and GDC in order to show that nonparticipation can operate effectively in non-State spheres, particularly online. The paper begins with a discussion of nonparticipation in the context of Nation States and non-Statal Organizations before offering a brief survey of the terms Global Citizenship (GC), Digital Citizenship (DC), and GDC. Nonparticipation in an online context is then explained, followed by a discussion of practical concerns, such as who might enforce GDC rights among global digital citizens.
