Abstract The stresses created by the growing need for family caregivers have failed to prompt federal policy action; in its absence, states are stepping up. This review of state policies that support employment among family caregivers found six main categories of legislative action: paid leave; expanding federally mandated unpaid leave; paid sick time; unemployment insurance for job loss attributable to caregiving duties; establishing family caregivers as a protected classification in employment discrimination; and flexible or alternative work schedules. Despite the demand for policies that support and empower working caregivers, a minority of states have passed such legislation; to date, 9 states have implemented paid family leave; 14 have implemented mandatory sick leave legislation; and 14 have expanded FMLA. This study discusses state-level policy actions, reviews the status and importance of these policies, and finds that despite gaps in caregiver support legislation at the state level, there is significant and promising momentum.

In late 2019, Congress passed the Federal Employee Paid Leave Act (FEPLA) establishing parental leave for most federal civilian employees. The new law provides up to 12 weeks of paid leave within 12 months after the birth, adoption, or foster placement of a child occurring on or after October 1, 2020. Despite its recent enactment, this study draws on survey data from 224 civil servants across 39 federal law enforcement agencies to examine the implications of FEPLA for improving work–life balance in the federal sector. Findings suggest that FEPLA will likely improve work–life balance for female civil servants. However, women may also be afraid to use FEPLA due to perceived loss of future promotional opportunities or other workplace visibilities.

The first few months of postnatal life are critical for establishing key neural connections that support the development of subsequent social, cognitive, and linguistic skills. Yet, the United States lacks a national policy of paid family leave during this important period of early brain development, despite previous research demonstrating links between paid leave and improved maternal mental health, lower rates of infant mortality, and increases in cognitive skills during toddlerhood. The current study examined associations between paid maternal leave and infant brain function at 3-months of age using electroencephalography (EEG). Even after controlling for influential infant and family characteristics, results indicate that compared to unpaid leave, experiences of paid leave were related to distinct EEG profiles, possibly reflecting more mature patterns of brain activity. Findings from this study support past work demonstrating the benefits of paid leave on infant cognitive development and extend this work into early neural functioning. Together with past research, this work suggests that policy interventions mandating paid family leave may lead to reductions in sociodemographic health disparities and set the stage for healthy neurocognitive development.

This article considers a range of legal issues that arise when family and domestic violence impacts upon the workplace. It examines the available data on the costs of family and domestic violence to employers and the community. It discusses the potential for employers to be affected by Australian State and Territory criminal and related laws that are intended to protect a person from family and domestic violence. Recent cases of discrimination arising from family and domestic violence are considered with some speculations as to other possible forms of liability for employers concerning work health and safety and workers compensation laws. The Australian Fair Work Commission’s determination of unpaid family domestic violence leave is also examined, as is the adoption of paid leave by some State and Territory governments and larger Australian employers. The article concludes with some reflections and speculations on how current laws may affect employers and what actions can be taken by employers to adopt supportive measures to protect employees.
