The paper presents the emergence and evolution of the concept of transnational law, from the Philip Jessup’s 1956 novation to the latest approaches, mainly from the western legal scholarship. In the legal writings from Romania or Republic of Moldova, the phenomenon of transnational law remains unexplored or, at best, mentioned incidental as a synonym of a modern “lex mercatoria”. Likewise, in Russian scholarship, research on transnational law bears a strong private imprint and ubiquitous reluctance may be noted. This article aims to discuss, from the perspective of legal pluralism, the loss of the state monopoly in law making, the pluralization of sources of legitimacy for transnational actors, and the reconsideration of the scope of the law, by de-territorializing it. Transnational law is seen thus not just a private regime, but as a system of normative law that transcends international or national law, acts in a distinct social space and addresses specific actors, not only private, but also public or hybrid. In Romanian legal knowledge this approach is missing.

O presente estudo trata do panorama transnacional do racismo, cuja publicização das ofensas é impulsionada pela globalização, restando escancaradas as dificuldades sofridas pelo “ser negro”, as quais se perpetuam no tempo e nos espaços pelos quais se desloca. Estruturado no método indutivo com a adoção da técnica do conceito operacional e da pesquisa bibliográfica, seu objetivo geral é categorizar o Direito Transnacional como rico instrumento de política antirracista, na medida em que visa a proteção do homem. Como objetivos específicos, se busca evidenciar o que é racismo e os fatos históricos e migratórios que lhe sustentam; apresentar o contexto transnacional da discriminação racial; e denunciar a ineficiência estatal, por meio dos tradicionais sistemas normativos internos, no combate ao racismo. Ao final, observar-se-á, que a discriminação racial desferida em face dos migrantes e nacionais, conforme meras características físicas, pode e merece ser enfrentada com os sólidos arcabouços afetos ao Direito Transnacional. Abstract: The current study is about the transnational racism panorama, which the offense publicity is driven by globalization, remaining wide open difficulties suffered about “being black”, which perpetuated in time and spaces through it moves. Structured in the inductive method with the adoption of operational concept technique in the bibliographic, what general goals are to categorize Transnational Law as rich anti-racist political instrument, in a measure that considers protection of men. As specifics goals, its search the evidence in what is racism and the historical facts that sustains; to present the transnational context of racial discrimination; the States inefficiency, through their traditional normative systems in combating racism. By the end, it will be observed that racial discriminations in migrants and nationals, according to few physical characterizes, can and deserves to be seen structures of solid affect frameworks of Transnational Law. : This article aims to advance on the form of Transnational Law, startingfrom Aristotelian philosophical assumptions until its confluence with the manifestations of Transnational Law. Thus, Aristotle’s support stems from the premisethat, even in a space deeply marked by material aspects, the form stands out andfunctions as a vicar for another substance, being, therefore, an important findingfor the theoretical development of Transnational Law and its normative sources.The present research is justified mainly for two reasons: the scientific and practicalrelevance that Transnational Law assumes contemporaneously, and, on the otherhand, the existing gap regarding its form, whose consequences focus on denialor skeptical positions, as well as, in the confusion between analysis of social factsand Transnational Law, which impacts on the construction of standards on thesources of Transnational Law. For the development of this research, the inductivemethod was used, operationalized by the techniques of operational concept andbibliographic research.
