We critically examine the definition of ‘terrorism’ in the Anti-Terrorism Act 1997 of Pakistan and as it is interpreted by the Supreme Court of Pakistan under the principle of legality in criminal and human rights law standards. 1 We conclude that the definition of terrorism under the Anti-Terrorism Act does not pass the test of the principle of legality and the jurisprudence of the Supreme Court of Pakistan is inconsistent confounding the situation further. We recommend that Pakistan, following the principle of legality and human rights standards, amend the current definition of terrorism as an overbroad definition could be misused and abused leading to human rights violations.

The article analyses the Judgment of the Supreme Court of Canada on the Nevsun v. Araya case, which deals with the severe violations of human rights, including slavery and forced labor with respect of the workers of Eritrean mines owned by a Canadian company “Nevsun”. By a 5 to 4 majority, the court concluded that litigants can seek compensation for the violations of international customs committed by a company. This decision is underpinned by the tenets that international customs form a part of Canadian common law, companies can bear responsibility for violations of International Human Rights Law, and under ubi jus ibi remedium principle plaintiffs have a right to receive compensation under national law. Being a commentary to this judgment the article focuses its analysis on an issue that is of a key character for Public International Law, namely on the tenet that international customs impose obligations to respect human rights on companies and they can be called for responsibility for these violations. This conclusion is revolutionary in the part in which it shifts the perception of the companies’ legal status under International Law. The court’s approach is critically assessed against its well-groundness and correspondence to the current stage of International law. In particular, the authors discuss, whether the legal stance on the Supreme Court of Canada, under which companies can bear responsibility for violations of International Human Rights Law is a justified necessity or a head start.

In this article, I investigate the nature and origin of the Alien Tort Statute (A TS) and its link and application to the modern conception ofhuman rights. In the recent Kiobel decision, the Supreme Court resurrected the A TS and found that the A TS does not apply to human rights violations outside of the US allegedly committed by foreign-based corporations. The Supreme Court held that the presumption against extraterritorially applies to common law causes of action under the A TS, and no evidence exists that the First Congress wanted the A TS to confer jurisdiction over extraterritorial torts. In the article, Idevelop the notion ofthe color ofhuman rights to demonstrate that human rights itself has become a sort of lex internationalis.

Discrimination is prohibited in different provisions of the 2003 Constitution of Rwanda (the Constitution), in different pieces of legislation and in international and regional human rights treaties ratified by Rwanda. According to the 2003 Constitution, one of the fundamental principles which have to be upheld by the State is the ‘eradication of discrimination and divisionism based on ethnicity, region or on any other ground as well as promotion of national unity’. Article 15 of the Constitution provides for equality before the law and Article 16 of the Constitution prohibits discrimination and it provides for the grounds on which a person shall not be discriminated against. Rwanda is also one of the very few African countries whose constitutions criminalise discrimination and different laws have been enacted to deal with the offence of discrimination. The Supreme Court of Rwanda, the highest court in the country, has handed down decisions on Articles 15 and 16 of the Constitution. The purpose of this article is to analyse these decisions and illustrate how the Supreme Court has dealt with the issues such as the definition of discrimination and the difference between discrimination and differentiation. The author also discusses the issues that the Rwandan judiciary and prosecutors are likely to face when dealing with the offence of discrimination.

In the 1976 case of Liswaniso v The People, the Zambian Supreme Court held that illegally obtained evidence is admissible as long as it is relevant. Since then, unsuccessful attempts have been made to convince the Supreme Court and the High Court to reconsider this position, especially when the evidence in question has been obtained in violation of a right in the Bill of Rights. Recent decisions from the Supreme Court show that the court is unlikely to change its position on this issue. In this article, the author suggests ways in which the Supreme Court could relax, without necessarily overruling, its rule in the Liswaniso when dealing with evidence obtained through violating human rights.

This article discusses the application of international human rights law by the courts in Malawi. It is divided into five parts. The first part examines the constitutional position of international law at the municipal level and will focus primarily on the position under the current Constitution of Malawi. The second discusses the relevance of international human rights law before national court, with the third part then analysing the relevance of such law in the courts. The fourth part considers the reasons for the attitude of the courts to international human rights law, whilst the final part contains some concluding remarks. The case law discussed is largely that handed down by the Supreme Court and the High Court since 1994.

This chapter examines the engagement of the Irish Supreme Court with the European Convention on Human Rights. It reviews all of the occasions on which decisions of the Supreme Court have been reviewed by the European Commission or Court of Human Rights, cases such as Lawless, Norris, Open Door, Keegan, Heaney, Murphy, Independent News, Bosphorus Airways, McFarlane and O’Keeffe. The argument is made that, like the UK Supreme Court, Ireland’s top court has not been as committed to adopting the ECHR’s standards as it might have been and that the Court is still not adapting its own judgment-writing to take proper account of the jurisprudence of the European Court of Human Rights. That Court has frequently highlighted the inordinate delays which plagued the Irish Supreme Court in the 1990s. More could be done to integrate the European Court’s thinking into the way the Supreme Court goes about developing Ireland’s human rights law.

In the last three decades, unlawful and dangerous act manslaughter has been subject to contradictory recommendations for reform. The debate has been dominated in that time by disagreement over the change of normative position, considered when attempting to justify liability for causing death in the commission of a crime with the objective risk of injury in the circumstances. The article suggests that this current definition of unlawful and dangerous act manslaughter is defensible if appropriately interpreted by the Supreme Court. The interpretation requires an intended unlawful act and the foreseeable risk of injury from a specific circumstance known to the defendant before the unlawful act.

Abstract The Constitution of Ghana, unlike those of other African countries such as Zimbabwe, Kenya, and South Africa is silent on the issue of the admissibility of evidence obtained through human rights violations. Jurisprudence from Ghana demonstrates that although there had been cases in which the High Court and the Court of Appeal briefly dealt with this type of evidence, the Supreme Court, the highest court in Ghana, had not expressed an opinion on this issue until recently. In February 2018, in the case of Cubagee v Asare and Others, the Supreme Court laid down the criteria that Ghanaian courts have to use in determining the admissibility of evidence obtained through human rights violations. In this article, the author argues that much as this is an important decision, the Supreme Court left some issues unresolved and there is still room for improvement.

Abstract Pennsylvania adopted the impairment rating provisions described in the AMA Guides to the Evaluation of Permanent Impairment (AMA Guides) in 1996 as an exposure cap for employers seeking predictability and cost control in workers’ compensation claims. In 2017, the Supreme Court of Pennsylvania handed down the Protz decision, which held that requiring physicians to apply the methodology set forth in the most recent edition of the AMA Guides reflected an unconstitutional delegation of legislative power to the American Medical Association. The decision eliminates the impairment-rating evaluation (IRE) mechanism under which claimants were assigned an impairment rating under the most recent edition of the AMA Guides. The AMA Guides periodically are revised to include the most recent scientific evidence regarding impairment ratings, and the AMA Guides, Sixth Edition, acknowledges that impairment is a complex concept that is not yet defined in a way that readily permits an evidence-based definition of assessment. The AMA Guides should not be considered standards frozen in time simply to withstand future scrutiny by the courts; instead, workers’ compensation acts could state that when a new edition of the AMA Guides is published, the legislature shall review and consider adopting the new edition. It appears unlikely that the Protz decision will be followed in other jurisdictions: Challenges to using the AMA Guides in assessing workers’ compensation claims have been attempted in three states, and all attempts failed.

This article argues for the strengthening and entrenchment of socio-economic rights provisions in Ghana's jurisprudence. The purpose of this entrenchment is to engender judicial activism in promoting more creative pathways for enforcing socio-economic rights in Ghana. The article traces the development of socio-economic rights in Ghana's jurisprudence, especially the influence of the requirements of the international rights movement, particularly of the International Covenant on Economic, Social and Cultural Rights (ICESCR). The article delves into the constitutional history of Ghana and its impact on the evolution of rights in the country. Of particular historical emphasis is the emergence of socio-economic rights under the Directive Principles of State Policy in the 1979 Constitution. However, the significance of the socio-economic rights only became profound with the return to democratic rule under the 1992 Constitution, again under a distinct chapter on Directive Principles of State Policy. However, unlike its counterpart, the chapter on the Fundamental Human Rights and Freedoms, which is directly enforceable, the Directive Principles of State Policy were not. It took the Supreme Court of Ghana a series of landmark decisions until finally, in 2008, it arrived at a presumption of justiciability in respect of all of the provisions in the 1992 Constitution. It is evident that prior to this, the Supreme Court was not willing to apply the same standards of adjudication and enforcement as it ordinarily applies in respect of rights under the chapter on Fundamental Human Rights and Freedoms. Having surmounted the non-justiciability hurdle, what is left is for the courts to begin to vigorously pursue an agenda that puts socio-economic rights at the centre of Ghana's rights adjudication framework. The article draws on comparative experiences from India and South Africa to showcase the extent of judicial creativity in rights adjudication. In India, the courts have been able to work around provisions restricting the enforcement of Directive Principles by often connecting them to Fundamental Freedoms. In South Africa, there is no hierarchy between civil and political rights on the one hand and socio-economic rights on the other; for that reason, the courts give equal ventilation to both sets of rights. The article further analyses these examples in the light of ongoing constitutional reforms in Ghana. It argues that these reforms fall short of the activism required to propel socio-economic rights adjudication to the forefront in Ghana's jurisprudence. In this regard, the article proposes social movements as a viable tool for socio-economic rights advocacy by recounting its success in previous controversial issues in Ghana. The article also connects this to other important building blocks like building socio-economic rights into a national development blueprint. Overall, the article calls for an imaginative socio-economic rights enforcement approach that is predicated on legislation, judicial activism, social movements and a national development blueprint aimed at delivering a qualitative life for the Ghanaian.
