Residential tourists and the half-life of European cosmopolitanism in post-crisis Spain

This article examines British homeowners in Spain after the 2008 economic crisis and their struggles to navigate Spain’s troubled real estate sector. It argues that foreign residents previously embraced European cosmopolitanism but disputes over illegal home construction soured their opinion of European Union (EU) integration. Using ethnographic research and interviews, the article shows how these homeowners contested the idea that EU cohesion policies produced uniform legal systems related to housing and urban development. It also shows that while cosmopolitanism was often spurred at the level of formal politics, cosmopolitan ‘practices’ were subtly endorsed to delineate between those who had agency, and were successfully dealing with the crisis, and those who seemed to be floundering. The article confirms contemporary studies of EU regional polarization and the stalled project of creating ‘social Europe’, while showing how personal conceptions of mobility are highly linked to class.

Spain is currently facing its worst crisis in the last fifty years. The crisis began as an extension of the international financial crisis, but the internal imbalances accumulated in the pre-crisis period aggravated the situation. At present their incomplete adjustment is making difficult the economic recovery. This paper describes the evolution of the economic crisis in Spain. The real estate sector and the banking sector are analyzed in detail, as they played a key role in the detonation and the deepening of the crisis. The results of the main reforms carried out so far are also carefully examined. It also discusses the main factors that have delayed the economic recovery up to now (unemployment and indebtedness), and present some alternatives to define an exit strategy.

Recently, the Nigerian Senate passed the Bankruptcy and Insolvency (Repeal and Re-enactment) Bill. This is no doubt a welcome development following the continued demand by insolvency practitioners, academics and other stakeholders for such legislation. The call has not only been for the enactment of just about any legislation, but (consistent with the economic challenges faced by businesses in the country), one that is favourably disposed to the successful restructuring of financially distressed businesses, allowing them to weather the storm of (impending) insolvency, emerge from it and continue to operate within the economy. This article seeks to situate this draft legislative instrument within the present wave of preventive restructuring ably espoused in the European Union Recommendation on New Approaches to Business Rescue and to Give Entrepreneurs a Second Chance (2014), which itself draws largely from Chapter 11 of the US Bankruptcy Code. The article draws a parallel between the economic crisis that gave rise to the preventive restructuring approach of the Recommendation and the present economic situation in Nigeria; it then examines the chances of such restructuring under the Nigerian draft bankruptcy and insolvency legislation. It argues in the final analysis that the draft legislation does not provide for a prophylactic recourse regime for financially distressed businesses. Consequently, a case is made for such an approach.

This article argues that urban governance, and academic theorisations of it, have focused on the role and strategies of real estate developers at the expense of understanding how investors are shaped by regulatory environments. In contrast, using the case of institutional investment in London’s private rental housing (Build to Rent), in this article I argue that unpacking the private sector and the development process helps reveal different types of risk which necessitate variegated responses from within the real estate sector. In doing so, I demonstrate the complexities of the private sector in urban development, especially housing provision, and the limitations of a binary conceptualised around pro- and anti-development narratives when discussing planning decisions. Instead, I show the multiplicity of responses from within the private sector, and how these reflect particular approaches to risk management. Uncovering this helps theorise the complexities of governing housing systems and demonstrates the potential for risk-based urban governance analysis in the future.

Procurement has long been used to fulfil policy goals, and social procurement policies can mitigate issues connected to social exclusion, unemployment and segregation. The target groups for such policies are disadvantaged people such as immigrants, young people and people with disabilities. Due to its close connection to exclusion and segregation issues, the construction and real estate sector has often been seen by policymakers as an appropriate sector for social procurement. However, practices to implement such policies are underdeveloped, which creates uncertainty and hinders the transition towards sustainability in the construction sector. This paper investigates how construction clients and contractors perceive the implementation of social procurement policies in practice. Drawing on policy-in-practice literature and interviewing 28 actors in the Swedish construction sector, the findings show a misalignment between: (1) social procurement policies, (2) the sector and its existing practices, and (3) the target group and their skills and needs. Although this misalignment adversely impacts policy implementation and practice formation, it can likely be mitigated if actors co-create policy goals and practices that mesh with existing practices, and provide more resources to enable policy implementation. This paper shows how procurement can help fulfil social policies and the difficulties of achieving that in practice.
