Intrusive memories of a traumatic event can be reduced by a subsequent interference procedure, seemingly sparing voluntary memory for that event. This selective-interference effect has potential therapeutic benefits (e.g., for emotional disorders) and legal importance (e.g., for witness testimony). However, the measurements of intrusive memory and voluntary memory typically differ in the role of associations between a cue and the emotional memory “hotspots.” To test this, we asked participants to watch a traumatic film followed by either an interference procedure (reminder plus Tetris) or control procedure (reminder only). Measurement of intrusions (using a laboratory task) and voluntary memory (recognition for film stills) were crossed with the presence or absence of associative cues. The reminder-plus-Tetris group exhibited fewer intrusions despite comparable recognition memory, replicating the results of prior studies. Note that this selective interference did not appear to depend on associative cues. This involuntary versus voluntary memory dissociation for emotional material further supports separate-trace memory theories and has applied advantages.

In this paper the position of victim in criminal procedure for organized crime is analyzed. Through recent changes of our criminal procedure law, the special type of procedure is created in relation to organized crime, with inclusion of large number of specific criminal procedure norms. These new solutions contribute to the protection of victims/witnesses, although there are still more space for the improvement. Legislative body still needs to overcome deeply embedded attitude that the witnesses and victims are the exclusive source of evidence, or, in other words, that the witness testimony is only way to find out evidence information. The victim has to be treated at the first place as a person to whom specific position in criminal procedure, with special regard on the protection of her basic rights, should be guaranteed.

The Will

The advance of medical technologies since the mid-20th century has enabled to prolong a patient’s life in critical situations, though not all patients would tolerate to undergo such treatment. Therefore, the legal question encompass- ing the problem was to resolve the issue of a patient’s refusal of life-sustaining treatment. Since most of such patients are usually irresponsive and lack legal capacity, a solution featuring a legal document akin to a testament or trust has been proposed in the early 70s. Upon the gist of this document, a patient having full legal capacity would anticipate his/her further incapacitation and command to conduct or refuse medical treatment. His/her will, which is reflected in a «living will» has to be notarized, and upon the jurisprudence of various countries worldwide, though not omnipresently, affirmed by a court in order to avoid fraud and satisfaction of the illegitimate interests of third parties. Despite being introduced in the 1970s, living wills are still seldomly drafted by patients. In such case, when the patient lacking a living will falls incapaci- tated, his/her legal representatives and/or the healthcare institution commence civil proceedings so as to define the future fate of the patient using the concept of a substituted judgment, constructed by the courts upon the evidence of the past beliefs and habits of the said person, which requires extensive witness testimony. Resolving the presumed will of the patient is a very complicated issue, and in terms of lack of evidence, courts are not likely to authorize ter- minating the patient’s treatment, acting with a «negative» presumption to rule so. However, courts still may rule that futile treatment is not of the best interests of the patient (which is frequent in respect with minor patients who were born with major congenital ailments). Therefore, a living will, if legitimately drafted, is considered as a firm evidence of the will of the incapacitated person to continue, or to terminate treatment. The «living will» is an entirely voluntary-drafted document and is void upon the fact of undue influence, like an ordinary testament. The intro- duction of such document into the national legislation requires adopting vari- ous legislative acts, and such document is not legally valid unless provided by appropriate legislation. A living will reflects the will of the patient, not his/her legal representatives, and may not be drafted by them. In rare exemptions, the patient, unable of writing, may dictate the will’s content to a duly authorized person (e.g., a guardianship judge, like in Italy). Thus, the approval of the living will execution is the compliance with the will of the patient concerned: his/her guardian expresses his/her will, and the court affirms it. The control- ling function of the courts is hereby apparent. All in all, the «living will» is a considerable institute of private law, enacted in various countries worldwide and has its legal prospects in Ukraine, as well.

This study aimed to analyze the force of private testament proofing and the judge's consideration in the Bitung District Court Decision Number 43 / Pdt.G / 2015 / PN.Bit. about sale without any written evidence. The study used a normative research method with a statutory approach and a case approach. The results showed the power of private testament regarding the Bitung District Court Decision Number 43 / Pdt.G / 2015 / PN.Bit. is strong, judging from the power of physical evidence, the power of formal evidence, and the power of material evidence. However, the sale carried out between the plaintiff and the defendant which was not in the presence of the Land Deed Official had weak legal force because it was not in accordance with the prevailing laws and regulations. In their legal considerations, judges used the principle of sale customary law only, namely light and cash, and witness testimony de auditu as evidence. This legal consideration was deemed inappropriate because it was against the Basic Agrarian Law and in general the witness testimony de auditu was rejected as evidence.

The photocopy acceptable in the court if it matched with the original letter and the strength of that photocopy is the same as the original letter. However, sometimes the original letter has been lost so that it cannot be shown at trial. This paper discusses whether a photocopy that cannot be matched with the original letter can be accepted in the civil procedural law and if it can be accepted how the strength of it, then the discussion will look at the judge’s consideration in two cases related to the issue. The results of discussions are that photocopies that cannot be matched with the original letter can be accepted as evidence if the photocopy matches or is strengthened with other evidence, as the jurisprudence of Decision Nr. 112 K/Pdt/1996 and Decision Nr. 410 K/pdt/2004. The jurisprudence has been followed by similar cases, which is the Decision of the Central Jakarta District Court Nr. 164/Pdt.G/2004/PN.Jkt.Pst jo. Decision of The Jakarta High Court Nr. 234/Pdt/2005/PT.DKI jo. Decision of The Supreme Court Nr. 1498 K/Pdt/2006 which in this case a photocopy can be accepted because it is strengthened by the recognition of the opposing party and The Pontianak District Court Nr.52/Pdt.G/2003/PN.Ptk which received a photocopy because it was strengthened with  witness testimony. The photocopy has a free power of proof (depends on the judge’s assessment). The use and assessment of the strength of the photocopy cannot be independent, but must be linked to other valid evidence. Abstrak Fotokopi surat dapat diterima dalam persidangan apabila dapat dicocokkan dengan aslinya, dan kekuatan pembuktiannya sama seperti surat aslinya. Tulisan ini membahas, dalam hal surat aslinya tidak dapat ditunjukkan di persidangan, apakah fotokopi surat dapat diterima dalam pembuktian hukum acara perdata, dan, apabila dapat diterima, bagaimanakah kekuatan pembuktiannya. Artikel ini menunjukkan, fotokopi surat yang tidak dapat dicocokkan dengan aslinya dapat diterima sebagai alat bukti surat jika bersesuaian atau dikuatkan dengan alat bukti lain, sebagaimana Putusan Mahkamah Agung Nomor 112 K/Pdt/1996 dan Putusan Nomor 410 K/pdt/2004 yang telah menjadi yurisprudensi. Yurisprudensi ini telah diikuti dalam perkara serupa, yaitu dalam Putusan Pengadilan Negeri Jakarta Pusat Nomor 164/Pdt.G/2004/PN.Jkt.Pst jo. Putusan Pengadilan Tinggi Jakarta Nomor 234/Pdt/2005/PT.DKI jo. Putusan Mahkamah Agung Nomor 1498 K/Pdt/2006, di mana dalam perkara ini fotokopi surat dapat diterima karena dikuatkan dengan pengakuan pihak lawan. Demikian juga dalam Putusan Pengadilan Negeri Pontianak Nomor 52/Pdt.G/2003/PN.Ptk, yang menerima fotokopi surat yang tidak dapat dicocokkan dengan aslinya karena dikuatkan dengan alat bukti keterangan saksi. Dengan demikian, fotokopi surat memiliki kekuatan pembuktian yang bebas, artinya diserahkan kepada penilaian hakim. Penggunaan dan penilaian kekuatan pembuktian fotokopi tersebut tidak dapat berdiri sendiri, tetapi harus dikaitkan dengan alat bukti lainnya yang sah.
