<em>This paper aims to analyze the fulfillment the restitution rights for the children as victims after the enactment of government regulation Number 43 of 2017 in Medan based on human rights studies. This research is normative legal research with statute approach which is carried out by examining law and regulations related to the legal issue being raised that is regarding the provision of restitution for child victim of human trafficking in Medan and empirical legal research which gaining data by means direct observation in Medan District Court. Based on the studies, it can be related that restitution must be given to the victims of human trafficking because it is a part of fulfillment of human rights to compensate the victim for losses suffered as the result of a crime.</em>

ABSTRACTThis study aims to determine the form of legal protection against disabled workers with disabilities. This study uses normative research methods with data collection techniques used to solve the problem formulation is by library data obtained based on legislation and literature - literature or official books. Data analysis used is qualitative approach to primary data and secondary data. The result of the research can be concluded that the form of legal protection for workers with disabilities who are harmed by employers by viewing or reviewing Law No.13 Year 2103, in the law has regulated the legal protection for workers with disabilities. Therefore, the need for legal protection is preventive and repressive, by increasing the supervision of the relevant agencies so that the disability workers are not harmed by the employer. And if there has been a dispute then it can be a repressive legal protection, which prioritizes the form of bipartite negotiations, in deliberation and tripartite, mediated by the facilitator. If in such endeavors remain unreachable, either party may make a lawsuit by enclosing minutes of negotiations and being registered with the industrial relations court at the local district court. ABSTRAKPenelitian ini bertujuan untuk mengetahui bentuk perlindungan hukum terhadap pekerja penyandang disabilitas yang dirugikan. Penelitian ini menggunakan metode penelitian normatif dengan teknik pengumpulan data yang digunakan untuk memecahkan rumusan masalah yaitu dengan data kepustakaan yang diperoleh berdasarkan dari perundang – undangan dan literaturr - literatur atau buku - buku resmi. Analisis data yang dipergunakan adalah pendekatan kualitatif terhadap data primer maupun data sekunder. Hasil penelitian dapat disimpulkan bahwa bentuk perlindungan hukum bagi pekerja penyandang disabilitas yang dirugikan oleh pemberi kerja / pengusaha dengan melihat atau meninjau Undang-Undang No.13 Tahun 2103, di undang-undang tersebut sudah mengatur tentang perlindungan hukum bagi pekerja penyandang disabilitas tersebut. Untuk itu perlunya perlindungan hukum secara preventif dan represif,  dengan lebih meningkatkan pengawasan dari dinas terkait agar pekerja disabilitas ini tidak dirugikan oleh pemberi kerja. Dan jika telah terjadi perselisihan maka dapat dilakukan perlindungan hukum secara represif,  yang lebih mengutamakan ke bentuk perundingan secara bipartit, secara musyawarah dan tripartit, dengan ditengahi oleh fasiliator. Jika dalam upaya tersebut tetap tidak mencapai kesepakatan, maka salah satu pihak dapat membuat gugatan dengan melampirkan risalah hasil perundingan dan didaftarkan ke pengadilan hubungan industrial di pengadilan negeri setempat.

This research aims to analyze election violations committed by election organizers in Aceh Besar Regency in 2019. The violation of this election occurred at several points in the sub-district of aceh regency, where the violation of the law is contained in the administration of the election file and also in the part of the organizer that is the election implementation team. This is one of the indicators in this study. Using empirical juridical research methods and qualitative data analysis, the study found that there were only 5 (five) unlawful actions in aceh besar district elections, among which there were un registerable reports, muted reports and follow-up reports to the Jantho District Court. It is recommended to the government, Bawaslu, Panwaslih to conduct more checking or control and also full supervision on a scale to minimize the on-the-process election violations in Aceh Besar Regency in particular as well as other districts.

Limited Liability Company (Ltd.) or Perseroan Terbatas (PT) is a legal entity in Indonesia that constitutes a capital alliance formed by an agreement that features a limited liability principle. Limited liability is a principle that limits the responsibility of shareholders to the risk of the Company. However, the principle of limited liability is frequently misapplied, as shareholders look for ways to protect themselves from the risk of more significant losses, to take advantage of all company profits for personal gain. Shareholders who abuse the principle of limited liability for personal gain, on the other hand, will be subject to the Piercing the Corporate Veil doctrine. This doctrine imposes the transfer of liability for personal losses to shareholders who cause harm to the company in bad faith. Based on this understanding, this paper seeks to comprehend the application of the Piercing the Corporate Veil doctrine by analyzing Medan District Court Decision Number: 656/Pdt.G/2015/PN.Mdn. The research method used in this study was normative legal research reviewed with a statute approach and a conceptual approach. The conclusion drawn from the problem is as follows: the regulation regarding the Piercing the Corporate Veil doctrine is borne not only by shareholders but also by the Board of Directors and the Board of Commissioners who fail to implement the principles of fiduciary duty of skill and care. Furthermore, in the case of 656/Pdt.G/2015/PN.Mdn, the judge considered the provisions of Article 3 paragraph (2) of the UUPT in implementing the Piercing the Corporate Veil Doctrine by punishing the Defendants jointly and severally to indemnify the Plaintiff.

Kegiatas usaha perseroan terbatas dilaksanakan oleh organ perseroan terbatas yaitu Direksi perseroan terbatas, Direksi dapat mewakili perseroan terbatas untuk melakukan kontrak dengan pihak terkait. Tindakan mewakili Perseroan Terbatas oleh Direksi harus sesuai dengan aturan sebagaiman dalam Undang-Undang No. 40 Tahun 2007 Tentang Perseroan Terbatas atau yang telah ditentukan dalam Anggaran Dasar Perseroan Terbatas. Apabilan tidakan Direksi Perseroan Terbatas  melaksanakan Kontrak yang dapat merugikan Perseroan karena bertentangan dengan Undang-Undang No. 40 Tahun 2007 Tentang Perseroan Terbatas atau yang telah ditatur dalam Anggaran Dasar Perseroan Terbatas maka kontrak yang dibuat mengandung Ultra Vires. Jika Direksi melakukan tindakan Ultra Vires maka sesuai dengan Pasal 61 Undang-Undang No. 40 Tahun 2007 tentang Perseroan Terbatas, kepada Pemegang sahan berhak mengajukan Gugatan terhadap Perseroan ke Pengadilan Negeri. Limited liability companies are carried out by Directors of limited liability companies. The directors can represent limited liability companies to enter into contracts with related parties. The act of representing a Limited Liability Company by the Board of Directors must be in accordance with the provisions in Law No. 40 of 2007 concerning Limited Liability Companies or those stipulated in the Articles of Association of Limited Liability Companies. If the actions of the Board of Directors of a Limited Liability Company implement a Contract that could be detrimental to the Company because it is contrary to Law No. 40 of 2007 concerning Limited Liability Companies or those stipulated in the Articles of Association of Limited Liability Companies, the contracts made contain Ultra Vires. If the Board of Directors carries out Ultra Vires actions, in accordance with Article 61 of Law No. 40 of 2007 concerning Limited Liability Companies, the shareholders have the right to file a lawsuit against the Company to the District Court.

Penelitian ini bertujuan untuk mengetahui apakah keterangan saksi verbalisan dapat menunjang keyakinan hakim dalam memutuskan suatu perkara tindak pidana dan apakah keterangan saksi verbalisan tidak bertentangan dengan upaya penegakan hak-hak terdakwa sebagaimana yang diatur dalam KUHP sesuai dengan Putusan Pengadilan Negeri Mamuju Nomor 204/Pid.B/2018/PN.Mam.Penelitian ini dilakukan menggunakan metode penelitian kuantitatif – normatif.lokasi penelitian di Pengadilan Negeri Mamuju. Berdasarkan penelitian yang telah dilakukan oleh Penulis lewat wawancara dengan Majelis Hakim dan Penyidik kepolisian serta menganalisis sebuah putusan yang berkaitan dengan tema peneltian ini, diperoleh hasil: (1) keterangan saksi verbalisan dapat menunjang keyakinan hakim dalam memutus suatu perkara pidana. (2) keterangan saksi verbalisan tidak bertentangan dengan upaya penegakan hak-hak terdakwa sebagaimana yang diatur dalam KUHP. Hakim bebas menilai kebenaran yang terkandung di dalamnya. Serta, kekuatan saksi verbalisan dalam penggunaannya tidak dapat berdiri sendiri melainkan juga harus didukung dengan alat-alat bukti yang lain. Apabila keterangan saksi verbalisan sesuai dengan alat-alat bukti yang lain maka keterangan saksi verbalisan dapat mempunyai nilai dan dapat digunakan dalam membantah sangkalan saksi dalam persidangan. Kesimpulan dari penelitian ini yaitu Penggunaan saksi verbalisan (saksi penyidik) dalam proses pembuktian perkara pidana diperlukan apabila dalam pemeriksaan sidang pengadilan saksi dan atau terdakwa memungkiri keterangan yang ada berita acara penyidikan karena adanya unsur paksaan atau tekanan baik itu berupa tekanan mental maupun fisik dari pihak penyidik pada waktu pembuatan berita acara penyidikan, sehingga menyebabkan fakta-fakta hukum yang didapat dalam pemeriksaan pengadilan menjadi kurang jelas. This study aims to determine whether the verbal witness testimony can support the judge's conviction in deciding a criminal case and whether the verbal witness testimony does not conflict with efforts to enforce the defendant's rights as regulated in the Criminal Code in accordance with the Mamuju District Court Decision Number 204/Pid.B /2018/PN.Mam. This research was conducted using quantitative, normative research methods. The research location was at the Mamuju District Court. Based on the research that has been done by the author through interviews with Judge Majelis and police investigators and analyzing a decision related to the title of the thesis, the results obtained are: (1) verbal witness testimony can support the judge's belief in deciding a criminal case. (2) the testimony of the verbal witness does not contradict the efforts to enforce the rights of the accused as regulated in the Criminal Code. Judges are free to judge the truth contained therein. Also, the power of verbal witnesses in their use cannot stand alone but must also be supported by other evidence. If the verbal witness testimony is in accordance with other evidence, the verbal witness testimony can have value and can be used to refute the witness's denial in the trial. The conclusion of this study is that the use of verbal witnesses (investigating witnesses) in the process of proving a criminal case is necessary if during a trial the witness and/or the defendant denies the information contained in the investigation report because of an element of coercion or pressure either in the form of mental or physical pressure from the investigator at the time of making the investigation report, causing the legal facts obtained in court examination to be less clear.

Employment relationships may end due to abuse by workers. The existence of abuse must be medically proven. This research aimed to analyze the existence of a visum et repertum for the occurrence of abuse that can be used as evidence in termination of employment. This legal research was normative with a statutory approach. The results showed that persecution was a criminal act. There was no requirement for a judge's decision in the District Court which already had permanent legal force for the occurrence of persecution as a condition for the validity of the layoff as if the visum et repertum was no longer needed. It was enough that the acts of abuse committed by workers were regulated in the Employment Agreement, Company Regulation or Collective Labor Agreement, then the persecution as a form of an urgent violation can be used as a valid reason for the termination of employment (Article 81 number 37 of the Job Creation Law jo.  Article 151 / 3 Manpower Law jo. article 52/2 Government Regulation 35/2021. The researchers’ efforts to review labor regulations related to urgent violations in the Indonesian manpower system are a form of evaluation of the weaknesses of the Job Creation Law and its implementing regulations can be able to assist legislators to develop and enforce laws that protect certain vulnerable groups namely workers in applying the principle of presumption of innocence.Keywords: Forensics; Persecution; Termination. Eksistensi Visum Et Repertum Atas Terjadinya Penganiayaan Sebagai Alat Bukti Pemutusan Hubungan KerjaAbstrakHubungan kerja dapat berakhir karena adanya penganiayaan yang dilakukan oleh pekerja. Adanya penganiayaan harus dibuktikan secara medis. Penelitian ini bertujuan untuk menganalisis adanya visum et repertum atas terjadinya penganiayaan yang dapat digunakan sebagai alat bukti dalam pemutusan hubungan kerja. Penelitian hukum ini bersifat normatif dengan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa  penganiayaan adalah perbuatan pidana. Tidak adanya keharusan putusan hakim di Pengadilan Negeri yang sudah memiliki kekuatan hukum tetap atas terjadinya penganiyaan sebagai syarat keabsahan PHK seolah mengakibatkan visum et repertum tidak dibutuhkan lagi. Cukup perbuatan penganiayaan yang dilakukan oleh pekerja diatur dalam Perjanjian Kerja, Peraturan Perusahaan atau Perjanjian Kerja Bersama, maka penganiayaan sebagai wujud telah terjadi pelanggaran yang bersifat mendesak dapat digunakan sebagai alasan keabsahan pemutusan hubungan Kerja (Pasal  81 angka 37 UU Cipta Kerja jo.  Pasal 151 /3 UU Ketenagakerjaan jo.Pasal 52/2 Peraturan Pemerintah 35/2021. Upaya penulis untuk mereview peraturan perburuhan terkait pelanggaran yang bersifat mendesak dalam sistim ketenagakerjaan Indonesia merupakan bentuk evaluasi atas adanyan kelemahan UU Cipta Kerja dan Peraturan pelaksananya, akan dapat membantu legislator untuk mengembangkan dan menegakkan hukum yang melindungi kelompok rentan tertentu yaitu pekerja dalam menerapkan asas praduga tak bersalah.Kata Kunci: Forensik; Penganiayaan; Pemutusan Hubungan Kerja Наличие Visum Et Repertum в случае преследования как доказательство прекращения работы АннотацияТрудовые отношения могут прекратиться из-за жестокого обращения со стороны работников. Наличие жестокого обращения должно быть доказано с медицинской точки зрения. Это исследование было направлено на анализ наличия visum et repertum в случаях злоупотреблений, которые могут использоваться в качестве доказательства при увольнении. Это правовое исследование было нормативным с законодательным подходом. Результаты показали, что преследование было уголовным преступлением. В районном суде не требовалось вынесения решения судьей, которое уже имело постоянную юридическую силу в связи с преследованием в качестве условия действительности увольнения, как если бы в visum et repertum больше не было необходимости. Достаточно того, чтобы акты жестокого обращения, совершенные работниками, регулировались трудовым договором, регламентом компании или коллективным трудовым договором, тогда преследование как форма неотложного нарушения может быть использовано в качестве уважительной причины для увольнения (статья 81 № 37 Закона о создании рабочих мест, ст. 151/3 Закона о рабочей силе, ст. 52/2 Постановление правительства 35/2021. Усилия исследователей по пересмотру трудового законодательства, касающегося неотложных нарушений в индонезийской системе кадровых ресурсов, являются формой оценки Слабые стороны Закона о создании рабочих мест и его подзаконных актов могут помочь законодателям в разработке и обеспечении соблюдения законов, которые защищают определенные уязвимые группы, а именно работников, в применении принципа презумпции невиновности.Ключевые слова: судебная экспертиза, преследование, прекращение действия

One of the executions of the mortgage object is the sale of the mortgage object through a public auction based on the executorial title contained in the Mortgage Certificate. Before the implementation is carried out by the creditor, a permit (fiat) is required by the local district court. The application for an auction for the execution of mortgage rights through a district court is closely related to obstacles, for example, a lawsuit from a third party (derden verzet) who feels he has the right to the object of execution even though it has nothing to do with creditors and debtors. This opposition made the Chief Justice of the District Court unable to grant the request for execution even though the creditor had a mortgage certificate that was encumbered but was forced to examine the relevant evidence in the trial forum to determine whether the resistance was sufficient reason or just a conspiracy with the debtor to delay the execution. Based on this explanation, the author wants to examine the legal force of the Grosse deed as the basis for the implementation of the mortgage execution auction. The type of research in writing scientific papers is a normative legal research type, with a statutory approach and a legal concept analysis approach (Analytical and Conceptual Approach). The sources of legal materials used in writing this scientific paper came from primary legal materials, secondary legal materials, and tertiary legal materials. The legal materials were collected using library research techniques. Then analyzed using description, systematization, evaluation and finally concluded with argumentation technique. The results of this study are expected to provide scientific knowledge for academics, law enforcers, and the public.
