ABSTRACT Context: triggered in 2014, the Car Wash Operation (CWO) belongs to a process of changing the legal context, in the sense of greater responsibility and penalization of public and private companies’ decision makers for acts practiced in the exercise of their functions, object of the Directors’ and Officers’ liability insurance coverage (D&O). Objective: to evaluate the relationship between the growth in the revenues of D&O insurance premiums and the developments of the OCW in Brazil, under the hypothesis of a change in the perception of economic agents exposed to risks covered by D&O insurance, in a process known as probability updating. Methods: official monthly data for all active insurers, arranged longitudinally between 2003 and 2017, and using two-stage regression method for panel data. Results: the OCW had a positive effect not only to the probability of offering this type of insurance, but also to increase the volume of D&O premiums; these results are consistent with the probability-updating hypothesis. Conclusion: the OCW resulted in an increase in revenues of D&O premiums, but there was a negative relationship between OCW and the entire insurance market, suggesting significance of this operation in the sector retraction observed since its outbreak.

O texto trata dos contratos de seguro de responsabilidade civil sob a modalidade “D&O” (directors & officers liability), recentemente regulamentos pela SUSEP, cujo objeto é a proteção do risco pela responsabilização de administradores de empresas (diretores e conselheiros de administração) em razão de atos cometidos no exercício de suas atividades. O enfoque da pesquisa reside nas cláusulas de afastamento de cobertura pelo cometimento de atos relacionados à corrupção – o que, segundo a lógica aplicada por algumas seguradoras, implicaria no risco moral e no aumento dos casos de violação à legislação anticorrupção. Nesse cenário, é proposta uma análise crítica acerca da cláusula de afastamento de cobertura, notadamente a partir da sua interpretação a partir da eficiência e proporcionalidade.

The article is devoted to the problems of innovative enterprise development. Since the Russian economy is in a state of financial and economic stagnation, there is a need to apply radically new innovative directions of business activities that ensure the effective use of financial potential within the framework of national projects. Practice shows that today the business sector in Russia is not able to provide a full-fledged demand for new technologies. Therefore, there is a need for substantial state support to provide centralized orders for high-tech industries. There are already examples of combining the efforts of a number of Autonomous economic entities to implement innovative reforms, new organizational forms of interaction have been formed, such as: centers for the implementation of innovative ideas; centers for engineering services; business incubators, etc. The subjects of these organizational forms of cooperation developed and proposed measures aimed at innovative solution of technological problems relevant to the regional economy, as well as for the country as a whole. Link for the efficient interaction of economic agents becomes an inherent characteristic, is the need of implementation of mechanisms of coordination with “network interaction”. It is important to note the fact that the existing relations and forms of regulation of various systems are not permanent, there are no strategic concepts aimed at long-term public and private cooperation.

Our study significantly contributes in understanding a comparative framework and the interactions of idiosyncratic and systematic factors for determining non-performing assets (NPA) and rate of recovery for banks in India, as put forward by Basel committee. Although determinants of NPA is very well debated issue, the comparison of public and private sector banks in terms of their assets quality i.e. NPAs and rate of recovery and their determinants like collateral, operational inefficiency, GDP growth rate etc. are the added contribition of this study. We have employed Arrelano–Bond dynamic panel method on 35 banks in India for the period 1998–1999 to 2017–2018 for determinants of NPAs, while determinants of rate of recovery are studied for the period 2003–2004 to 2017–2018. Our findings show that the priority sector loan has significant differences in determining NPA across banks despite them having sufficient collateral. The negative relationship between collateral and recovery, especially for private sector banks, signifies low recovery for illliquid collateral. This study may recommend that a bank with high net interest margin (NIM), high proportion of secured and liquid collateral, and sufficient mix of long- and short-duration loans in line with bank’s asset liability policy can manage their portfolio well.

AbstractOver the last year, the dangerous severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) has spread rapidly around the world. Malaysia has not been excluded from this COVID-19 pandemic. The resurgence of COVID-19 cases has overwhelmed the public healthcare system and overloaded the healthcare resources. Ministry of Health (MOH) Malaysia has adopted an Emergency Ordinance (EO) to instruct private hospitals to receive both COVID-19 and non-COVID-19 patients to reduce the strain on public facilities. The treatment of COVID-19 patients at private hospitals could help to boost the bed and critical care occupancy. However, with the absence of insurance coverage because COVID-19 is categorised as pandemic-related diseases, there are some challenges and opportunities posed by the treatment fees management. Another major issue in the collaboration between public and private hospitals is the willingness of private medical consultants to participate in the management of COVID-19 patients, because medical consultants in private hospitals in Malaysia are not hospital employees, but what are termed “private contractors” who provide patient care services to the hospitals. Other collaborative measures with private healthcare providers, e.g. tele-conferencing by private medical clinics to monitor COVID-19 patients and the rollout of national vaccination programme. The public and private healthcare partnership must be enhanced, and continue to find effective ways to collaborate further to combat the pandemic. The MOH, private healthcare sectors and insurance providers need to have a synergistic COVID-19 treatment plans to ensure public as well as insurance policy holders have equal opportunities for COVID-19 screening tests, vaccinations and treatment.
