How EPA Ireland is using new technologies in its regulatory processes: Case study on the Environmental Protection Agency (EPA)

The Environmental Protection Agency (EPA) provides access to information on a variety of topics related to the environment and strives to inform citizens of health risks. The EPA also has an extensive library network that consists of 26 libraries throughout the United States, which provide access to a plethora of information to EPA employees, scientists, and researchers. The EPA implemented a reorganization project to digitize their materials so they would be more accessible to a wider range of users, but this plan was drastically accelerated when the EPA was threatened with a budget cut. It chose to close and reduce the hours and services of some of their libraries. As a result, the agency was accused of denying users the “right to know” by making information unavailable, not providing an adequate strategic plan, and discarding vital materials. This case study explores the background of the digitization project, the practices implemented, and the critiques of the project.

AbstractThis paper argues that regulatory agencies have a responsibility to further the public interest when they determine the conditions under which new technological products may be commercialized. As a case study, this paper analyzes the US 9th Circuit Court’s ruling on the efforts of the US Environmental Protection Agency (EPA) to regulate an herbicide meant for use with seed that are genetically modified to be tolerant of the chemical. Using that case, it is argued that when regulatory agencies evaluate new technological products, they have an obligation to draw on data, analyses, and evaluations from a variety of credible epistemic sources, and not rely solely or even primarily on the technology developer. Otherwise, they create conditions for their own domination and that of the polity by the technology developer. Moreover, in the interest of advancing the public interest, regulatory agencies must evaluate new technologies in a substantively and procedurally unbiased manner.

Technology transfer is an important activity within the ll.S. Environmental Protection Agency. Specific technology transfer programs such as the activities of the Center for Environmental Research Information, the Innovative and Alternative Technology Program, as well as the Small Community Outreach Program are used to encourage the utilization of cost-effective municipal pollution control technology. Case studies of three technologies including a plant operations diagnostic/remediation methodology, alternative sewer technologies and ultraviolet disinfection are presented. These case studies are presented retrospectively in the context of a generalized concept of how technology flows from science to utilization which was developed in a study by Allen (1977). Additional insights from this study are presented on the information gathering characteristics of engineers and scientists which may be useful in designing technology transfer programs. The recognition of the need for a technology or a deficiency in current practice are important stimuli other than technology transfer for accelerating the utilization of new technology.
