African Union�s Transitional Justice Policy (AUTJP) acknowledges that conflicts affect women and girls disproportionately. Implied in this is the need for transitional processes that take into account the gendered nature of conflicts as well as the role of women in contributing to peacebuilding processes and transitional mechanisms. The article contextualises transitional justice within the framework of gender and grass-roots peacebuilding. From both theoretical and empirical perspectives, the article discusses snippets that depict women as contributors to peacebuilding and transitional justice mechanisms in Kenya�s North Rift conflicts. The study shows that women have used responsibility in burdens; advocacy; membership in village peace committees; negotiation with patriarchy; sensitisation and memorialisation; and socio-economic empowerment, as approaches to build peace and transition communities at the grass-roots level. These efforts feed into transitional justice�s tenets of peace processes, reconciliation, social cohesion, memorialisation, and local ownership. The paper illustrates the need for peacebuilders to focus more on integrating women�s voices in local and mainstream peacebuilding mechanisms.

This article examines the transformation of the Kenya National Commission on Human Rights (KNCHR) and discusses the implications of such transformation on the promotion and protection of human rights in Kenya. The article is an exposition of the powers of the Commission and their importance to the realisation of the Bill of Rights under the 2010 Kenyan Constitution. This is done from a normative and institutional perspective with particular emphasis on the extent to which the UN Principles Relating to the Status of National Institutions for the promotion and protection of human rights (the Paris Principles, 1993) have been complied with. The article highlights the role of national human rights commissions in transformative and/or transitional justice in post-conflict Kenya. It also explores the possible complementary relationship(s) between the KNCHR and other Article 59 Commissions for the better enforcement of the bill of rights.

The place and role of local government within the structure of government in Africa has attracted much public interest. Prior to and after independence, African countries used local government as the administrative units of central governments without their having any legal status, to the extent that local authorities were under the strict control of central governments. The autonomy of local government is pivotal in the democratisation of a country. The United Nations, European Union and African Union have adopted treaties to promote the recognition and protection of local government in the state parties’ constitutions. Accordingly, this article explains the status of local government in Africa and its impact on strengthening democracy in African states.

This work focuses on a compared analysis of the South Afri- can decision related to the “peace and reconciliation act” of this country’s Parliament, and the Colombian decision regarding the amendment of the constitution called “The juridical framework for the peace.” Turning to the structure, it is developed in three major topics: 1. It provides a brief of the historical context, political background and an overview of the two decisions.2. It gives a structural analysis of the powers that each Court has and the nature of the constitutional mechanism through which both Courts decided the constitutionality of the said norms 3. It presents a critical analysis on the similarities and differences between the two systems and judgments. It presents some con- clusions.

Universal jurisdiction permits states to investigate and prosecute perpetrators of certain widely condemned offences, irrespective of whether they possess any of the traditional territorial, nationality, or other jurisdictional links to the offence. As a legal principle, African states accept the principle of universal jurisdiction, but in the past decade they have pushed back against it due to the perception that the courts of various European states have unfairly targeted African government officials that they perceive as enemies. Against this background, the chapter examines the status of the universal jurisdiction debate and how it relates to the role of the International Criminal Court and that of the African Union and its member states, in addition to evaluating the proposals made by African states within the framework of the United Nations to address the African government concerns about double standards in the application of universal jurisdiction through a special ad hoc committee of the General Assembly.

The growing interest in ‘During Conflict Justice’ (DCJ) in areas experiencing ongoing, sustained violent ‘conflict’ has further demonstrated the confluence between transitional justice and liberal peacebuilding approaches. Nowhere so is this more evident than in the case of Palestine-Israel where an ongoing process of Israeli settler-colonialism in historic Palestine continues, with the further spotlighting of ‘justice’ issues that are longstanding and unresolved. This article critiques the application of TJ/DCJ in Palestine-Israel and calls for a radicalisation of its application so as to ensure a platforming of conversation around decolonisation. It does so by critiquing the impact of discourse, specifically the framing of the ‘conflict’ and focuses on the nefarious role of a liberal peace building agenda in Palestine-Israel, a process that has embedded a deeply unjust and inequitable status quo. An insight into several ‘top-down’ and ‘bottom-up’ strategies of TJ/DCJ in Palestine-Israel is provided, with the conclusion reached that; any TJ/DCJ praxis that does not platform meaningful conversation around decolonisation in the region will ultimately amount to the individualisation of ‘justice’ whilst failing to address root causes.
