In November, 1978, the Pocatello Social Service Agency accused six older Bannock-Shoshoni women from the Fort Hall reservation of withholding financial information while receiving supplemental security income (SSI). The women were charged with fraud and ordered to repay the SSI payments. With the help of an Idaho legal aid office, the women contested the agency ruling on repayment. Legal Aid contended that the women were misinformed of SSI rules and of their individual responsibilities. The social service agency claimed the women knew the rules and chose to ignore them. When the disagreement ended up in court, I was asked to help out. The issue seemed clear. Did the Indian women understand what was expected of them?
