Abstract The research aims to determine the practice of implementing good governance in the context of administrative law. This writing is a legal writing that uses a conceptual approach. The results of the study show that the legislative body in carrying out the regulatory function must base on good / decent regulatory principles / principles by developing knowledge and skills in the field of legislation as mandated by Law Number 12 Year 2011 along with its attachments. In general, there are two main means used to assess good / decent governance, namely Procedure and Facts used in making decisions, in addition to attention to several legal principles as a manifestation of the implementation of the principle of democracy. Judicial control in overseeing government actions against decisions made, including in Judicial Review, which are repressive and prioritize the legality aspect (rechtmatigheid) of a decision. Penulisan ini merupakan penulisan hukum yang menggunakan pendekatan konseptual. Hasil penelitian menunjukan bahwa Badan legislatif dalam menjalankan fungsi regulasi wajib mendasarkan pada prinsip-prinsip/ asas-asas regulasi yang baik/layak dengan mengembangkan pengetahuan dan ketrampilan di bidang perundang-undangan sebagaimana diamanatkan oleh Undang-Undang Nomor 12 Tahun 2011 beserta lampirannya. Pada umumnya terdapat dua sarana utama yang dipergunakan untuk menilai tentang penyelenggraaan pemerintahan yang baik/layak, yakni Prosedur dan Fakta yang dipergunakan dalam mengambil keputusan, di samping perhatian terhadap beberapa prinsip hukum sebagai wujud dari pelaksanaan asas demokrasi. Kontrol peradilan dalam mengawasi tindakan pemerintah terhadap keputusan yang dibuatnya, termasuk dalam Judicial Review,  yang bersifat represif dan mengutamakan aspek legalitas (rechtmatigheid) dari suatu keputusan. Courts and tribunals have distinct roles within the Australian administrative law system at the federal level, and to a lesser extent, in the states and territories. Questions of law are for the courts, and questions of fact are for the executive and tribunals. From time to time this orthodoxy is questioned. Suggestions are made that the courts are increasingly tending to intrude into the province of tribunals. Using cases as illustrations, this article explores five relevant jurisdictional areas —from appeals on a question of law to deference under the Administrative Decisions (Judicial Review) Act 1977 (Cth) s 10(2)(b)(ii)—to test the accuracy of the suggestion.

The article addresses the issue of judicial control of the implementation of Common Foreign and Security Policy at international regional level within the framework of the relaunching of the negotiation in view of the accession of the EU to the ECHR. Considering the extent of jurisdiction of the CJEU in respect of Common Foreign and Security Policy field in the light of its case law (sections 1 and 2), it analyses the question of judicial review of Common Foreign and Security Policy within international regional justice by the ECtHR in the light of the ongoing negotiations (section 3), in the perspective of the relationship between non-national courts (section 3.A), having as background the (2013) Draft Agreement of accession (section 3.B.1). After addressing the relaunching of the negotiation procedure (section 3.B.2) and the issue of CFSP control by the ECtHR according to the recent (re)negotiation meetings (section 3.B.3), some concrete proposals, including for the redrafting of the accession agreement, will be put forward (section 3.B.4), as well as a conclusion (section 4).

AbstractThe 1994 Malawian Constitution is unique in that it, among other things, recognizes administrative justice as a fundamental right and articulates the notion of constitutional supremacy. This right and the idea of constitutional supremacy have important implications for Malawi's administrative law, which was hitherto based on the common law inherited from Britain. This article highlights the difficulties that Malawian courts have faced in reconciling the right to administrative justice as protected under the new constitution with the common law. In doing so, it offers some insights into what the constitutionalization of administrative justice means for Malawian administrative law. It is argued that the constitution has altered the basis and grounds for judicial review so fundamentally that the Malawian legal system's marriage to the English common law can be regarded as having irretrievably broken down as far as administrative law is concerned.
